Title:Uvedba e-ZK in nova procesnopravna ureditev zemljiškoknjižnega postopka

Abstract:Zakon o spremembah in dopolnitvah zakona o zemljiški knjigi (ZZK-1C) je korenito spremenil dosedanjo prakso zemljiške knjige in v zemljiški postopek uvedel popolno informatizacijo s pomočjo računalniške tehnologije. S prvim majem 2011 je začel delovati sistem e-ZK, ki vse poslovanje zemljiške knjige prenaša iz papirnatega medija v digitalizirano obliko. Sistem e-ZK je za potrebe svojega delovanja zahteval tudi spremembo zemljiškoknjižnega postopka. Tako je novela ZZK-1C uvedla nova pravila zemljiškoknjižnega postopka in spremembo nekaterih materialnih pravil zemljiškoknjižnega prava kot sta ukinitev zemljiškoknjižnega vložka in uvedba novih materialnopravnih pojmov. Najpomembnejše novo procesnopravno pravilo je zagotovo obvezno elektronsko vlaganje zemljiškoknjižnega predloga, ki ga je možno vložiti na poseben portal preko medmrežja. Vložitev elektronskega zemljiškoknjižnega predloga je omogočen različnim uporabnikom, med drugim tudi fizični in pravni osebi, če izpolnjujeta pogoje. Tudi listina, ki je podlaga za vpis, se sedaj pretvori v elektronsko obliko in se pripne k zemljiškoknjižnem predlogu. Zaradi potrebe elektronizacije je ukinjena krajevna pristojnost kar pomeni, da se lahko zemljiškoknjižni predlog vloži kjerkoli v Slovenji, ne glede na lego nepremičnine in zagotavlja enotno ter ažurno zemljiško knjigo. Dostop do informatizirane glavne knjige in vpogled v podatke je možen preko interneta brezplačno z možnostjo računalniškega izpisa podatkov.

Title:Introduction of e-ZK system and new land register procedure rules
Abstract:The amendment to the Land Register Act (ZZK1-C) has changed law practice of land register and introduced complete computerization of land register procedure. The system of electronic land register, called system e-ZK, has been set off on May first 2011. The system e-ZK required changes of land register procedure rules. The ZZK-1C establishes new rules of land register proceeding and some new rules of substantive land register law, such as the abolition of some land register requirements regarding entry and introduction of new substantive law concepts. Most important procedure rule is obligatory electronic submission of land register motion, which can be submitted on the internet. Electronic entry of the motion can be performed by personal authorized persons and other users as well, if necessary conditions fulfilled. It is obligatory that the documents and other applications to the motion are transformed into electronic form. Computerization of land register has abolished district delegation, which means the electronic entry of the motion can be submitted anywhere in Slovenija no matter the location of real estate. Free access to the computerized land register and access to the data inside is possible on the internet with a computer technology.
