Title:PRIZNANJE IN IZVRŠITEV PREŽIVNINSKIH ODLOČB V EVROPSKI UNIJI NA PODLAGI BRUSELJSKE UREDBE I

Abstract:Preživnina je eden pomembnejših institutov družinskega prava, ki omogoča zagotovitev sredstev za preživljanje mladoletnih otrok, otrok, ki se šolajo ali otrok, ki niso sposobni skrbeti sami zase. Poznamo tudi dolžnost preživljanja staršev, kadar se ti ne morejo preživljati sami. Dolžnost preživljanja obstaja samo med člani družine in temelji na solidarnosti. Države imajo v svojem nacionalnem pravu razdelana pravila, ki zadevajo preživljanje, način uveljavljanja preživnine in sankcije, ki doletijo neplačnika. S širjenjem Evropske unije in uvedbo evropskega državljanstva, ki je omogočil prosto prehajanje med državami Unije, se je povečalo število zakonskih zvez z mednarodnim elementom in posledično tudi število razvez. Problem se je pojavil pri uveljavljanju preživninskih odločb, ki jih je izdalo sodišče ene države članice v drugi državi članici, saj se pravila od države do države razlikujejo. Na tem področju je pomembno vlogo odigrala Bruseljska uredba I, ki je omogočila hitro priznavanje in uveljavljanje preživninskih odločb v drugih državah članicah. Bruseljska uredba je bistveno olajšala uveljavljanje preživninskih zahtevkov in skrajšala sodne postopke. Diplomska naloga obravnava način določitve pristojnosti ter postopek priznanja in izvrševanja preživninskih odločb kot ga ureja Bruseljska uredba I. Pojasnjuje postopek eksekvature ter položaj preživninskega dolžnika in preživninskega upravičenca v mednarodnih postopkih za priznanju in izvršitvi preživninskih zahtevkov. Zaradi vse večjega števila preživninskih zahtevkov, dolgotrajnih postopkov, ki so bili rezultat eksekvaturnih postopkov, restriktivnih pravil o pristojnosti in ostalih ovir za uveljavitev in izvrševanje preživninskih odločb, je nastala potreba po prenovi režima, ki ga je na področju preživnin vzpostavila Bruseljska uredba I. Sprejeta je bila Preživninska uredba, ki je uvedla nekaj potrebnih sprememb. Diplomska naloga na kratko obravnava tudi najpomembnejše vidike Preživninske uredbe, novosti, ki jih je uvedla in primerjavo z Bruseljsko uredbo I.

Title:RECOGNITION AND ENFORCEMENT OF MAINTENANCE DECISIONS ON THE BASIS BRUSSELS REGULATION I
Abstract:Maintenance is one of the major institutes of family law that allows the provision of funds for maintenance of minor children, children attending school or children who are unable to care for themselves. In Slovenian law the children are obliged to care for their parents if they can not support themselves. Maintenance obligation exists only among the family and it is based on solidarity between family members. Countries have elaborated their national law and rules concerning maintenance issues and efficient sanctions that affect non-payers. With the expansion of the European Union and the introduction of European citizenship, which allowed free passage between the countries of the Union, the number of marriages with an international element and hence the number of divorces, has increased. The problem occurred with the enforcement of maintenance decisions, given by the court of one Member State to another Member State, since the rules of the court vary from country to country. Brussels I Regulation played important role in this area as it allowed rapid recognition and enforcement of maintenance decisions in all Member States. The Brussels Regulation is essential to facilitate the enforcement of maintenance claims and shortens litigation. This diploma thesis explains the method of determining jurisdiction, procedure of recognition and enforcement of maintenance decisions as governed by the Brussels I Regulation. It explains the exequatur procedure and position of maintenance debtor and creditor in international processes of maintenance claims. Due to the increasing number of maintenance claims and lengthy procedures which were the result of exequatur procedures, restrictive rules about jurisdiction and other barriers, a need of reformed regime arisen. That was established in the form of Maintenance Regulation that introduced some necessary changes. This diploma thesis briefly examines the most important aspects of the new Maintenance Regulation, the innovations it has introduced and a comparison made with the Brussels I Regulation.
