Title:OBMOČJE SVOBODE , VARNOSTI IN PRAVICE PO LIZBONSKI POGODBI

Abstract:Diplomska naloga obravnava območje svobode, varnosti in pravice po Lizbonski pogodbi. Območje svobode, varnosti in pravice (v nadaljevanju območje) je območje znotraj meja Evropske unije (v nadaljevanju EU), ki je opredeljeno kot območje brez notranjih meja, na katerem je v povezavi z ustreznimi ukrepi glede nadzora na zunanjih mejah, azila, priseljevanja ter glede preprečevanja kriminala in boja proti njemu zagotovljeno prosto gibanje oseb. Območje vsebuje štiri politike in sicer: politiko mejne kontrole, priseljevanja in azila, politiko pravosodnega sodelovanja v civilnih zadevah, politiko pravosodnega sodelovanja v kazenskih zadevah in politiko policijskega sodelovanja. Zamisel o takšnem območju se je pojavila v devetdesetih letih prejšnjega stoletja in od takrat pridobiva na pomembnosti. Tudi z Lizbonsko pogodbo, ki je stopila v veljavo 1. decembra 2009, je bilo tako, saj Lizbonska pogodba glede območja prinaša številne spremembe, ki bodo še okrepile vlogo območja. Lizbonska pogodba uvaja enotne pravne akte za vsa področja delovanja EU, tudi za območje. Vsa zakonodaja glede območja bo lahko tudi predmet presoje sodišča EU. Izboljšana je tudi demokratična kontrola območja z okrepljeno vlogo nacionalnih parlamentov. Lizbonska pogodba predvideva tudi možnost ustanovitve Evropskega javnega tožilstva s preoblikovanjem Eurojusta. Avtorica zaključuje, da je Lizbonska pogodba večino določb glede pravosodnega sodelovanja v kazenskih zadevah in policijskega sodelovanja podvrgla načelu kvalificirane večine in soodločanja, kar omogoča hitrejše sprejemanje zakonodaje EU na tem področju. Kljub temu pa ni mogoče v celoti predvideti učinkov, ki jih bodo te spremembe prinesle in zelo verjetno je, da bo potrebnih še veliko sprememb, da bo območje vzpostavljeno v celoti.

Title:AN AREA OF FREEDOM, SECURITY AND JUSTICE BY TREATY OF LISBON
Abstract:A theme of this diploma paper in an area of freedom, security and justice by Treaty of Lisbon. An area of freedom, security and justice (abbreviated an area) is an area without internal frontiers, in which the free movement of persons is ensured in conjuction with appropriate measures with respect to external border controls, asylum, immigration and the prevention and combating of crime. An area entails four policies: border controls, immigration and asylum, judicial cooperation in civil matters, judicial cooperation in criminal matters and police cooperation. An idea of such an area appeared approximately twenty years ago and since then it is becoming more and more important. This have not changed with the Treaty of Lisbon, which came into force on 1. december 2009. The Treaty of Lisbon imposes the unified types of legal instrument for all European Union policies, including for the area. A democrating control over the area is also improved with an increased role of national parliaments. The Treaty of Lisbon also provides a possibility of establishment European Public Prosecutor`s Office. The author concludes, that the Treaty of Lisbon has switched most provisions regarding judicial cooperation in criminal matters and police cooperation to qualified majority voting and codecision, which enables faster acceptance of EU legislation. However, we can not foresee all of the consequences, which the Treaty of Lisbon will bring and it is highly likely, that there will be needed a lot of changes to establish the whole area.
