Title:POSTOPEK S KONKURENČNIM DIALOGOM

Abstract:V Sloveniji sta bila na podlagi Direktive 2004/18/ES in Direktive 2004/17/ES sprejeta dva zakona, ki urejata področje javnega naročanja. V Zakonu o javnem naročanju je bil kot novost urejen tudi konkurenčni dialog, kot postopek oddaje javnega naročila, ki je uvedel na področje oddaje javnih naročil bistveno spremembo v primerjavi s prejšnjimi ureditvami, in sicer je pri oddaji javnega naročila z njegovo pomočjo naročniku in potencialnim ponudnikom v fazi priprave razpisne dokumentacije omogočeno, da med seboj sodelujejo, kar je bilo dotlej nedopustno. V drugem, na novo sprejetem zakonu, ki ureja oddajo javnih naročil na področju gopodarske infrastrukture, Zakonu o javnem naročanju na vodnem, energetskem, trasnportnem področju in področju poštnih storitev konkurenčni dialog ni urejen, vendar ga je vseeno mogoče uporabiti vedno, kadar so podane predpostavke za izvedbo postopka s pogajanji po predhodni objavi. Konkurenčni dialog lahko naročnik uporabi v primeru oddaje posebno zahtevnih javnih naročil, ko brez ustreznih informacij ali rešitev, pridobljenih od potencialnih ponudnikov, ne more opredeliti tehničnih, pravnih ali finančnih elementov predmeta javnega naročila ter pod pogojem, da ni mogoče uporabiti odprtega ali postopka s predhodnim ugotavljanjem sposobnosti in da je merilo za izbiro najugodnejšega ponudnika ekonomsko najugodnejša ponudba.

Title:THE COMPETITIVE DIALOGUE PROCEDURE
Abstract:In Slovenia, two Acts were adopted under Directive 2004/18/EC and Directive 2004/17/EC, that govern the area of public procurement. The Act on Public Procurement introduced among other newelties also the Competitive Dialogue, as a contract award procedure, which established in the scope of public procurement a significant change compared to the previous regimes, namely the procedure offers to the contracting authority and the potential tenderers in the phase of the preparation of the descriptive document a position to cooperate, which had been till then unacceptable. In the second, newly adopted Act, which governs public procurement on the utilities sector, the Act on Public Procurement on the water, energy, transport fields and the field of postal services, the competitive dialogue was not arranged, but it still can be used whenever the conditions are given for the use of the Negotiated procedure with competition. The contracting authority may make use of the Competitive dialogue in cases where specially complex contracts are the object of the award, when he is without the relevant informations or solutions derived from the potential tenderers unable to specify the technical, legal and financial elements of the subject of the contract and only if it is not possible to use the Open procedure or the Restricted procedure and also the contract must be awarded on the sole basis of the award criterion for the most economically advantageous tender.
