Title:Dokazna vrednost izvedenskih mnenj na primeru Kamenik : diplomsko delo univerzitetnega študija

Abstract:V diplomski nalogi so zajeta osnovna spoznanja s področja dokazovanja, izvedenstva, povezana z izvedenstvom za preiskavo sledi obuval, in pomembnost izvedenskih mnenj za sam kazenski postopek. Sojenja brez pritegnitve izvedenca v dokazni postopek si danes niti ne moremo več predstavljati, saj z izvedenstvom vstopajo v kazenski postopek vedno bolj natančni znanstveni načini ugotavljanja dejstev, pomembni za učinkovito reševanje kazenskih zadev. Rezultat izvedenstva je izvedensko mnenje, ki daje strokoven odgovor na zastavljeno vprašanje, in je dokaz kot vsak drug dokaz. V izvedenskem mnenju izvedenec opredeli ali so obuvala, ki so bila zasežena osebi, povzročila preiskovano sled, oz. kolikšna je verjetnost, da so ravno zasežena obuvala povzročila preiskovano sled. Njegov pomen ni samo v strokovnosti, ampak tudi v večji objektivnosti in s tem zanesljivosti odgovorov o pravno relavantnih dejstvih. Kljub vsemu pa je dokazna vrednost izvedenskih mnenj podvržena načelu proste presoje dokazov, saj sodišče ni vezano na ugotovitve izvedenskega mnenja. Izvedenska mnenja so v primeru Kamenik pomembno vplivala na potek sojenja. Poglavitni dokaz v primeru štirikratnega umora v Tekačevem je sled obuvala, zaradi katere je med petimi, tako domačimi kot tujimi izvedenci, prišlo do velikih razhajanj, in posledično še danes obstaja dvom o Kameniku kot storilcu kaznivega dejanja umora.

Abstract:My diploma covers the basic knowledge about evidence, expert for footwear marks, expert opinion and importance of expertise for criminal proceedings. With expert evidence in criminal proceedings enters increasingly detailed scientific ways of determing facts, relavant for effective solving criminal cases, which is why we can not imagine judging without expert evidence. Expert opinion is evidence like any other evidence and it provides professional answer to question, which was reffered to expert. For instance, expert for footwear marks in his expert opinon usually answers if seized shoes causes footwear mark and what is probability that seized shoe causes footwear mark. Its importance is not only in professionalism, but also in the grater objectivity and reliability of answers about legal facts. The court is not bounded by the findings of expert opininion. Moreover, the judge decides on the principles of free evaluation of evidence. In case Kamenik expert opinion had a significant influence on the course of trial. The main evidence in the case is footwear shoe track. Local and foreign experts have come into conflict and large divergences precisely becouse of that footwear shoe track, and also the trail has not ended becouse of differences between experts.
