Title:Pridobitev lastninske pravice s pravnim poslom in dedovanje po slovenskem in francoskem pravu

Abstract:V diplomskem delu je podan primerjalni vpogled v pravno ureditev pridobitve lastninske pravice v dveh pravnih sistemih. Izbrala sem primerjavo med francosko in slovensko pravno ureditvijo z omenjenega področja. Težišče naloge je usmerjeno predvsem na razumevanje razlik in tudi na iskanje skupnih imenovalcev. Med predstavljanjem teme sem se primarno osredotočila na pridobitev lastninske pravice s pravnim poslom in dedovanjem po slovenskem in francoskem pravu, čeprav je za njeno učinkovito razumevanje potrebna tudi splošna opredelitev lastninske pravice v obeh pravnih ureditvah. Tako je v začetnih poglavjih vsake ureditve najprej opisan pojem lastninske pravice in nato šele njena pridobitev s pravnim poslom in dedovanjem. Skozi raziskavo bo razvidno, da ne gre samo za primerjavo in manjše razlike med dvema ureditvama, ampak se pojavi tudi razmejitev dveh sistemov na konsenzualne in tradicijske sisteme ter abstraktne in kavzalne. Poleg tega pa se pojavi tudi vprašanje načela enotnosti in ločenosti.

Title:Acquisition of property right by legal transaction and French law
Abstract:The diploma thesis; “Acquisition of property right by legal transaction and inheritance in Slovenian and French law” discusses two different legal systems and offers comparative insight of their legal regulation of acquisition of property right. The comparison of mentioned field was done between French and Slovenian legal system. The main focus of the thesis is directed in understanding the differences and finding characteristics that both have in common. In the face of thesis presentation I was primarily focused on the acquisition of property right by legal transaction and inheritance in Slovenian and French law, although for its full and effective understanding a general definition of property rights in both legal systems is needed. In first few chapters of each regulation, the concept of property is described firstly and then followed by its acquisition by legal transaction and inheritance. Through the research it is going to be evident that it is not only the case of comparison and minor differences between the two regimes but it also defines the boundaries of two systems on consensual and tradition systems and abstract and causal on the other hand. In addition, the questions of unity issue and separation appears.
