Title:PRIZNANJE KRIVDE V SLOVENSKEM IN HRVAŠKEM KAZENSKEM POSTOPKU

Abstract:Predmet preučevanja diplomske naloge je ureditev kazenskega postopka, kot ga uvaja novela ZKP-K, sprejeta novembra 2011, ki predstavlja pomemben korak v dosedanjem postopnem reformiranju slovenskega kazenskega postopka. Ta poteka v smeri od tradicionalnega kontinentalnega modela do sodobnejših modelov, ki se različno imenujejo: participativni, konsenzualni, pogajalski in tudi adversarni. Nova ureditev prinaša nekatere nove institute, ki omogočajo, da se kazenski postopek hitreje konča, v ospredju teh institutov pa je obdolženčevo priznanje krivde kot ključni element, od katerega je odvisen izid konkretnega postopka. Največ pozornosti je namenjeno institutu pogajanja o krivdi, znamenitemu plea bargaining-u, ki je znan iz Združenih držav Amerike. S prevzemanjem rešitev, ki izvirajo iz anglo-ameriške pravne tradicije dobiva obdolženčevo priznanje krivde drugačen pomen, kot ga je imelo do sedaj in vzporedno s tem gre tudi za drugačen koncept razumevanja kazenskega postopka v našem pravnem sistemu, ki je nezdružljiv z nekaterimi tradicionalnimi načeli kontinentalnega kazenskega postopka. V tem diplomskem delu je zato podana analiza ureditve novih institutov z vidika tradicionalnih kontinentalnih načel kazenskega postopka in posledično ugotovitve o posameznih odstopanjih. Delo govori tudi o samem fenomenu priznanja krivde in o tem, kakšen pomen ter posledice slednje dobiva po novi zakonski ureditvi. Prav tako je predmet preučevanja ureditev hrvaškega kazenskega postopka, v katerega so bili podobni instituti, kot jih uvaja novela ZKP-K, uvedeni že leta 2008. Pri tem gre za primerjavo ureditev obeh držav, ugotavljanje podobnosti in razlik ter podajanje morebitnih predlogov za spremembo ureditve.

Title:THE GUILTY PLEA IN THE SLOVENIAN AND CROATIAN CRIMINAL PROCEDURE
Abstract:The subject of this thesis is the study of rules of criminal procedure, as established by the amendment to the Slovenian Criminal Procedure Code, adopted in November 2011, which represents an important step in reforming the Slovene criminal procedure. The transformation follows the path from the traditional continental model to more contemporary models, such as the participatory, consensual, negotiating, and adverse model. The new regulation carries some new institutes, which allow the criminal procedure to end quicker. The focus of these institutes is the defendant’s plea of guilt as the key element that prejudices the outcome of a particular case. The outmost attention is paid to the institute of negotiations concerning one's guilt, the famous plea bargaining originating from the United States of America. By assuming solutions originating from the Anglo-American legal tradition the defendant’s plea of guilt receives a different meaning than it had so far and in parallel, follows a different concept of understanding the concept of the criminal proceeding in our legal system, which is incompatible with some of the traditional principles of the continental law process. The present thesis therefore gives an analysis of the organisation of new institutes from the point of view of the continental principles of criminal procedure as well as findings on individual deviations. Moreover it deals with the phenomenon of the plea of guilt and with the meaning and consequences it is receiving in terms of the new legal regulation. The subject of the research is also the organisation of the Croatian criminal procedure, which introduced similar institutions already in 2008. The aim was to compare regulations of both countries, define similarities and differences, and present possible suggestions for the change of the regulation.
