Abstract:Sodobna tehnologija je omogočila enostaven način pridobivanja velikih količin podatkov. Sledenje vozilom s pomočjo GPS, podatki iz spletnih in poštnih strežnikov, video posnetki nadzornih kamer, »slučajno« posneti telefonski pogovori, izpiski telefonskih pogovorov so enostavni načini pridobivanja informacij. Do teh podatkov, ob upoštevanju pravice zasebnosti, ne bi smeli imeti dostopa. In ti podatki dokazujejo, da nekdo krši naše pravice, povzroča nam škodo, krade naše informacije in jih prodaja konkurentom, ne opravlja svojega dela in uporablja sredstva podjetja v lastno korist. Podatki pridobljeni na nedopusten način so vdor v pravico do zasebnosti. Ali jih lahko kljub temu uporabimo kot dokaz v civilnih postopkih?

Title:THE PROBLEM OF EVIDENCE OBTAINED IN AN UNACCEPTABLE MANNER, IN CIVIL PROCCEDINGS
Abstract:Modern technology made it very easy to gain large quantities of information. GPS tracking of vehicles, data logs of web and mail servers, video tapes of surveillance cameras, »accidentally« tapped phone conversations, phone records are at our fingertips. All of that is data, which should not be accessed, when right to privacy is considered. This proves someone is violating our rights, causing us damage, stealing our information, and selling them to competition; that he is not doing his job, and is using company's assets for his own benefit. Nevertheless, data is acquired in an inadmissible manner, with a breach of the right to privacy. Yet, may we still use them as an evidence in civil proceedings?
