Title:VRNITEV DELAVCA NA DELO V IZVRŠILNEM POSTOPKU

Abstract:Predmetno diplomsko delo se nanaša na izvršilni postopek in v zvezi z njim podrobneje obravnava problematiko uveljavitve upnikove nedenarne terjatve – pravice delavca do vrnitve na delo. Predstavljena so načela in predpostavke izvršilnega postopka, verodostojna listina in izvršilni naslov, na podlagi katerih lahko vlagamo izvršilne predloge, oblike izvršilnih predlogov, izvršbe na uveljavitev upnikove nedenarne terjatve, podrobneje pa je obdelan institut vrnitve delavca na delo, ki je zaradi posebnega pomena te vrste spornih odnosov v Zakonu o izvršbi in zavarovanju urejen posebej in sicer v tretjem razdelku z naslovom Izvršba za uveljavitev nedenarne terjatve, v 18. poglavju, členi od 230 do 233. V praksi se, kljub zakonsko dokaj podrobni ureditvi, pojavljajo vprašanja, vezana na izvršitev teh sodnih odločb. Problem vrnitve delavca na delo zajema tudi druge pravice, ki so bile delavcu kratene v obdobju nezakonite odstranitve z delovnega mesta, kot npr. nadomestilo plače, vplačila vseh pokojninskih in zdravstvenih prispevkov itd. V določenih primerih je sama vrnitev delavca na delo vezana tudi na druge, zakonsko določene pogoje, ki morajo biti izpolnjeni, da je reintegracija oz. vrnitev sploh mogoča (npr. veljavno delovno dovoljenje pri tujcih). Cilj predmetne diplomske naloge je opredeliti pravna pravila instituta vrnitve delavca na delo v skladu s pozitivno izvršilno zakonodajo, upoštevaje določila Zakona o izvršbi in zavarovanju, Zakona o pravdnem postopku, Zakona o delovnih razmerjih, Zakona o delovnih in socialnih sodiščih ter upoštevaje dejansko realno stanje s sočasno preučitvijo sodne prakse, ki obstaja v zvezi s tem vprašanjem.

Title:ENFORCEMENT OF EMPLOYERS REENGAGEMENT
Abstract:This dissertation addresses the enforcement procedure and specifies the problems of employees right to reengagement. It presents the principals and assumptions of enforcement procedure, legal documents, upon which the motion can be filed, forms of motions, enforcement of non-money judgements and orders, and a specification of rules, which are regulating the employees right for reintegration and are placed in the enforcement law in section three, chapter 18, articles from 230 to 233. Nevertheless and despite the regulation, in praxis various problems and questions occur about the implementations of judgements. The institute of reintegration (to employees previous post) or to a different adequate post, includes several other rights, that are denied to an employee during his unlawful absence from the post, like wage compensation, payment of all the taxes and other benefits etc. In some cases other conditions and rules have to be fulfilled in order to make the reintegration even possible (like working permission for foreigners). The goals of this dissertation is to address the enforcement rules about employees reintegration in accordance with Slovenian legislation (ZIZ, ZPP, ZDR in ZDSS) and in accordance with studies of actual situation, combined with the study of court decisions, related to the problem.
