Title:ODVZEM ŽIVLJENJA LASTNEMU OTROKU Z VIDIKA SLOVENSKEGA IN TUJEGA KAZENSKEGA PRAVA

Abstract:Diplomsko delo prikazuje kompleksno analizo pravne regulative nasilja nad otroki s strani njihovih staršev s poudarkom na posledicah, ki se lahko končajo s smrtjo otroka. V prvem delu diplomske naloge spoznamo pravni položaj otroka skozi zgodovinski prerez do sprejetja Konvencije o otrokovih pravicah leta 1987 ter institucije, ki to področje obravnavajo. Okoliščine teh kaznivih dejanj so si podobne, podrobno pa so predstavljeni starši kot storilci, motivi in povodi ter načini, sredstva, čas in kraj odvzema življenja lastnemu otroku z elementi krivde kot odločilnimi elementi za kazniva dejanja. V posebnem poglavju je predstavljena pravna opredelitev odvzema življenja lastnemu otroku, kjer skozi primerjalno predstavitev členov slovenskega, srbskega in avstrijskega Kazenskega zakonika, dokazujem sličnosti oz. razlike obravnave teh kaznivih dejanj. Primer družine Vodušek je le eden izmed primerov sodne prakse, ki dokazuje, da se za zaprtimi vrati družinskega okolja dogajajo nasilja, katerih žrtve so pogosto otroci, družbeno okolje in državne institucije pa ne reagirajo takrat, ko bi bilo mogoče posledice teh dejanj preprečiti.

Title:ENDING THE LIFE OF YOUR OWN CHILD FROM A SLOVENE AND INTERNATIONAL CRIMINAL LAW PERSPECTIVE
Abstract:This diploma thesis presents a complex analysis of legal regulation of child abuse perpetrated by their parents, emphasizing its consequences, which may end up with the death of the child. The first part of the thesis provides a historic survey of a child's legal status until the adoption of the Convention on the Rights of the Child and presents the institutions dealing with this field. The circumstances of these criminal acts are similar, so parents as perpetrators, the motives and causes, the manner, means, time and place of taking one's own child's life, together, with the elements of guilt as critical elements of criminal acts are presented in detail. In a special chapter the legal definition of taking one’s own child’s life is presented and the similarities and differences in the proceedings of such criminal acts are demonstrated by comparative presentation of relevant articles of the Criminal Codes of Slovenia, Serbia and Austria. The case of the Vodušek family is just one of the examples of case law demonstrating that violence takes place in a family environment behind closed doors, the victims of which are often children, but the social environment and government institutions do not react when the consequences of such acts could be prevented.
