Title:Kršitve temeljnih načel upravnega postopka - novejša judikatura

Abstract:V diplomskem delu predstavljamo temeljna pravna in načela upravnega postopka, ki so kot vrednostna merila oziroma vodila vsebovana v konvencijah, ustavi in zakonih. Vsebinsko usmerjajo opredeljevanje pravnih pravil in njihovo izvrševanje, ki so se uveljavila v pravni praksi. S pregledom novejših (od leta 2009) pravnih praks oziroma judikatov Ustavnega, Upravnega in Vrhovnega sodišča Republike Slovenije na področju njihovih kršitev pa nazorno prikazati kako pomembna je njihova vloga. Temeljna načela upravnega postopka so hkrati pravila za razlago posameznih procesnih institutov splošnih in posebnih upravnih postopkov, jim pomagajo pri pravilni presoji, služijo za njihovo usmerjaje in nakazujejo način vodenja upravnih postopkov ter odločanja v konkretnih zadevah. Obravnavana načela upravnega postopka zato strankam pomenijo minimalne procesno-varstvene standarde in vsem državnim organom obvezna pravila ravnanja v upravnem postopku. Z njihovim poznavanjem je strankam zagotovljena možnost, da od pooblaščene osebe, ki upravni postopek vodi, zahtevajo dosledno spoštovanje le-teh, jim omogočajo sodelovanje v postopku ter uveljavljanje pravic in pravnih koristi. Upravni organi svoje delo opravljajo samostojno, v okviru in na podlagi veljavne zakonodaje. Posamični akti in dejanja državnih organov, organov lokalnih skupnosti in nosilcev javnih pooblastil, morajo zato vedno temeljiti na zakonu ali na zakonitem predpisu. V kolikor pride do kršitev, je vsakomur zagotovljena pravica do pritožbe oziroma drugega pravnega sredstva proti odločbam sodišč in drugih državnih organov, organov lokalnih skupnosti in nosilcev javnih pooblastil, s katerimi so ti odločali o pravicah ali pravnih interesih posameznikov. Upravni organi postopke vodijo in v njih odločajo samostojno, tudi v razmerju do organov drugih vej oblasti. Njihova odgovornost se pokaže v notranjih hierarhičnih razmerjih v okviru nadzorstvene pravice ter v vezanosti upravnih organov na odločitve sodišča. Pravni strokovnjaki ne opozarjajo zaman, da je potrebno sodbe Ustavnega sodišča spoštovati in jih izvajati. Njihovo nespoštovanje bi pomenilo kršitev temeljnih ustavnih načel pravne države z vgrajenim sistemom ravnovesij. V kolikor bi bilo odločanje prepuščeno zgolj javni upravi, bi vladavina prava zbledela ter bi prevlado prevzele vsakokratne politične struje. Zato je nujno, da nad delovanjem javne uprave bdi neodvisen strokoven organ kot je Ustavno sodišče Republike Slovenije.

Title:Violations of fundamental principles of administrative procedures - newer court decisions
Abstract:The diploma thesis presents the basic principles of administrative law and proceedings, which are as value criteria and guidelines incorporated in Conventions, Constitution and laws. Their contents direct defining legal rules and their enforcement, which are implemented in legal practice. We try, with more recent review (since 2009) of legal practices of the Constitutional, the Administrative, and the Supreme Courts of the Republic of Slovenia, in matter of their violations, to clearly demonstrate importance of their roles. Basic principles of administrative proceedings are as well rules for the interpretation of procedural institutions in general and specific administrative proceedings, helping them for right assessments, serving them for guidance and indicating a way of managing procedures and decision making in individual cases. For clients means basic principles of administrative procedure, the minimum process-safety standards and mandatory rules of conduct in the proceedings for all state administration bodies. With knowledge of basic principles, clients have a possibility to require strict compliance from authorized person who leads an administrative procedure, allowing them to participate in the process and exercise their rights and legal benefits. The administrative authorities perform their work independently, within and under the applicable legislation. Individual acts and actions of state authorities, local communities and bearers of public authority should therefore always be based on law or legal act. In case violations occur, everyone is guaranteed the right to appeal or to have other legal remedy against the decisions of courts and other state bodies, local authorities and statutory authorities, on the rights or legal interests of individuals. The administrative authorities lead proceedings and decide independently, also in relation to other branches of government authorities. Their responsibility shows in the internal hierarchy within the supervisory rights and commitment of administrative bodies to the court decisions. Legal experts do not warn for nothing that is necessary to respect and implement judgments of the Constitutional Court. Disrespecting them would constitute a violation of fundamental constitutional principles of law and the built-in balance system. If only the public administration were left up to decide, the rule of law would fade away and the supremacy assumes respective political currents. Therefore it is essential for the functioning of public administration, to be supervised by an independent professional body such as the Constitutional Court of the Republic of Slovenia is.
