Title:SVOBODA OPRAVLJANJA STORITEV NA TRGU EU

Abstract:V diplomski nalogi smo v šestih poglavjih analizirali svoboščino prostega pretoka storitev na trgu EU. V uvodnem delu smo predstavili namen, cilje in osnovne trditve diplomske naloge, opredelili predpostavke in omejitve ter določili metode raziskovanja. V drugem poglavju smo raziskali, kakšen je pomen skupnega trga v EU in predstavili vlogo storitev na trgu EU. Skozi pravne vire smo analizirali pravno podlago za razvoj svoboščine prostega opravljanja storitev ter ugotovili, da obstajajo ovire, ki omejujejo prosto opravljanje storitev ponudnikom storitev ter ovire, ki onemogočajo prosto sprejemanje storitev v EU. V tretjem poglavju smo natančneje analizirali in definirali posamezne vrste ovir, ki se kažejo kot diskriminatorna ravnanja ter posledično izboljšujejo položaj domačim ponudnikom storitev v primerjavi s ponudniki iz drugih držav članic. V četrtem poglavju smo podrobneje preučili nastanek in postopek razvoja najnovejše direktive s področja opravljanja storitev v EU, ki poleg sodne prakse Sodišča ES predstavlja najpomembnejšo pravno podlago na tem področju. V petem poglavju smo opredelili pravila za opravljanje storitev in v šestem poglavju razmejili omejitve in izjeme od pravila o prostem opravljanju storitev v EU. Sklenili smo, da so storitve eno najpomembnejših področij izgradnje skupnega trga EU in da so aktivnosti EU usmerjene k odpravljanju ovir na področju svobode opravljanja storitev.

Title:THE FREE MOVEMENT OF SERVICES IN EU
Abstract:This thesis examines the free movement of services in the European Union. The first chapter is an introduction to the goals, purposes and arguments for the freedom to provide services in the EU. The second chapter provides a general review of the freedom to provide services in the EU. The third chapter presents barriers to the freedom for service providers and recipients and shows different kinds of discrimination. Within the framework of the provisions, restrictions on freedom to provide services within the Union shall be prohibited for citizens of Member States who are established in a Member State other than that of the person for whom the services are intended. The forth chapter analyzes the services directive, which establishes a general legal framework facilitating the exercise of service providers and the free movement of services, while maintaining a high quality of services (Directive 2006/123/EC). In the fifth chapter, there is a review of the rules for providing services, while the sixth chapter examines limitations justified on grounds of public policy, public security or public health. The internal market is an area without internal frontiers in which the free movement of services is ensured. The elimination of obstacles to the development of service activities between Member States is essential in order to strengthen the integration of the peoples of Europe and to promote balanced and sustainable economic and social progress.
