Title:Ugotavljanje krivde na podlagi športnikovega biološkega potnega lista : diplomsko delo univerzitetnega študija

Abstract:Strmenje k vse boljšim rezultatom je v vrhunski šport vpeljalo znanost. Na žalost se veliko število športnikov, v želji po kar najboljših rezultatih, odloči poseči po nedovoljenih snoveh in metodah, ki pa so, z razvojem znanosti, vse bolj in bolj prefinjene. Pogoj, da se taka praksa odkrije in ustrezno sankcionira, je razvoj organizacij proti dopingu in metod, ki se jih poslužujejo. Novi pristopi v boju proti dopingu so podvrženi skeptičnim mnenjem in kritikam, vendar se je biološki potni list že večkrat izkazal kot zanesljiva metoda v postopkih pred mednarodnim športnim razsodiščem. V diplomskem delu smo obravnavali celoten postopek najnovejše metode dokazovanja krvnega dopinga, biološki potni list. Preučili smo pridobivanje materialnih dokazov, krvnih vzorcev, ter vrsto opravil, ki zagotavljajo avtentičnost in natančnost rezultatov, na podlagi katerih se kasneje uvede disciplinski postopek. Ključni del diplomskega dela je razlaga temelja biološkega potnega lista – vzdolžnega profila. Diplomsko delo sklenemo z opisom disciplinskega postopka in sklepom, v katerem so podane potrditve hipotez.

Abstract:Striving towards better results has introduced science to top sports. Sadly, in their desire to get the best results possible, many athletes decide to use illicit drugs or methods, which are becoming more and more refined as science progresses. If we are to discover and take proper measures against this, it is imperative to further develop anti-doping organizations and their methods. The new approach to the anti-doping battle is subjected to skeptical opinions and criticism, yet the Athlete Biological Passport has proven many times to be reliable method in a procedure before the Court of Arbitration for Sport. In this BA thesis we discussed the entire procedure of the newest method of proving blood doping, the Athlete Biological Passport. We studied the gaining of material evidence, blood samples, and a series of tasks that guarantee the authenticity and accuracy of the results, based on which a disciplinary procedure is established later on. The key part of this thesis is an explanation of the basis of the Athlete Biological Passport – the longitudinal profile. We conclude the thesis with a description of the disciplinary procedure and a conclusion, which confirms the hypotheses.
