Title:PRAVNO VARSTVO ŽIVALI PRED MUČENJEM: PRIMERJALNI PREGLED UREDITVE V DRUGIH DRŽAVAH IN REŠITVE PRIMERNE ZA IZBOLJŠANJE SLOVENSKE ZAKONODAJE

Abstract:V diplomskem delu je obravnavana slovenska pravna ureditev varstva živali pred mučenjem, pri čemer je poudarek na analiziranju rešitev, ki bi to ureditev lahko izboljšale. Najprej je predstavljen sam pravni položaja živali, kot ga opredeljujejo teoretiki ter stanje na področju pozitivnopravnega priznavanja pravic živali (tj. lastnosti omejenega ali pasivnega pravnega subjekta z določenimi upravičenji, ne pa obveznostmi) v Sloveniji in tujini. Avtorica ugotavlja, da je moralne in teoretične podlage sistema živalskih pravic še potrebno utrditi, da bi ga lahko celovito izgradili ter naredili vzdržnega, do takrat pa je potrebno še naprej izpopolnjevati sistem zaščite živali. Sledi predstavitev obstoječega slovenskega sistema pravne zaščite živali pred mučenjem, pri čemer avtorica opozarja na njegove pomanjkljivosti, in sicer zlasti na nejasnosti pri opredeljevanju posameznih prepovedanih oblik mučenja, na potrebo po zakonski prepovedi nekaterih novih oblik povzročanja trpljenja živalim ter po drugi strani na neumestnost določb, ki dopuščajo trpljenje živali za doseganje tako neprimernih in nevrednih ciljev kot sta estetika ali prihranek denarja. Posebej izpostavlja trenutno najbolj aktualno in perečo problematiko izvršljivosti slovenske zakonodaje o varstvu živali pred mučenjem, kjer so spremembe najnujnejše. Avtorica nadalje analizira ureditev varstva živali pred mučenjem v nekaterih drugih državah ter identificira najboljše primerjalnopravne rešitve. Na tej podlagi podaja teze ter predloge za spremembe slovenske zakonodaje na tem področju. V tej zvezi med drugim predlaga uvedbo kazenskopravnega sankcioniranja mučenja živali iz malomarnosti ter odgovornosti skrbnika živali za dovolitev mučenja oz. opustitev ukrepov za preprečitev mučenja vsaj za prekršek mučenja živali. Podrobno se posveti pripravi najustreznejših predlogov rešitev za izboljšanje nadzorstva nad izvajanjem zakonodaje o varstvu živali pred mučenjem in v tem okviru možnostim uvedbe t.i. »živalske policije« (animal police), kot jo poznajo v tujini, tudi pri nas. Pri tem pride do sklepa, da bi bilo najbolje, da bi se takšna organizacija, namenjena izključno opravljanju nadzora nad izvajanjem zakonodaje o zaščiti živali, organizirala v okviru državne uprave. Namesto ustanovitve novega organa v sestavi ministrstva, pristojnega za veterinarstvo predlaga reorganizacijo že obstoječih organov znotraj VURS ter ustanovitev zavetišč v njihovem okviru oziroma vzpostavitev tesnega sodelovanja z obstoječimi zavetišči. Po njeni zamisli bi znotraj takšne organizacije nadzorstvo samostojno ali skupaj z uradnimi veterinarji opravljali uniformirani »uradni nadzorniki za zaščito živali«, kot je poimenovala osebe, ki bi za opravljanje tovrstnega dela morale izpolnjevati milejše pogoje kot uradni veterinarji. Tem bi poleg obstoječih pravic in dolžnosti podelila nekatera nova pooblastila. Na koncu je predmet razprave kaznovalna politika. V tej zvezi avtorica opozarja na potrebo po zvišanju obstoječih sankcij za prekrške mučenja živali, ki so nezadostne in tudi primerjalno med najnižjimi ter zato ne morejo delovati preventivno. Predlaga še uvedbo dveh novih sankcij, tj. sankcijo prepovedi imetništva živali ter sankcijo psihološkega svetovanja za kaznivo dejanje mučenja živali tudi poleg izrečene denarne ali zaporne kazni.

Title:LEGAL PROTECTION OF ANIMALS FROM ACTS OF CRUELTY: COMPARATIVE REVIEW OF REGULATION IN OTHER COUNTRIES AND SOLUTIONS APPROPRIATE FOR IMPROVEMENT OF SLOVENE LEGISLATION
Abstract:Diploma thesis deals with Slovene legal regulation of protecting animals from acts of cruelty. The emphasis is on analyzing the solutions that could improve this regulation. Legal position of animals determined by theorists and the state in the field of positively legal acknowledging of animal rights (i.e. characteristics of limited or passive legal subject with certain justifications and not obligations) in Slovenia and abroad is introduced first. The author detects that it is necessary to strengthen moral and theoretical bases of the system of animal rights and that it could be comprehensively shaped and made bearable but until then the system of animal protection needs to keep being perfected. The presentation of existing Slovene legal system of protecting animals from acts of cruelty follows. The author points out its deficiencies, like for example the vagueness of some prohibited forms of cruelty, the need for legal prohibition of some novel forms of causing suffering to animals and on the other side the inappropriateness of statutory provisions that allow animal suffering for achieving inappropriate and unworthy goals such as aesthetics or saving money. The author stresses currently the most topical issue of executing the Slovene legislation on protecting animals from acts of cruelty, where changes are most imperative. Furthermore she analyses the regulation of protecting animals from acts of cruelty in some other countries and identifies the best comparatively legal solutions. On that basis she introduces theses and suggestions for changing Slovene legislation in this field. In that regard among other things she proposes the introduction of criminal law to sanction negligent animal cruelty and the responsibility of the caretaker for allowing cruelty to happen and for the abandonment of measures for preventing cruelty at least for offence of animal cruelty. She fully investigates the most suitable solutions for improving supervision over execution of legislation on protecting animals from acts of cruelty and in this aspect the possibilities of introducing animal police (as known abroad) in Slovenia. She concludes that it would be best if that kind of organization, intended solely to supervision of execution of legislation on protecting animals, was organised by state administration. Instead of establishing a new body in composition of ministry in charge of veterinary medicine, she suggests reorganization of already existent bodies within VURS and establishment of new shelters or tight collaboration with existing shelters. She believes that supervision inside such organisation should be carried out independently or in collaboration with official veterinaries by uniformed »official supervisors for animal protection«, as she named people, who would in order to do their job have to meet milder conditions as official veterinaries. These official supervisors for animal protection would beside existent rights and duties be given some new authorisations. Towards the end of the diploma thesis the object of the discussion is punitive policy. The author expresses the need to increase existent penalties for offences of animal cruelty. She believes that existent penalties are insufficient and comparatively among the mildest, therefore they cannot function preventively. She also suggests the introduction of two new sanctions, namely the sanction that would prohibit the ownership of animals and sanction of psychological consultancy for criminal offence of animal torture beside monetary or imprisonment punishment.
