Title:PROBLEMATIKA UPORABE PRIKRITIH PREISKOVALNIH UKREPOV NA PODROČJU ODKRIVANJA IN DOKAZOVANJA ORGANIZIRANEGA KRIMINALA

Abstract:Razvoj organizirane kriminalitete sovpada z razvojem sodobne družbe. Organi pregona, katerih naloga je, preprečevanje in zatiranje tudi organiziranega kriminala, se vse pogosteje srečujejo s specifičnimi težavami pri odkrivanju storilcev kaznivih dejanj in pri samem zaznavanju teh dejanj. Medtem, ko so klasične oblike preiskovalnih postopkov v veliki meri uspešno in ustrezno sredstvo za boj proti t.i. klasični kriminaliteti, pa predstavlja organiziran kriminal in nekatere vrste t.i. zločinov brez žrtev hud problem pri odkrivanju in toliko večji pri preiskovanju in zbiranju dokazov za uspešne postopke organov kazenskega pregona pred sodišči. Pri raziskavi kaznivih dejanj organizirane kriminalitete policija uporablja vedno več novih metod in sredstev, ki pomenijo odmik od klasičnih preiskovalnih tehnik. Pri izvajanju novih metod in sredstev se na drugi strani krčijo človekove pravice in temeljne svoboščine. S temi metodami država nenehno posega v človekove pravice in temeljne svoboščine, katere so opredeljene v ustavi. Zaradi stopnje družbene nevarnosti, ki se pojavlja pri izvrševanjih kaznivih dejanj s strani posameznikov in organiziranih skupin, ki se nikakor ne morejo ali nočejo podrejati pozitivnim pravnim normam, je družba zainteresirana, da preganja in kaznuje storilce njej nevarnih dejanj. Ravno zaradi stopnje družbene nevarnosti pri določenih kaznivih dejanjih, je zakonodajalec privolil v omejevanje določenih človekovih pravic in temeljnih svoboščin v primerih, ko je potrebno raziskati kaznivo dejanje in prijeti storilce tovrstnega dejanja. V Republiki Sloveniji so prikrite preiskovalne ukrepe do sedaj urejali različni zakoni. Ti so se spreminjali skozi štiri obdobja od osamosvojitve Republike Slovenije dalje. V teh obdobjih so se prikriti preiskovalni ukrepi spreminjali in prilagajali potrebam družbe. V prihodnosti se bo to občutljivo področje zagotovo še spreminjalo in prilagajalo razvoju družbe in s tem posledično tudi razvoju organiziranega kriminala.

Title:THE PROBLEM OF COVERT INVESTIGATIVE MEASURES IN THE DETECTION AND PROOF OF ORGANIZED CRIME
Abstract:The development of organized crime coincides with the development of modern society. Law enforcement agencies which task is to prevent and to combat organized crime are repeatedly faced with problems with detection of offenders and detection of acts itself. Traditional forms of investigative procedures are highly successful and appropriate to combat classic crime. On the other hand organized crime and a certain types of so called “crimes without a victim” represent serious problem for detection and furthermore for investigation and gathering evidences for success in court procedures. The police use more and more new methods and means that distinguish from traditional investigation techniques to investigate organized crime. With implementation of these new methods and tools on the other hand the police reduces human rights and fundamental freedom. These methods state constantly interferes with human rights and fundamental freedoms, which are determinated in the Constitution. Given the level of social risk which occurs with criminal offenses that are committed by individuals and organized groups who are unable or unwilling to subject themselves to the positive legal norms, the society is interested in prosecution and punishment of perpetrators of this dangerous acts. Similarly, because the degree of social risk for certain offenses is so high, the legislature agreed with the restriction of certain human rights and fundamental freedoms in cases where it is necessary to investigate such crime and apprehend the perpetrators. Covert investigation measures are regulated by different laws in the Republic of Slovenia. They have been changed in four periods since the independence of the Republic of Slovenia. In those periods, investigative measures modified and adapt to changing needs of the society. In the future this sensitive field of work will certainly change and adjust to the development of society and consequently the development of organized crime.
