Title:Uporabnost hipnoze pri preiskovanju kaznivih dejanj : diplomsko delo univerzitetnega študija

Abstract:Hipnoza je že star fenomen, čeprav se širša javnost tega ne zaveda. Uporabljali so jo že pred par tisočletji. Uporabljali so na veliko področjih, še posebej pa v zdravstvu, kjer so jo uporabljali kot anestezijo, zdravljenje bolečin ali pa tudi za odpravljanje fobij in slabih navad. Hipnoza je relativno nezapleten poseg v našo zapleteno duševnost, ki je manj škodljiv in precej učinkovitejši kot drugi psihoterapevtski postopki. Je spremenjeno stanje zavesti, ki vsebuje usmerjeno pozornost, povečano zavednost in koncentracijo, ki jo večina ljudi doseže s primerno motivacijo in odnosom. Forenzično hipnozo pa bi lahko opisali kot tehniko za raziskovanje spominov prič in žrtev hudih kaznivih dejanj, da bi vplivali na spomin dogodkov, pogovorov, situacij in okolja v času kaznivega dejanja. Zaradi verodostojnosti pričanja pa je naletela na težave na kazenskem področju, kjer se še vedno bori za njen obstoj. Dopustnost uporabe informacij pridobljenih s hipnozo, se razlikuje v zakonodaji od države do države. Nekje dopuščajo nekatere oblike, drugje je strogo prepovedana. Zaradi tveganja, kot je možnost izkrivljanja spomina in sugestije, v večini primerov ne dopuščajo dokazovanja na sodiščih. Čeprav ima hipnoza veliko pozitivnih učinkov, kot je pridobivanje spomina, se z njo pojavljajo tudi negativni. Te negativne učinke se lahko posploši na tri glavne veje problemov, zaradi katerih se policija običajno ne odloči za njeni uporabo.. Prvi je, da so povečanja v pravilnih in resnih priklicih spomina lahko včasih povezana s povečanjem nepravilnih informacij (upadanje stopnje natančnosti). Drugič, samozavest, zaupanje je pogosto povečano ne glede na natančnost (udeleženci so lahko samozavestni v natančnost, pravilnost napačnih informacij). In tretjič, očividci včasih kažejo povečanja v sugestibilnosti pri vodljivih vprašanjih in zavajajočih po-dogodkovnih informacijah. Vendar, če so uporabljene smernice in izpolnjeni vsi začšitni ukrepi, je hipnoza nadvse uporabno preiskovalno orodje.

Abstract:Hypnosis is an old phenomenon, even though the general public don't realise it. It has been used a few millenniums ago. It is used in many fields, especially in medicine, where it was used as an anesthesia, pain treatment or to eliminate phobias and bad habits. Hypnosis is a relatively straightforward procedure in our complex psyche, which is much less harmful and more effective than other psychotherapeutic procedures. It is an altered state of consciousness that contains directed attention, consciousness and increased concentration, which can most people reach by appropriate motivation and attitude. Forensic hypnosis could be described as a technique to revive the memories of witnesses and victims of serious crime to affect on the memory of events, conversations, situations and environment at the time of the crime.The credibility of the testimony is experiencing difficulties in the criminal field, where still fighting for its existence. Permissibility to use information obtained through hypnosis is different in law from state to state. Somewhere they allow certain forms, elsewhere is strictly prohibited. Because of the risk, such as the possibility of distortion of memory and suggestion, in most cases, they do not allow evidence in the courts. While hypnosis has many beneficial effects, such as the production of memory, there also appear negative ones.However, if the safety guidelines are used, hypnosis is a very useful investigative tool.
