Cross-border region Graz-Maribor: challenges and potentials of integration processes

Opis: The paper outlines the spatial development of the cross-border region between the two cities - Graz (Austria) and Maribor (Slovenia) - with regard to the integration processes in the past, present and future. First, the analyses of the past, when both parts of the region shared the national border, will be discussed. It will emphasize the consequences of the ćborder effectć, which are mostly characterised by growing intensification of urbanization alongside the main transport axis, the emergence of new 'urban nods', and the gradual urban sprawl in the hinterland. For decades, the area has been generating various integration processes of economic, social and cultural collaboration, which were in most cases partly financed by the European Union (EU). In 2004, after Slovenia joined the EU, some traditional relationships started to perform in the opposite way, demonstrating the gradually diminishing rate of commuter flows, especially those of shopping tourism. However, the current regional development is characterised by strong efforts for balancing the economic, social and cultural standards on both sides of the cross-border region. The paper aims to identify these new dynamics of intraregional interactions as potentials for future developments.

Typology of cross-border urban areas

Opis: The opening of the internal borders among the member states of the European Union (EU) has not only caused the development of different socio-economic processes, but also of new urban potential in the areas lying across the national borders. Although there has recently been a remarkable upsurge of activities and interests in the regions and areas along the borders regarding the formation of border regions and cross- border processes, they mostly remain quite rigidly within specialised disciplinary fields, i.e. economy, geography, and sociology. There is, however, much less interest in cross-border areas seen in the light of spatial and urban development processes within EU integration. The article provides an overview of specific urban formations through the presentation of selected cases of cross-border regions and, in addition, aims to open some new issues with regard to the context of Slovenian border regions. On the basis of their morphological, economic, and social characteristics, a range of urban typologies, such as cross-border agglomerations, urban exclaves, bi-national border cities etc. will be identified and analysed from different aspects of spatial development.

Growth effects of cross-border mergers and acquisitions in European transition countries

Opis: This paper deals with the economic effect of cross-border mergers and acquisitions on GDP per capita in European transition countries for the 2000- 2014 period. Our analysis shows that cross-border mergers and acquisitions have a negative effect on GDP per capita in the current period, whereas their lagged level positively impacts output performance. We found that transition countries characterized by a higher quality of institutional setting have achieved a positive impact on GDP per capita.

Some observations regarding cross-border debt collection in consumer disputes

Opis: Cross-border debt collection in consumer dispute leads to many difficulties. The main one is the access to justice as consumers are generally not aware of their rights and legal proceedings may be expensive. The major difficulty in order to sue a counterpart based in another Member States is the determination of the competent court. However, this private international law issue is the first step in order to bring a legal action. This action may be disproportionate, on time and value, in comparison with the amount of the debt a consumer wants to recover. As a result, the European Commission has adopted the Directive 2008/52/EC on certain aspects of mediation in civil and commercial matters which aims at facilitating cross-border disputes involving consumers. After recalling the main characteristics of the Directive, author also discusses online mediation, that can also lead to more effective results.

Characteristics of Austrian remedies against enforcement and a general analysis of their suitability for achieving the objectives of Brussels I recast

Opis: Regulation No 1215/2012 (Brussels Ia or Brussels I Recast) was another big step forward towards the establishment of a genuine European judicial area. In the wake of the Brussels I Recast, two facts have rather soon become apparent: One, several well- known (or better: infamous) issues are sadly still unsolved. And two, some other issues have emerged. Because of the abolishment of the “exequatur procedure”, esp. the issue of remedies against enforcement, in both the Member State of origin as well as in the Member State of enforcement, has gained more importance again. Therefore this paper analysis the characteristics of Austrian remedies in enforcement and their suitability for achieving the objects of Brussels I Recast.
