Abstract:V diplomski nalogi predstavljamo področje spletnih iger na srečo z vidika uporabnosti, saj je le-ta namenjena širšemu krogu bralcev. V njej je vse, kar potencialnega igralca lahko zanima, torej od samih iger, ki se ponujajo na spletu, plačilnih metod in tveganj, do pomembnih mejnikov v zakonodaji, ki vplivajo na njegovo igranje in institucij, na katere mora biti pozoren. Specifično področje spletnih iger na srečo predstavlja dandanes globalen izziv tako na političnem, ekonomskem in pravnem področju. Države se bojujejo z nelegalnimi igralnicami, ki so krivec za proračunski primanjkljaj, uporabniki spletnih iger iščejo zabavo, lahek in neobdavčen zaslužek, ponudniki pa iščejo primerno okolje za nemoteno izvajanje dejavnosti spletnega igralništva in posledično velike dobičke. V diskreciji posamezne države članice EU je, kako bo uredila področje spletnega igralništva. Pri tem mora upoštevati omejevalne ukrepe v skladu s PDEU ter spremljati sodno prakso Sodišča EU in skladno z njo oblikovati nacionalno zakonodajo. Mnoge države se odločajo tu za izrazito restriktiven pristop, za kar pa se bo tudi v diplomskem delu izkazalo, da morda ni niti praktično niti smotrno. Razmah interneta je domala spletnim igram na srečo porušil vse navidezne meje med državami. In jasno je, da se bo spletno igralništvo razvijalo, potrebna pa bo regulacija na globalnem nivoju. Kako pa se bo v praski izvedla, pa bo pokazal čas. Potreben pa bo verjetno konsenz tako med državami, kot med ponudniki in uporabniki.

Title:LEGAL ASPETCS OF ONLINE GAMBLING IN EU AND IN SLOVENIA
Abstract:In this thesis is presented the field of online gambling in terms of usability, since the latter is aimed at a wide range of readers. It includes everything a potencial player might find interesting; everything from the games offered online, payment methods and risks, to important milestones in the law, that affect the playing and institutions, on which a player must put his attention. Specific area of online gaming is nowadays a global challenge in the political, economic and legal fields. Countries are struggling with the illegal online games that are to blame for budget deficits, users of online gaming are looking for a fun, easy and not taxable income, bidders are seeking a suitable environment for the smooth implementation of the online gaming and thus big profits. It is in a discretion of each individual EU member country how to regulate the field of online gaming. The restrictive measures by PDEU must be taken into account, monitoring of the case law of the EU Court and creating national legislation in accordance to that. At this point many countries opt for a highly restrictive approach, for which it will be shown in this thesis, that perhaps it is neither practical nor prudent. The expansion of the Internet has almost destroyed all the apparent boundaries between countries. And it is clear that online gaming will develop, but regulation on the global level will be required. But only time will tell how that will perform in practice. Consensus between countries, providers and users will likely be required.
