Title:POGODBA O ZAPOSLITVI ZA OPRAVLJANJE JAVNIH DEL

Abstract:V diplomskem delu obravnavam pogodbo o zaposlitvi za opravljanje javnih del, ki jo določata Zakon o delovnih razmerjih in Zakon o zaposlovanju in zavarovanju za primer brezposelnosti. Ob tem je vključena tudi mednarodna ureditev in domača sodna praksa, ki se nanaša na naslovno temo. Zakon o delovnih razmerjih uvršča pogodbo o zaposlitvi za opravljanje javnih del med atipične pogodbe o zaposlitvi. Gre za pogodbo, ki je tesno povezana z ukrepi države v okviru opravljanja dela brezposelnih oseb oziroma aktivne politike zaposlovanja. Zakon o zaposlovanju in zavarovanju za primer brezposelnosti podrobneje opredeljuje javna dela in določa posebnosti glede plačila za delo, trajanja dopusta, polnega delovnega časa in razlogov za prenehanje pogodbe o zaposlitvi za opravljanje javnih del. Za vse druge pravice in obveznosti, ki izhajajo iz delovnega razmerja, napotuje na uporabo Zakona o delovnih razmerjih, kolektivnih pogodb in splošnih aktov delodajalca. Diplomsko delo vsebuje poglavje z naslovom Aktivna politika zaposlovanja, katere temeljni namen je zagotavljanje ekonomske aktivnosti in zaposljivosti čim večjemu krogu posameznikov. Vključuje programe zaposlovanja, usposabljanja in ustvarjanja delovnih mest. Pomemben del predstavljajo javna dela, katerim je namenjeno posebno poglavje, ki podrobno opredeljuje ureditev in posamezne pojme. Ob koncu diplomskega dela je predstavljena ureditev javnih del na Hrvaškem in primerjava s slovensko ureditvijo.

Title:EMPLOYMENT CONTRACT FOR PUBLIC SERVICES
Abstract:This dissertation thesis defines the employment contract for public services according to the Employment Relationship Act and the Employment and Insurance Against Unemployment Act. International regulations and domestic case law, connected with the topic, are also included. According to the Employment Relationship Act, the employment contract for public services is an atypical employment contract. It is a contract which is closely linked with the country's measures to provide work for the unemployed and active employment policy measures. Employment and Insurance Against Unemployment Act fully defines public services and determines the particularities about the payment, the length of one's holiday and working full-time, as well as the reasons for termination of the contract. For all other rights and obligations the Employment and Insurance Against Unemployment Act refers us to the Employment Relationship Act, collective agreements and the employer's general act. This dissertation thesis includes a chapter called Active employment policy measures. The main goal of the policy is to ensure economic activity and to provide employment for as many people as possible. It includes employment programmes, qualification programmes and creation of employment opportunities. A special chapter has been dedicated to social services. This chapter thoroughly presents the regulations and individual concepts. The final part of the BA thesis is the presentation of the regulations concerning public services in Croatia and the comparison with Slovene regulations.
