Abstract:V diplomski nalogi obravnavam razvezo zakonske zveze. Osredotočila sem se na specifično področje, in sicer, ko do razveze pride iz verskih razlogov. Dva posameznika se poročita, si ustvarita družino, nato pa se zgodi, da en zakonec spremeni svoje versko prepričanje. To lahko drugega zakonca zelo vznemiri. Stvari lahko pripelje celo tako daleč, da se razvežeta. Tu nastopi problem, v kateri veri se bo vzgajalo otroke. Zakonec, ki je sprejel novo vero, želi otroke vključiti v bogoslužja, drugi zakonec pa se s tem ne strinja. Morda celo zahteva skrbništvo nad otroki. Načeloma je odločitev o verski vzgoji otrok stvar staršev. Kadar pa se ne moreta sporazumeti o tej zadevi, mora vmes poseči sodišče. Tako so sodniki tisti, ki morajo odločiti o tem, kaj je najboljše za otroke, ali bo otrokom dvojna verska vzgoja škodovala. Praksa je pokazala, da dvojna verska vzgoja otrokom ne škodi. Otrok namreč tako dobi možnost, da se seznani z dvema religijama in se na koncu sam odloči, kateri bo pripadal, če sploh kateri. Sodišče poseže tudi takrat, če ugotovi, da je otrok zaradi novega verskega prepričanja starša ogrožen. V naši Ustavi je določeno, da imajo starši pravico, v skladu s svojim prepričanjem, otrokom zagotavljati versko in moralno vzgojo. Usmerjanje otrok glede verske in moralne vzgoje mora biti v skladu z otrokovo starostjo in zrelostjo ter z njegovo svobodo vesti, verske in druge opredelitve ter prepričanja. To pravico pa najdemo tudi v mednarodnih konvencijah: Evropski konvenciji o človekovih pravicah in temeljnih svoboščinah, Konvenciji Združenih narodov o otrokovih pravicah.

Title:CHILD CUSTODY IN CASE OF DIVORCE FOR RELIGIOUS REASONS
Abstract:The main discussion of my diploma is divorce, specifically when divorce happens for religious reasons. Two people get married. They have children. While they are married, one of them becomes a member of a new religion. Accepting a new religion can be a source of a lot of stress and disagreements in a relationship between husband and wife. It can get so extreme, that they decide to separate. Question that arises now is can children be involved in this new religion of a parent. Ex partner may disagree. Maybe he or she even fills for full custody and demands that children have absolutely no contact with this new found religion of his ex partner. When parents can not come to an agreement, the court has to intervene and make a decision. Is it good for children to be involved in two religions? Many experts say yes, it is. It actually provides an opportunity for them to get acquainted with two religions. When they are old enough, they can decide if they want to be a part of any religion. The court will also intervene in case, if children are in danger due to parents new religious beliefs. Constitution of Slovenia provides parents with a right to raise their children according to their own beliefs. They have to take in consideration children’s age, maturity, freedom of conscience, religion and other beliefs. Parent's right of religious up bringing of children is also found in European Conventions like: European Convention on human rights and fundamental freedoms, Convention on the rights of the child.
