Abstract:V diplomskem delu je podan primerjalni vpogled v nekatere evropske sisteme pridobitve lastninske pravice na premičnini od razpolagalno nesposobne osebe (a non domino). Tri od skupno petih obravnavanih sistemov pripadajo romanski pravni družini , zato bo težišče naloge usmerjeno v iskanje razlik, pa tudi skupnih imenovalcev ureditev germanskega in romanskega porekla. Med predstavljanjem teme, ki jo mnogi označujejo za »križišče obligacijskega in stvarnega prava« , se bom primarno osredotočila na obravnavo instituta a non domino, vendar je za njegovo učinkovito preučevanje potrebna tudi splošna predstavitev sistemov prenosa lastninske pravice v različnih pravnih redih. Zato bo v začetnih poglavjih vsake obravnavane ureditve kot tematsko izhodišče najprej opisana splošna pridobitev lastninske pravice, zatem pa še podrobnejša predstavitev pridobitve lastninske pravice na premičnini, kadar je odsvojitelj razpolagalno nesposobna oseba (t.i. »non domino«). Razvidno bo, da so si romanski in germanski sistemi glede prenosa lastninske pravice konceptualno precej različni, hkrati pa zaradi korekcij in izjem v vsakdanji praksi ne dajejo dramatično drugačnih oziroma nasprotujočih si rezultatov.

Title:ACQUISITION OF PROPERTY OF MOVABLES THROUGH A PERSON WITHOUT AUTHORITY TO TRANSFER OWNERSHIP - COMPARISON OF SLOVENIAN LEGAL REGULATION AND REGULATIONS OF SOME ROMANIC LEGAL SYSTEMS
Abstract:The thesis gives a comparative view on some European systems of acquisition of title concerning movable property when acquired from a party who is not entitled to it (a non domino). Three out of five described systems belong to Romanic legal family , therefore the thesis will primarily deal with the seeking of characteristics that distinguish Romanic and Germanic systems, as well as the characteristics that both have in common. The presentation of the theme, that is often referred to as »the crossroad of contract and property« , will mainly focus on the a non domino institution. However, to enable a sufficiently effective presentation of this institution it is necessary to take a general look into each national regulation of transfer of movable property. Therefore, each chapter will start out with general descriptions of a regular acquisition of property and proceed with the presentation of the acquisition of property when the alienator is not entitled to transfer the property (a so called »non domino«). The research will show that Romanic and Germanic systems of tranfer of property vary in their conceptual structure, even though they do not produce essentially different nor dramatically oposing results.
