Title:SVETOST ALI KAKOVOST ŽIVLJENJA

Abstract:V diplomskem delu sem tematiko svetosti ali kakovosti življenja razdelila v štiri poglavja. V prvem poglavju sem predstavila nekaj splošnih dejstev o pridobitvi in izgubi pravne sposobnosti, saj je le ta pomemben element predvsem iz vidika prava, ki se tako kot medicina ukvarja s pojmovanjem smrti, ki je moj osrednji vidik tematike. V drugem poglavju sem se podrobneje posvetila možganski smrti. Tukaj naj omenim pravilnik o medicinskih merilih, načinu in postopku ugotavljanja možganske smrti ter sestavi komisije za ugotavljanje možganske smrti, na temeljih katerega je opredeljena možganska smrt. Poudarila sem tudi teološko vrednotenje svetosti življenja, za katerega se zavzema katoliška cerkev. V tretjem poglavju sem na konkretnem primeru izvzetem iz nemške prakse želela prikazati, s kakšnimi težavami se srečuje medicina in vzporedno z njo pravo, ko gre za možgansko smrt noseče ženske. V različnih zakonodajah se takšnih primerov poslužujejo na različne načine, odvisno od tega, koliko pravic zakonodaja posamezne države daje še nerojenemu otroku. V zadnjem, četrtem poglavju pa sem se ukvarjala s problematiko umetne prekinitve nosečnosti, ki ima v razvitem delu sveta vedno večjo podporo tako s strani medicine, kot tudi prava. Države podeljujejo vedno večjo svobodo pri uresničevanju pravice do svobodnega odločanja o rojstvu otrok. Tako tudi zakonodaja v Republiki Sloveniji daje noseči ženski večjo vrednost, kot pravicam še nerojenega otroka. Otrok je varovan po naši zakonodaji zgolj pogojno s stani matere in njene volje, ter posredno preko nezakonite prekinitve nosečnosti. Tudi tukaj sem vključila stališče cerkve in na koncu dodala še svoje mnenje glede svetosti in kakovosti življenja v primeru umetne prekinitve nosečnosti.

Title:HOLINESS OR QUALITY OF LIFE
Abstract:In my diploma work I divided the topic of holiness or quality of life into four sections. I presented some general facts about the acquisition and loss of legal capacity in the first chapter since this is an important element particularly in the terms of law. Like medicine it also deals with the concept of death, which is the central aspect of my topic. I devoted myself more in detail to the brain death in the second chapter. At this point let me mention the rules on medical criteria, method and procedure for determining the brain death and establish the commission to determine it on the basis of the defined brain death. I also emphasized the theological evaluation of the sanctity of life which is committed to the Catholic Church. In the third chapter I wanted to show the difficulties facing medicine and parallel to the law when it refers to the brain death of a pregnant woman on the case struck from the German law. In various jurisdictions such cases are making use of a variety of ways, depending on the rights given to the unborn child. In the final, fourth section, I dealt with the problem of abortion. The support from medicine and law is rising in the developed world. States are awarding larger freedom over implementation of right towards free deciding at a birth of children. The Republic of Slovenia as well gives greater value to the pregnant woman in comparison to the rights of the unborn child. The child is protected by our laws only conditionally by the mother and her will and indirectly through illegal abortion. At this point I included the position of the church and added my own opinion on sanctity and quality of life in the case of abortion.
