The principle of mutual recognition in the area of freedom security and justice

Abstract: Mutual recognition in the EU is both a goal and a principle in of itself, constructed and operationalised through individual provisions. The principle of mutual recognition is regarded as fundamental in enabling cooperation between Member States both in civil and criminal matters. The principle of mutual recognition has long ago outgrown the Internal Market and seeped through into judicial matters between Member States in the AFSJ. The accompanying realisation that the EU is not just an economic area is therefore evident. Since the inception of the idea of a Europe free of classical border checks facilitating freedom of movement was manifested, the fear of circumventing the application of judicial decisions became evermore real. Therefore, monumental changes in the fields of international criminal and international private law were expected and implemented in the European union (EU), through the principle of mutual trust and mutual recognition. Subsequently, classical concepts of private international and international criminal law gave way to Europeanised concepts of exequatur, the public policy exception, the principle of reciprocity, the principle of double criminality and the principle of specialty to name a few. It should be noted that these rules had been reserved to be enacted by the Member States. However, by loosening those principles the guarantees and freedoms which they either explicitly or implicitly guard are in danger of being sidestepped in order to enable mutual recognition. Therefore, at the forefront of the debate of mutual recognition of judicial decisions is the question of protecting fundamental rights and legal principles enshrined both in European and domestic legislation of the Member States. The balancing act that the EU preforms has to be careful enough to facilitate mutual recognition while not jeopardizing mutual trust between Member States. Today both EU private international law and EU criminal law work on the basis of the provisions which facilitate mutual recognition and limit it within the AFSJ. Since the basic idea behind mutual recognition is the same, i.e. free movement of judicial decisions, both their manifestations and their limits should strive to respect the basic framework of the field of law form which they stand. While the principle of mutual recognition has been slowly and methodically evolving, there is a sense of urgency with the development of the principle of mutual recognition in criminal matters.

Numerical modeling of floating prefabricated vertical drains in layered soil

Abstract: This paper presents a comparison of field measurements and a numerical model of settlements based on the construction of an embankment on soft soil for the Cirebon Power Plant Project in Indonesia, where prefabricated vertical drains (PVDs) were installed. In the numerical model, floating PVDs in two soil layers for two- and one-way drainage conditions are examined in order to determine the optimum penetration depth. In this study, good agreement between the field measurements of the settlements and the numerical prediction could be achieved. An interesting result of this study is that the differences in the stiffness and/or the permeability in the unimproved area below the PVD tip have a significant influence on the optimum penetration depth (L/H) in the two-soil-layer condition. The numerical study showed that it is possible to use floating PVDs in single drainage conditions if the second layer is stiffer and/or more permeable than the first layer.

Double diffusive natural convection in a horizontal porous layer with the boundary domain integral method

Abstract: We present the boundary-domain integral method, one of the numerical methods for solving the transport phenomena in porous media. The results for the case of double diffusive natural convection in a porous horizontal layer, which is fully saturated with an incompressible fluid, are obtained. Modified Navier-Stokes equations were used to describe the fluid motion in porous media in the form of conservation laws for mass, momentum, energy and species. Several results for different cases of double diffusive natural convection in a porous horizontal layer are presented and compared with some published studies in which calculations with other numerical methods were performed.

The language of appraisal in British advertisements

Abstract: The article explores the occurrence and frequency of use of attitudinal judgement in British advertisement texts. Judgement, as one of the main attitudinal categories in the discourse-semantic appraisal model (Martin and White 2005), is concerned with the evaluation of human character and behaviour. The article focuses on the judgement categories of capability and propriety, as the research described concludes that they are the most frequently occurring of the judgement categories. Some typical instances encoding capability and propriety are discussed in terms of explicit and implicit manifestation. The article demonstrates that capability and propriety often participate in attitudinal double-coding due to the brevity of advertising texts and the creativity of advertising language. Capability and propriety are strongly socially motivated: they impose values upon the potential consumer, and hence upon society, and through them create social roles for the participants in the advertising interaction.

NEZVESTOBA - ALI OBSTAJA RAZLIKA MED MOŠKO IN ŽENSKO NEZVESTOBO

Abstract: Osnovni namen diplomskega dela je ugotoviti, ali obstajajo razlike med moško in žensko nezvestobo. V teoretičnem delu diplomske naloge smo se osredotočili na zgodovinske, kulturne in družbene vidike nezvestobe in njihov vpliv na razlike med spoloma. Ugotavljali smo, kako individualizacija posameznikov in spremenjena vloga žensk vplivata na porast nezvestobe pri ženskem spolu. Razložili smo tri teorije, ki se ukvarjajo z nezvestobo in spolom: evolucijsko, »double-shot« hipotezo in sociobiologijo. V empiričnem delu smo z analizo ankete preverjali pet hipotez. Cilj je ugotoviti, ali moški res varajo pogosteje kot ženske, kakšna je povezava spola in starosti, ko pride do varanja, ali se percepcija varanja razlikuje glede na spol, ali so ženske res tiste, ki varanje bolj obžalujejo in ali obstajajo razlike med spoloma v vzrokih, zakaj do varanja sploh pride. Rezultati so pokazali, da razlik med spoloma v pogostosti varanja ni, pri vseh ostalih hipotezah pa razlike so, ampak rezultati niso bili vedno v skladu z našimi predpostavkami.

Zeta potential determination of polymeric materials using two differently designed measuring cells of an electrokinetic analyzer

Abstract: The so-called zeta potential can be determined through electrokinetic measurements and indicates the status regarding surface charges along the interface between solids and liquids. Surface charge gives us information about the condition, quality, and characteristics of a macroscopic surface in the polar medium. In our study the zeta potential was determined using a 'SurPASS' electrokinetic analyzer based on the streaming current and streaming potential measurements. The aim of the research was to compare the results of two differently designed measuring cells ('Adjustable Gap Cell' and 'Clamping Cell') but operating on the same principle. In order to investigate this problem, the zeta potential was determined for the three polymeric materials: poly(ethylene terephthalate) foil, thin-film polyamide composite membranes for nanofiltration and reverse osmosis. The results obtained with 'Clamping Cell' versus 'Adjustable Gap Cell' showed differences in zeta potential, where the 'Adjustable Gap Cell' gave more reproducible results. One reason for this behaviour could be the different geometries of the streaming channels. A more likely reason is the design of the 'Clamping Cell', that requires a sample size larger than necessary for zeta potential determination.

Boundary domain integral method for the study of double diffusive natural convection in porous media

Abstract: The main purpose of this paper is to present a boundary domain integral method(BDIM) for the solution of natural convection in porous media driven by combining thermal and solutal buoyancy forces. The Brinkman extension of the classical Darcy equation is used for the momentum conservation equation. The numerical scheme was tested on a natural convection problem within a square porous cavity, where different temperature and concentration values are applied on the vertical walls, while the horizontal walls are adiabatic and impermeable. The results for different governing parameters (Rayleigh number, Darcy number, buoyancy ratio and Lewis number) are presented and compared withpublished work. There is a good agreement between those results obtained using the presented numerical scheme and reported studies using other numerical methods.

EVTANAZIJA MED MEDICINO IN PRAVOM,Dileme pravnega urejanja evtanazije

Abstract: V diplomski nalogi predstavljam pojem evtanazije in možne načine definiranja tega pojma, podal bom zgodovinski pregled razvoja evtanazije in opisal v kakšnih oblikah se evtanazija lahko pojavlja oziroma katere vrste evtanazije poznamo. Sledi opredelitev pojmov, ki jih ni mogoče enačiti z pojmom evtanazije oziroma so iz definicije evtanazije izvzeti. Predstavljam tudi stališča zagovornikov in nasprotnikov evtanazije, t.i. argumente "za" in "proti" evtanaziji. Ker je pri evtanaziji bistvenega pomena medicinski vidik bom opisal razmerje med bolnikom (pacientom) in zdravnikom, ki lahko nastopa bodisi kot storilec evtanazije bodisi kot oseba, ki bolniku lajša bolečine na podlagi drugih priznanih metod ( npr. metoda double effect). V istem poglavju pojasnjujem tudi vrste odgovornosti zdravnika. V šestem poglavju podrobno predstavljam ureditev evtanazije na mednarodni ravni, v evropskih državah in v svetu ter posebej položaj, ki ga ima evtanazija v Republiki Sloveniji. Sledi opis posameznih aktualnih primerov, ki so bili medijsko precej odmevni. V sklepu pa predstavljam svoja razmišljanja in pogled na problematiko evtanazije, razne ugotovitve, pa tudi dejstva, ki spodbujajo nadaljnja razmišljanja. Za konec navajam še literaturo in pravne viri, ki so mi bili v pomoč pri pisanju diplomske naloge.
