Opis:V diplomskem delu so na splošno predstavljeni mednarodni standardi varstva človekovih pravic pred zlorabo policijskih pooblastil ter mehanizmi varstva človekovih pravic pred zlorabo policijskih pooblastil po slovenskem pravnem redu. Predstavljena je nadzorna ter notranje-varnostna dejavnost v policiji in način obravnave kaznivih dejanj, za katera se storilec preganja po uradni dolžnosti, ki so jih osumljene uradne osebe zaposlene v policiji, pred in po sprejetju novele Zakona o državnem tožilstvu ZDT-D in novele Zakona o kazenskem postopku ZKP-H ter novega Zakona o državnem tožilstvu ZDT-1. Predstavljeni sta tudi sodbi s katerima je bila Slovenija pred Evropskim sodiščem za človekove pravice obsojena, zaradi kršitve določil Konvencije o varstvu človekovih pravic in temeljnih svoboščin, ker ni zagotovila neodvisnih preiskav kršitev človekovih pravic in temeljnih svoboščin in sodba Ustavnega sodišča RS, s katero je le-to izpostavilo dolžnost vseh državnih organov izvesti neodvisno preiskavo dogodkov, v katerih naj bi prišlo do kršitev človekovih pravic in temeljnih svoboščin. Navedene sodbe so privedle do sprejetja novele ZKP-H in novele ZDT-D, na podlagi katerih je bil pri VDT RS, Skupini državnih tožilcev za pregon organiziranega kriminala, ustanovljen Specializirani oddelek, ki je postal izključno stvarno pristojen za obravnavo kaznivih dejanj uradnih oseb zaposlenih v policiji. S sprejetimi spremembami v navedenih novelah je Republika Slovenija zadostila merilom, ki jih je v svoji sodni praksi razvilo Evropsko sodišče za človekove pravice pri zagotavljanju pravice do neodvisne učinkovite preiskave v primeru morebitne kršitve 2. oziroma 3. člena Evropske konvencije o človekovih pravicah (EKČP). V pristojnost Specializiranega oddelka je prešlo preiskovanje kaznivih dejanj, ki naj bi jih storile uradne osebe, zaposlene v policiji oziroma druge uradne osebe, zaposlene na področju notranjih zadev, v z zakonom določenem pristojnem organu v ministrstvu, pristojnem za obrambo, ki ima policijska pooblastila v predkazenskem postopku, ali uradne osebe, napotene na misijo v tujini. S sprejemom novega Zakona o državnem tožilstvu (ZDT-1) je bil Specializirani oddelek preimenovan v Oddelek za preiskovanje in pregon uradnih oseb s posebnimi pooblastili (Posebni oddelek), ki je kljub drugačnim izhodiščem zakonodajalca ostal še vedno izključno stvarno in krajevno pristojen za preiskovanje kaznivih dejanj, ki jih storijo določene uradne osebe s policijskimi pooblastili. Ob tem je ZDT-1 razširil personalno pristojnost Posebnega oddelka, saj je le-ta postal izključno stvarno in krajevno pristojen za obravnavno kaznivih dejanj, ki jih storijo uradne osebe Policije, uradne osebe notranjih zadev, ki imajo policijska pooblastila v okviru izvajanja nadzora po zakonu, ki ureja Policijo, uradne osebe vojaške policije, ki imajo pooblastila policije v predkazenskem postopku, uradne osebe s pooblastili policije v predkazenskem postopku, ki so napotene na misijo v tujini, uradne osebe Obveščevalno-varnostne službe ministrstva, pristojnega za obrambo in uradne osebe Slovenske obveščevalno-varnostne agencije. V diplomski nalogi so nakazane tudi rešitve in izboljšave trenutnega načina obravnave kaznivih dejanj, za katera se storilec preganja po uradni dolžnosti in storitve katerih so osumljene uradne osebe zaposlene v policiji.

Naslov:PROSECUTION OF THE CRIMINAL OFFENCES COMMITTED BY POLICE OFFICERS
Opis:My thesis generally presents the international standards of human rights protection against police authority abuse and the mechanisms of human rights protection against police authority abuse in accordance with the Slovene law. It also shows the supervising and inner-security actions within the police and the way of dealing with criminal offence, which requires the offender to be prosecuted by law, and which was committed by officials employed within the police, before and after passing the Amending State Prosecutor Act (SPA-D), the Amending Criminal Procedure Act (CPA-H) and the new State Prosecutor Act (SPA-1). What is also presented are the two judgments, firstly, the one of the European Court of Human Rights which convicted Slovenia of violating the Convention of Human Rights Protection and Fundamental Freedoms, as it did not ensure independent investigations of violating human rights and fundamental freedoms. Secondly, the judgment of the Slovene Constitutional Court, which emphasised the duty of all public departments to carry out independent investigations of events where human rights and freedoms were considered to be violated. The above mentioned judgments led to pass the Amending State Prosecutor Act (SPA-D) and the Amending Criminal Procedure Act (CPA-H) on the basis of which a Specialised Department was established by the group of public prosecutors to prosecute organised crime. This department became exclusively designated to deal with criminal offence committed by officials employed within the police. With the changes of the mentioned amending acts The Republic of Slovenia met the standards developed by the European Court of Human Rights to ensure the right to an independent and efficient investigation in case of violation of the 2nd or the 3rd Act of the European Convention of Human Rights (ECHR). Within the authorisation of the Specialised Department there were investigations of criminal offence, supposedly committed by officials employed within the police or in the field of internal affairs as well as in the designated body within the Ministry of Defense, which has police authorisations in pre-trial criminal procedure, or by officials sent on a mission abroad. By passing the new State Prosecutor Act (SPA-1), the Specialised Department was renamed into the Department of Investigating and Prosecuting Officials with Special Authorisations (Special Department). Despite the different grounds of the regulator, it remained designated to investigate criminal offence committed by officials with police authorisations. By doing so SPA-1 expanded the personal designation of the Special Department as it became exclusively and locally designated to deal with criminal offence when committed by officials of the police, by officials of the internal affairs with police authorisations in legal supervision which regulates the police, by military police officials with police authorisations in pre-criminal procedure sent on a mission abroad, by officials of the ministry's designated for defense and by officials of the Slovene intelligence service agency. The thesis proposes solutions and improvements of the current way of dealing with criminal offence committed by officials employed within the police and which requires the offender to be prosecuted by law.
