1. Cross-cultural adaptation and validation of the Slovenian version of the Core outcome measures index for low back painMatevž Topolovec, David Vozlič, Nejc Plohl, Rok Vengust, Miha Vodičar, Anne Frances Mannion, 2020, izvirni znanstveni članek Opis: Background:To conduct a cross-cultural adaptation and validation of the Core Outcome Measures Index (COMI) in the Slovenian language, for use in patients with low back pain.
Methods:The English version of COMI was translated into Slovene following established guidelines. Three hundredfifty-three patients with chronic low back pain were recruited from the Orthopedic clinic department of a tertiary care teaching institution. Data quality, construct validity, responsiveness, and test-retest reliability of the COMI were assessed.
Results: The questionnaire was generally well accepted with no missing values. The majority of items exhibited only mild ceiling effects (below 20.0%) and some what more prominent floor effects, which were similar to previousstudies (4.5-78.8%). Correlations with Oswestry Disability Index (ODI) were high (= 0.76 between overall COMI andODI scores), suggesting that the Slovene version of COMI had high construct validity. Additionally, the Slovene version of COMI successfully captured surgical patients' improvement in their low back problem after surgery(overall COMI score change: Z =9.34,p< .001, r =0.53) and showed acceptable test-retest reliability (ICC = 0.86).
Conclusions:The Slovene version of COMI showed good psychometric properties, comparable to those of previously tested language versions. It represents a valuable instrument for the use in future domestic and multicenter clinical studies. 3. Aktualna vprašanja hipotekarnega prava s pregledom najnovejše sodne prakse : magistrsko deloEva Hvalec, 2023, magistrsko delo Opis: Magistrsko delo obravnava nekatera aktualna vprašanja hipotekarnega prava, v okviru katerih je teoretičnemu delu, ki je tvorjen iz predstavitve relevantnih zakonskih pravil ter stališč slovenskih pravnih strokovnjakov, dodan širok pregled novejše sodne prakse, ki bralcu omogoča vpogled v to, kako se pravna pravila v zadnjih letih udejanjajo v konkretnih življenjskih primerih. Posebna pozornost je namenjena vprašanju ekstenzivnosti hipoteke, hipoteki za zavarovanje tujega dolga, pravnim posledicam začetka stečajnega postopka za hipoteko kot ločitveno pravico, izbranima vprašanjema v zvezi z maksimalno hipoteko (prenosu z maksimalno hipoteko zavarovanih terjatev in zaznambi neposredne izvršljivosti notarskega zapisa pri maksimalni hipoteki), utesnitvi hipoteke, učinkom sodne in zunajsodne uveljavitve hipoteke na poznejše izvedene stvarne pravice, notarski prodaji zaradi zunajsodne uveljavitve hipoteke ter prepovedanim dogovorom pri hipoteki (predvsem komisornemu dogovoru in pravni operaciji sale and lease back). Čeprav magistrsko delo sodi na področje stvarnega prava, se pri obravnavanju posameznih vprašanj dotika tudi področij izvršilnega, stečajnega in obligacijskega prava. Ali se hipoteka razteza tudi na sončno elektrarno, ki je postavljena na zemljišču? Od koga lahko hipotekarni upnik zahteva poplačilo v primerih, ko glavni dolžnik, ki je pravna oseba, preneha zaradi stečaja? Kaj mora storiti hipotekarni upnik, če je nad dolžnikom začet stečajni postopek? Kakšni so učinki uveljavitve hipoteke na poznejše izvedene stvarne pravice in kakšna je usoda najemnikov ob prodaji nepremičnine, izvedene zaradi uveljavitve hipoteke? Kdaj je s pravno operacijo sale and lease back kršena prepoved komisornega dogovora? Odgovori na ta in številna druga vprašanja so v magistrskem delu podani sistematično, znotraj posameznih poglavij. Posamezna vprašanja magistrsko delo povezuje v ugotovitvi, da je pri nekaterih pravnih pravilih mogoče zaznati določene pomanjkljivosti, ki bi jih bilo v zasledovanju cilja učinkovite ureditve pravnega instituta hipoteke potrebno ustrezno spremeniti oziroma dopolniti. Predstavljene so nekatere možne rešitve, ki bi pripomogle k temu, da hipoteka svoj ugled ter osrednje mesto med zavarovanji terjatev ohrani tudi v prihodnje. 4. Prepovedani dogovori pri hipoteki s pregledom sodne prakse : magistrsko deloRene Toplak, 2021, magistrsko delo Opis: Magistrsko delo »Prepovedani dogovori pri hipoteki s pregledom sodne prakse« obravnava različne vrste dogovorov, za katere se dogovorita hipotekarni upnik in zastavitelj. Ker je rezultat teh dogovorov navadno okoriščenje ene izmed strank nasproti drugi stranki, jih pravni redi prepovedujejo.
Bistveni del (prepovedani dogovori) magistrske naloge je zajet v zadnjem, tretjem poglavju. Poglavje je razdeljeno na štiri različne prepovedane dogovore, kjer so podrobno opisane vse značilnosti teh dogovorov. Pri tem so zajete značilnosti iz zgodovine in današnje pravne ureditve, kakor tudi sodna praksa, ki smo jo podrobno obdelali. Še posebej je razčlenjen komisorni dogovor v povezavi z različnimi oblikami stvarnopravnih zavarovanj. V zadnjem podpoglavju pa sledijo primeri iz sodne prakse, ki pa so že predhodno obravnavani v jedrnem delu prepovedanih dogovorov. Ob temeljitem raziskovanju zakonodaje, teorije in sodne prakse glede razsežnosti prepovedanih dogovorov ugotovimo, da nam odgovor daje prav sodna praksa.
Ta je skozi odločitve zavzela enotno stališče, da je prepoved komisornega dogovora potrebno upoštevati, tudi če ne gre za zakonsko določeno obliko stvarnopravnega zavarovanja in ima posel drugačen videz, je pa njegov namen zavarovanje obveznosti. Posledica pa je ničnost vseh teh poslov, saj ni ničen dogovor, ki ga sploh ni, temveč učinek poslov kot celote, ki izigravajo prepoved komisornega dogovora oziroma njegov namen. Pri tem pa je delo sodišč, da vsak posel oz. kombinacijo poslov skrbno presodijo v smislu prepovedi komisornega dogovora. Sodna praksa gre v smeri, da je ključno preprečevanje neopravičene obogatitve, ne pa preprečevanje pridobitve lastninske pravice upnika na stvari, ali uresničitev poplačilne pravice, kot to absolutno velja pri zastavni pravici in je določeno v 132. členu Stvarnopravnega zakonika. 5. A fundamental study of the performance of X-section cast-in-place concrete single pilesYu Wang, Yaru Lv, Dongdong Zhang, Jieying Zhou, 2016, izvirni znanstveni članek Opis: X-section cast-in-place concrete (XCC) piles are used because they have a higher bearing capacity than circularsection cast-in-place concrete (CCC) piles of the same cross-sectional area. Although the bearing capacity of XCC piles has been studied, the performance of XCC single piles, especially for the stress-transfer mechanism dependent on the geometrical effects, is still not fully understood. This paper reports two comparative field static load tests on an XCC and a CCC single pile of the same cross-sectional area. In addition, corresponding threedimensional numerical back-analyses are performed to provide a fundamental understanding. The measured and computed results reveal that the XCC single pile has an approximately 25% higher ultimate bearing capacity than the CCC single pile. This is because the XCC single pile has an approximately 20% larger total side resistance, which is caused by a 60% larger pile perimeter and a slightly smaller unit side resistance. Lateral soil arching effects are developed, causing a non-uniform effective normal stress and a shear stress across the circumference of the XCC single pile. It is suggested that XCC single piles have a higher efficiency in terms of material saving compared with CCC single piles. 6. Time-dependent behaviour of reinforced cuts in weathered flysch rock massesMirko Grošić, Željko Arbanas, 2014, izvirni znanstveni članek Opis: Knowledge of stress-strain rock mass behaviour is crucial for many engineering purposes. Rock mass deformations and their influences on construction are observed during construction and even during exploitation phases. These deformations in the exploitation phase are caused by the time-dependent behaviour of the rock mass. A flysch rock mass is categorised as a heterogenic weak rock that has been intensely subjected to weathering processes. Due to weathering processes, the flysch rock mass degrades from fresh rock to residual soil within only a few meters of the geological profile below the surface. Observations of reinforced cuts along the Adriatic motorway near the City of Rijeka, Croatia, were conducted over a time period of seven years of spanning construction and exploitation. Measured displacements reached significant magnitudes during the exploitation period as a consequence of the time-dependent behaviour of the rock mass. The paper presents findings related to flysch rock mass weathering profile and its characteristics based on detailed geotechnical investigations and monitoring results coupled with back analyses. It was found possible to detect the thickness of the flysch rock mass weathering profile by performing detailed geotechnical investigations. Recommendations for the strength, deformation, and creep properties of the weathering profile of a flysch rock mass are given. 7. The behaviour of a two-componenet back-filling grout used in a tunnel-boring machineDaniele Peila, Luca Borio, Sebastiano Pelizza, 2011, izvirni znanstveni članek Opis: The instantaneous filling of the annulus that is created behind the segment lining at the end of the tail during the TBM advance is an operation of paramount importance. Its main goal is to minimize the surface settlements due to any over-excavation generated by the passage of the TBM. To correctly achieve the goals, a simultaneous back-filling system and the injected material should satisfy the technical, operational and performance characteristics. A two-component system injection for the back-filling is progressively substituting the use of traditional mortars. In this paper different systems of back-filling grout and in particular the two-component system are analyzed and the results of laboratory tests are presented and discussed. 8. New trends in rock mass characterisation for designing geotechnical structuresDrago Ocepek, 2005, izvirni znanstveni članek Opis: The investigation on designing supporting measures for geotechnical structures consists of the proper selection of the input data for the stress – strain analysis of the excavation process and the selection of retaining measures. In the preliminary phase of investigation the area must be geologically mapped in detail, and discontinuities precisely measured, boreholes and their “in situ” tests listed and samples for laboratory examinations taken. The new method allows rock mass classification for different rock quality, from soft rocks to mixed rock masses, as well as determination of the geological strength index GSI. The limits for using the suggested method are persistent discontinuities in rock mass which lead to translation or rotation failure mechanisms, either in a single plane or as a wedge. In all cases where discontinuities play a significant role, the rock mass structure must be considered and kinematical analyses performed. In other circumstances, a rock may be uniform and reasonably isotropic due to the geometry of discontinuities and their mutual intersections. The value range of GSI is first determined in the beginning of investigation and later in the excavation phase by considering the disturbance factor D, which expresses disturbances caused by excavation methods and rock mass relaxation. The strength and deformability parameters of rocks of different quality are determined by the generalized Hoek-Brown failure criterion and applied to shallow and deep tunnels or slopes. Before the start of excavations work and after establishing the retaining measures, the analysis results are checked by monitoring. New methods include the determination of post peak strength parameters of rock mass after relaxation, and routine measurements. The newest measurement system however allows direct readings of displacements of the rock mass in both the elastic and post-peak states. With back analyses we determine the softening behavior of the rock mass and a possible need for increasing retaining measures. Such a design method enables the optimization of retaining measures and the reduction of investment costs. 9. Back analysis of time-dependet displacement at the Trojane tunnel constructionJakob Likar, 2004, izvirni znanstveni članek Opis: The 2,900-metre double tube tunnel of Trojane forms part of the highway section between Celje and Ljubljana and part of the highway road system connecting Lendava and Koper with adjacent roads. The construction of this section, which is of special importance for the Republic Slovenia, has been going on for almost ten years.
The highway near Trojane where the tunnel is located, lies on a hilly terrain composed of Permian-carboniferous rocks, which are tectonically badly damaged in some places and marked with broad fault zones, containing tectonically remoulded soil of low strength in terms of deformability properties. Even though the amount of waters coming from the hills during the excavation of the tunnel was relatively small, this water, in combination with extremely damaged weak rock caused the increase of deformations at the construction site.
Geological and geotechnical surveying with geometric monitoring and the analyses of stress and deformation changes in the surrounding rocks and support elements were critical in assessing the actual weak-rock conditions during the course of construction. Since the analyses of deformation processes, which had been modelled with PLAXIS 3D TUNNEL PROGRAM, showed great impact on permanent stability of the tunnel, special care was paid to rheological changes in the surrounding rocks and combined in-built support elements.
3D back analyses with SOFT-SOIL-CREEP (SSC) constitutive model, which takes into account rheological phenomena, were carried out. The calculations of primary and secondary stresses and deformations were made for two characteristic areas and determined on the basis of realistic geological mapping during tunnel construction. The first area represented typical rocks of the Trojane tunnel, i.e. shales and siltstone, while the second one was a tectonic zone where geological and geotechnical conditions during excavation were less favourable. The results of back analyses used provided an acceptable possibility for estimating the stress-strain variation during construction as well as an appropriate basis for analysing vertical displacements at the tunnel roof. The calculation results show good correlation with field measurements. 10. Psychosocial factors in the development of low back pain among professional driversFriderika Kresal, Tine Bertoncel, Maja Meško, 2017, izvirni znanstveni članek Opis: Background and purpose: Professional drivers as a group are exposed to high risk of developing low back pain due to ergonomic factors and work conditions. The purpose of the study was to examine to what extent the low back pain occurs among Slovene professional drivers as a result of the development of various psychosocial factors.
Methodology: The study involved 275 respondents (professional bus drivers, car/van drivers, international truck/ lorry drivers, and ambulance car drivers). Hypotheses were tested using multivariate statistical method (regression analysis) and analysis of variance. Data were collected by structured questionnaire comprised of three parts: socio-demographic data, basic psychosocial factors causing low back pain, and incidence, duration and severity of low back pain as a result of psychosocial risk factors, was implemented.
Results: The results of quantitative survey suggest that low back pain is mostly caused by lifting and carrying heavy loads, inadequate working conditions, poor physical fitness, regular nights out, shift work, and stress. Only the impact of gender on low back pain distress among professional drivers was confirmed, predominantly among bus drivers and lorry drivers on international routes. Low back pain occurrence was less common, albeit not statistically significant, among professional drivers of vans and passenger cars.
Conclusion: Our study suggests that psychosocial factors are also important cause for the development of low back pain among professional drivers and can limit the quality of their social and professional lives.
