Abstract:Nagrada za inovacijo mora biti vzpodbuda za inoviranje. V primerjavi s poslovno skrivnostjo so visoki stroški največja slabost patentiranja izuma, ki jih majhna in srednje velika podjetja težko zmorejo. Zakon o izumih iz delovnega razmerja določa obvezno nagrajevanje za izume ustvarjene v delovnem razmerju ter ureja druge pravice in obveznosti delodajalcev, ki izhajajo iz izumov, ustvarjenih v delovnem razmerju. Podrobnejše kriterije za odmero nagrade določa Pravilnik o nagradah za izume iz delovnega razmerja. Pravica do nagrade je odvisna od dejstva, ali gre za prosti ali službeni izum, ki ga Zakon o izumih iz delovnega razmerja opredeljuje kot neposredni službeni izum, ki je ustvarjen pri izpolnjevanju pogodbe o zaposlitvi, na izrecno zahtevo delodajalca ali pa na podlagi posebne pogodbe med delodajalcem in delavcem. V skladu z omenjenim zakonom je službeni izum tudi posredni službeni izum.

Title:JOB-RELATED INVENTION AND EMPLOYEE'S RIGHT TO COMPENSATION
Abstract:Reward for employee's innovation should be an incentive to innovate. In comparison to a trade secret the most important disadvantage of patent protection are relatively high expenses, that small and medium enterprises cannot afford. Rights and obligations of employers and employees deriving from inventions made in the course of employment are governed by Job Related Inventions Act, which provides reward for patentable innovation. Rules on Compensation for Job Related Inventions specify the decisive factors for the assesment of compensation. The employee's right to compensation depends on whether invention made by employee is either independent invention or job-related invention, that is defined by Job Related Inventions Act as a direct job-related invention, which is made in the course of implementation of the employment contract, at the employer's explicit request, or on the basis of a special contract concluded between the employer and the employee. In accordance with the law mentioned above, a job-related invention can also be an indirect job-related invention.
