Title:PRAVNI POLOŽAJ DELAVCA V PRIMERU STEČAJA DELODAJALCA

Abstract:Nastop insolventnosti ter uvedba stečajnega postopka posledično privede do odpovedi pogodb o zaposlitvi delavcem, katerih delo postane nepotrebno. Gre za posebne primere odpovedi iz poslovnega razloga. Takšen način prenehanja delovnega razmerja je dandanes še preveč aktualen pojav, saj se podjetja srečujejo z nelikvidnostjo in gre za specifično situacijo, v kateri je pravočasno in pravilno izplačilo plač delavcem še posebej ogroženo. Prvi del diplomskega dela je namenjen opredelitvi pojma insolventnosti, opisom osnovnih značilnosti stečajnega postopka kot instituta stečajnega prava, ter opredelitvi posebnosti same odpovedi pogodbe o zaposlitvi v stečajnem postopku, kot odpovedi pogodbe o zaposlitvi iz poslovnega razloga. V drugem delu diplomske naloge pa je izpostavljeno varstvo terjatev delavcev v stečajnem postopku, kot ga zagotavljata Zakon o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju ter Zakon o javnem jamstvenem in preživninskem sladu Republike Slovenije. Terjatve delavcev predstavljajo predvsem neizplačane plače, odpravnine, nadomestila za neizrabljeni dopust, ipd. Za takšne položaje, dejanska stanja, ko delavec nastopa kot upnik, je potrebna posebna varstvena pravna ureditev, ki upošteva specifičnost položaja delavca ne le kot upnika, enakovrednega drugim upnikom, temveč je vključen tudi socialni vidik. V težavnem obdobju, v katerem se je znašlo gospodarstvo, je potrebno delavcem zagotoviti določeno stopnjo varstva zaposlitve, predvsem pa jih seznaniti s pravnimi možnostmi. V želji, da zaobjamem problematiko na način, ki ponuja vpogled nad celotnim postopkom, ki se v težavnih situacijah odvije pred očmi delavca, bom opisala še vlogo Jamstvenega in preživninskega sklada Republike Slovenije ter Zavoda Republike Slovenije za zaposlovanje.

Title:THE EMPLOYEES POSITION IN THE INSOLVENCY PROCEEDING OF EMPLOYER
Abstract:Insolvency as well as bankruptcy proceedings lead to issuing notices to workers whose work is no longer needed. The word is about notices based on business grounds and such ways of terminating an employment relationship is very common nowadays why companies face illiquidity. Moreover, it is about specific situation when prompt and correct payments to workers are at risk. The first part of my diploma paper specifies the term insolvency itself, the process of bankruptcy proceedings as a bankruptcy law institute, also special features relating employment notices in bankruptcy proceedings are given in this part and the termination of a contract based on business grounds. The second part highlights protection of workers’ claims in bankruptcy proceedings guaranteed by firstly Financial Operations, Insolvency Proceedings and Compulsory Dissolution Act and secondly by Public Guarantee and Maintenance Fund of the Republic of Slovenia Act. Workers’ claims include missing payments, terminal leave pay, refunds for not taking the leave, etc. In cases when worker is represented as a creditor special protection legal arrangements are demanded, considering the specificity of a worker not only as a creditor equal to other creditors but also his social dimensions have to be considered. The economy is currently facing hard times and workers need to be ensured with some level of employment protection. Moreover, they need to be informed with all legal instruments. It is my wish to precisely introduce a difficult situation workers find themselves in and a process they have to go through. The paper also gives a description of a role that Guarantee and Maintenance Fund of the Republic of Slovenia and Employment Service of Slovenia play.
