Abstract:Pričujoče delo poskuša prikazati slovensko in mednarodno pravno ureditev področja neprostovoljne hospitalizacije oseb z duševnimi motnjami v zvezi s katero ostajajo nekateri neprijetni spomini iz bližnje preteklosti, ko se je ta izvajala pretežno iz političnih razlogov. Ukrep neprostovoljne hospitalizacije odpira poleg pravnih še nekatera etična vprašanja. Temeljna zahteva, ki jo je potrebno postaviti je, da zdravniki spoštujejo človekove pravice ter z zakonom predpisan postopek, kar v prvi vrsti predstavlja udejanjanje pravic do zakonitega in poštenega sojenja. Svoboda je namreč preveč pomembna pridobitev demokratične družbe, da bi odločitve o njej prepustili le psihiatrom.

Title:Involuntary hospitalization of people with mental disorders from the aspect of the protection of human rights
Abstract:The objective of this thesis is to introduce Slovenian and international legal regulations in the area of involuntary hospitalization of people with mental disorders, which has been related to abuse in the recent past, when it was administered mostly with a political background. The act of involuntary hospitalization along with legal, also raises some ethical questions. Basic requirement that must be met is, for psychiatrists to respect human rights and legal procedures, which firstly reflects the implementation of a right to a fair trail. Freedom is namely to important of an acquisition of a democratic society for the decisions on it to be left soley in the hands of psychiatrists.
