Abstract:Z diskriminacijo, ki pomeni kršitev načela enakega obravnavanja in načela enakih možnosti, se srečujejo tudi delavci starši. Diskriminacijo delavcev prepovedujejo dokumenti Organizacije združenih narodov, dokumenti Sveta Evrope, konvencije Mednarodne organizacije dela in direktive Evropske Unije. Na nacionalni ravni pa so med najpomembnejši pravnimi viri, ki prepovedujejo diskriminacijo delavce staršev, Zakon o uresničevanju načela enakega obravnavanja, Zakon o enakih možnosti žensk in moških ter Zakon o delovnih razmerjih, ki staršem zagotavlja tudi pravico do posebnega varstva v delovnih razmerjih. Starši se z diskriminacijo srečujejo že v času iskanja zaposlitve, v času trajanja delovnega razmerja in tudi pri odpovedi pogodbe o zaposlitvi. V primeru diskriminacije ima delavec pravico zahtevati sodno varstvo, lahko se obrne na Inšpektorat za delo ali pa poskuša svoje pravice uveljaviti v neformalnem postopku pred Varuhom človekovih pravic ali Zagovornikom načela enakega obravnavanja. Spore pa lahko rešuje tudi s pomočjo arbitraže ali mediacije. Kljub številnim pravnim virom, ki diskriminacijo prepovedujejo, do nje še vedno prihaja zaradi delne neusklajenosti nacionalne ureditve z mednarodno ureditvijo. Problem predstavlja tudi prikrita diskriminacija, ki je težko dokazljiva in se dogajaj za zaprtimi vrati. Sistem pravnega varstva diskriminiranih oseb je precej razpršen in, za prava nevešče osebe, tudi zelo zapleten in nejasen, zato nekatere žrtve diskriminacije tega sploh ne prijavijo. V Bosni in Hercegovini delavce starše, pred diskriminacijo, varujejo slovenskim podobni nacionalni pravni viri in, razen virov EU, enaki viri mednarodnih organizacij.

Title:DISCRIMINATION AGAINST WORKER PARENTS
Abstract:A discrimination, which is a violation of the equal treatment and equal opportunities, is also present at parent workers. The discrimination of workers is treated in documents of the UN, the Council of Europe, the convention of ILO and the directive of EU. On the national level in Slovenia we have several legal acts which deal with the discrimination of the parent workers; The Equal treatment law, the Equal opportunity for men and women law and the Employment law, the latter provides a special protection for parent workers. Parents are already met with the discrimination when searching for work, during the employment period itself and also at the resignation. In the case of discrimination employees are entitled to the legal protection, they can turn on the Labor inspectorate or try to defend their rights in the informal procedure in front of the ombudsman. Conflicts can be also solved with arbitrage or meditation. The discrimination is still present, regardless of numerous legal sources, due to the partial mismatch of national regulation with the international one. One of the problems is also hidden discrimination behind the closed door which is very hard to prove. The system of legal protection of discriminated individuals is quite diverted and for laics very complicated and unclear, therefore some victims do not press charges against the offender. In BIH there is a similar national legal protection from discrimination as in Slovenia and also similar international legal protection.
