Title:KAZENSKOPRAVNO VARSTVO V DELOVNIH RAZMERJIH

Abstract:V Republiki Sloveniji je delovnopravno varstvo pravic iz delovnega razmerja zagotovljeno po delovnem, civilnem in kazenskem pravu. Problem, ki ga izpostavlja magistrsko delo v prvem poglavju, se nanaša na vprašanje, ali je kazenskopravno varstvo v delovnih razmerjih primerno in učinkovito, upoštevajoč, da je značilnost kazenskega prava represija, delovnega prava pa odnos zaupnosti, podrejenosti in lojalnosti. Magistrsko delo v drugem poglavju obravnava kazenskopravno varstvo pravic iz delovnega razmerja po kazenskem zakoniku, in sicer normativno ureditev štirih kaznivih dejanj zoper delovno razmerje, s prikazom obstoječe sodne prakse in primerjalnopravno ureditev. Novost v naši kazenski zakonodaji sta kaznivi dejanji šikaniranja na delovnem mestu in zaposlovanja na črno, ki sta tudi opisani. V zadnjih letih je nasilje na delovnem mestu postalo ena od največjih nevarnosti v delovnem okolju, s katero se srečuje vse več zaposlenih, kar je opisano v tretjem poglavju. V četrtem poglavju je predstavljen mobbing kot posebna oblika psihičnega in fizičnega nasilja na delovnem mestu, njegove pojavne oblike, vzroki zanj ter njegove posledice. Nekateri avtorji za izraz mobbing uporabljajo tudi izraz šikaniranje, v delovnopravni zakonodaji pa so ta izraz prevedli kot trpinčenje na delovnem mestu. V tem poglavju je tudi opisano pravno varstvo zaščite delavcev pred mobbingom v Evropski uniji in v Sloveniji. Zaposlovanje na črno je segment tako imenovane sive ekonomije. V Sloveniji je za leto 2004/05 delež sive ekonomije ocenjen na 27,4 % BDP, kar ima negativne posledice za celotno družbo. V petem poglavju so podrobneje predstavljene zakonske norme, ki opredeljujejo zaposlovanje na črno, službe za odkrivanje, preprečevanje in sankcioniranje zaposlovanja na črno.

Title:PENAL PROTECTION IN EMPLOYMENT RELATIONSHIP
Abstract:Labour law-related protection of rights from labour relationship is in the Republic of Slovenia secured by labour, civil and criminal law. The issue exposed in the first chapter of Master's thesis refers to the question if labour relations enjoy adequate and sufficient penal protection, considering the fact that repression is a typical characteristic of criminal law, while the relation between confidence, subordination and loyalty is typical of labour law. The second chapter of Master's thesis deals with penal protection of rights deriving from labour relationship according to Criminal Code, namely the regulatory framework for four criminal offences against labour relationship, concentrating on the existing court practice and a comparative legal regulation. What is new in our criminal legislation are workplace bullying and illegal employment as criminal offences, and they are both described here. In recent years, workplace violence has become one of the largest hazards in our working environment and the number of employees facing it has been continuously growing, as described in the third chapter of thesis. The fourth chapter presents mobbing as a special form of psychological and physical abuse on a workplace, its manifestations, reasons for mobbing and its consequences. Some authors also apply the term harassment for the term mobbing. In labour law-related legislation, however, this term is translated as workplace harassment. This chapter also describes legal protection of workers against mobbing in the European Union and Slovenia. Black labour is a segment of the so called shadow economy. Estimations for the share of shadow economy in Slovenia for the year 2004/2005 lie at 27.4 % BDP which has a negative impact on the entire society. The fifth chapter focuses on legal standards defining black labour, detection department, prevention and sanctioning of black labour.
