"Here and there one seed sprouts, and then it seems we have done something" : nurturing creativity in elementary schools

Opis: The Lisbon Strategy and other documents of the European Union advocating for a knowledge-based society have provided the ground for restructuring schools and changing pedagogical approaches to teaching and learning, focusing on creativity and entrepreneurship. One of the approaches increasingly popular in Slovenia has been Edward de Bono's methodology. The article analyses the benefits, controversies, and potentials of de Bono's "lateral thinking" methods for increasing creativity when introduced to children in elementary school courses and extracurricular activities. Based on the qualitative study, it explores how this "pragmatic" approach to creativity is realised in Slovenian elementary schools, and reflects on teaching creativity in schools as a systemic approach.

Evaluating gastronomic destination competitiveness through upscale gastronomy

Opis: Food has evolved from a basic necessity to a primary motivation for travel. While providing a high-quality gastronomic offer is still a restaurant's primary function, quality is no longer enough; today's demanding guests seek unique and memorable dining experiences. A restaurant's competences play a significant role in shaping the guests' overall perception of the quality and derived perceived value, both of which ultimately impact the competitiveness of both the restaurant and the gastronomic destination. The main contribution of this article is the development of a novel theoretical model-GADECOMP-which is designed to measure a gastronomic destination's competitiveness by centering it around the destination's gastronomic offer. Exploratory factor analyses confirmed that the instrument is reliable and valid. The model was tested on upscale restaurant guests in Slovenia, Italy, and Croatia. Additionally, the SERVQUAL model of quality measurement was transferred from the entrepreneurial level to the destination level. Our method uses a unique competence approach and expands and diversifies the existing quality concepts by using elements of innovativeness, creativity, sustainability, and local features. The GADECOMP model measures the perceived quality of a gastronomic destination through its competences, which are reflected in the gastronomic destination offer. A regression analysis was used to identify the strength of the effect that perceived value has on the gastronomic destination offer and gastronomic destination competences.

The Phenomenon of (Sustainable) Tourism Activities on Farms in Slovenia During the COVID-19 Pandemic

Opis: The outbreak of the COVID-19 pandemic is the reason why the development trends of the tourism industry are changing today. The purpose of this article is to address issues of future tourism industry development, linking it to elements of sustainable development trends. The article presents the main elements of the sustainable concept of rural and farm tourism. Using the method of compilation and description, we want to check, based on statistical data related to farm tourism activities in Slovenia (before and during the COVID-19 pandemic), whether it is possible to detect development trends in Slovenia, in the direction of sustainability that are linked to the concept of farm tourism. This study also aims to identify a number of measures that can improve sustainability at the farming tourism level in Slovenia, in a post-COVID phase. According to the findings of numerous comparisons and statistical analysis, it can be stated that the future development trends show a great need to develop the decarbonisation of the industry, digitalisation of industry, and the involvement of the local population in the provision of services. In the present global situation, we have reached a point where it will be necessary to focus on sustainable and digital forms of the industry, in order to further post-COVID development of the tourism industry.

Cultural events as tools of developing sustainable tourism in rural areas : the case of Sevnica in Slovenia

Opis: The purpose of this article is to identify cultural tourism as one of the best practices that can help in the implementation of the Strategy for Sustainable Growth of Slovenian Tourism (2017 - 2021) and to examine the role of cultural events as tools for the development of sustainable tourism. The latter is one of the main trends in the tourism sector, at least in the European context and also in Slovenia as a member country of the European Union. The challenge of developing sustainable tourism destinations is considerable in rural areas, where local communities must be closely observed and by all means included in the decision-making process on future tourism development. This is of the utmost importance as tourism is much more than an economic activity. Therefore, key decision-makers need to be aware that tourism activities affect all local people and many areas of their life and that the role of tourism in rural areas is to improve the quality of life of the local population. Since at least some form of culture can be found in every village, small (rural) tourist destinations often find important opportunities for sustainable tourism development in organizing cultural events, which lead to greater community visibility, cultural branding of the destination, which is significant and also several business opportunities. On the case of Sevnica, this article aims to demonstrate that there is great potential for further development of cultural tourism and its subtypes in Slovenia by further developing cultural tourism and various tourism products based on rich cultural heritage.

Motivations for hosting on Airbnb : the case of Slovenia

Opis: The ‘platform economy’ has evolved over the years into a global phenomenon. The focus of this paper is the motivations of Slovene hosts to use the Airbnb platform. While Airbnb was originally optimistically discussed as an element of ‘the sharing economy’, it has become known as one of the key players of the ‘platform economy’, belonging to the area of the so-called capital platforms, which allow participation-based primarily based on ownership of capital. Our research amongst a sample of 103 officially registered accommodation providers in Slovenia has shown that Airbnb is the second-most used platform, on average bringing a third of income for the surveyed participants, while Booking.com brings about half of their income. Furthermore, the results show that monetary motives prevail among Slovene hosts. However, social and moral motives are also strongly expressed. These findings indicate that the perceived primary purpose of Airbnb is generating additional earnings due to a surplus of real estate capital. A higher share of income from hosting in comparison to other types of income is correlated with the expressed importance of monetary motives. In contrast, the prevalence of social motives is influenced by fear of loneliness, cultural openness, and hosts’ global prosociality.

Adapting the wellness offer in Slovenian spas to the new COVID-19 pandemic conditions*

Opis: The COVID-19 pandemic has had a markedly negative impact on global tourism and, on the other hand, has offered new opportunities for researchers to analyze the resilience of the tourism industry in such conditions. Recently, several scientific articles have emerged claiming that the COVID-19 pandemic could represent an opportunity for significant changes in tourism. This refers to changing practices at several levels and spreading new ethical principles. The pandemic has also made people aware of the importance of “well-being”. Even without a pandemic, wellness tourism has been one of the fastest-growing types of tourism in recent years. In all parts of the world, including Slovenia, natural spas have tried to adapt to new conditions during the COVID-19 pandemic. Our analysis confirms that visitors to Slovenian spas strongly support introducing new/alternative activities and thus the dispersion of visitors to several locations. They showed the greatest interest in visiting nature in the vicinity of spas, which is also expected as a result of the closure during the pandemic. The purpose of our article is to give suggestions for offering alternative activities in Slovenian natural spas. However, adapting the wellness offer in spas should ensure that the basic traditional principles of wellness are maintained.

The policing perspective of personal data protection and the right to be forgotten in Europe and in the Republic of Slovenia

Opis: Purpose: The article raises the question, whether the data protection regulation in police procedures is sufficient and whether it does not ‘harm’ the person subject to the procedure. Design/Methods/Approach: The impact, advantages and disadvantages of legislative changes on implementing specific police tasks (e.g. biometric data, facial recognition systems and automatic identification of vehicle registration plates) are presented, emphasising regulation in the Republic of Slovenia as a systematic literature review. Findings: The latest changes in personal data protection were related to the definition, collection, processing, use, transmission and storage of personal data. An individual has rights relating to access to information, processing, correction, restrictions on use, transferability, deletion and objection to the processing of personal data. When police operate within the law, their powers must align with constitutional and legal provisions. This alignment safeguards interventions in individual privacy. Yet, without legal clarity, known as lex certa, there’s a risk of actions becoming unwarranted intrusions into rights and freedoms. A consensus is needed between the protection of individual privacy and enabling the effective investigation and control of crime by law enforcement authorities. Research Limitation/Implications: The research was focus only on data protection regulation in police procedures. Practical Implication: The findings of the article offer insight into data protection regulation in police procedures and highlights the gaps and formulate starting points for future research. Originality/Value: The article is the first systematic literature review in data protection in police procedures in Slovenia.

Korupcijska kazniva dejanja : magistrsko delo

Opis: V slovenski kazenskopravni ureditvi pojem korupcije zajema deset korupcijskih kaznivih dejanj. Inkriminacije slednjih so v Kazenskem zakoniku sistematično umeščene v poglavja volilnih kaznivih dejanj, gospodarskih kaznivih dejanj in kaznivih dejanj zoper uradno dolžnost. Korupcijska kazniva dejanja praviloma potekajo med dvema osebama, ki se ne čutita žrtvi v kazenskopravnem pomenu besede in nista pripravljeni sodelovati z organi odkrivanja in pregona, saj je inkriminirano dejanje obeh udeležencev. Zaradi navedenega in dejstva, da obstaja med udeležencema najvišja stopnja diskretnosti, uvrščamo korupcijska kazniva dejanja med ena (naj)težje dokazljivih kaznivih dejanj. Že vse od leta 2012 Slovenija na Indeksu zaznave korupcije Transparency International ne beleži napredka. Celo več, Slovenija je v zadnjih desetih letih na Indeksu zaznave korupcije Transparency International nazadovala za skupno pet točk in tako na Indeksu zaznave korupcije Transparency International za leto 2022 dosegla svoj zgodovinsko najnižji rezultat, in sicer se je z oceno 56/100 uvrstila na 41. mesto. Ta podatek odraža počasen napredek z reformami in odsotnost ukrepov, s katerimi bi se že obstoječa pravila udejanjila v praksi. Slovenija bi lahko obstoječe zaskrbljujoče stanje korupcije izboljšala s prizadevanjem, da postane Komisija za preprečevanje korupcije bolj učinkovita, kar bi lahko dosegla na način, da bi s strani Komisije za preprečevanje korupcije ugotovljene kršitve integritete pridobile vse več potrditev s strani sodišč; z novelacijo oziroma prenovo Zakona o integriteti in preprečevanju korupcije, s katero bi se vpeljale primerne sankcije za potrjene kršitve, med drugim tudi integritete, in sankcije za neodzivnost na priporočila, izdana s strani Komisije za preprečevanje korupcije; s prenovo Resolucije o preprečevanju korupcije v Republiki Sloveniji, v okviru katere bi lahko vsakokratne predvolilne obljube politike preoblikovali v prakso; z uvedbo obrnjenega dokaznega bremena pri dokazovanju premoženjske koristi, čigar smisel je v tem, da osumljeni izgubi svoje premoženje, v kolikor ne more dokazati, da ga je pridobil zakonito in tako plačal vse obveznosti državi, ter s sprejemom presumpcije oziroma domneve, da premoženje osumljene osebe vselej izvira iz kaznivih dejanj, v kolikor ne ustreza njegovim legalnim dohodkom. Analiza ukrepov za preprečevanje korupcije je pokazala, da so pri preprečevanju pojava korupcije bolj učinkoviti preventivni ukrepi, ki za razliko od represivnih ukrepov v družbi ustvarjajo takšne razmere, v katerih se korupcija sploh ne more razviti, in na ta način vodijo do odprave celotnega pojava korupcije in ne zgolj do odprave posameznih posledic pojava korupcije, do katerih vodijo represivni ukrepi. Na področju preventivnega delovanja oziroma preventivnih ukrepov za preprečevanje korupcije ima ključno vlogo Konvencija Združenih narodov proti korupciji, ki podpisnicam nalaga vzpostavitev raznovrstnih preventivnih ukrepov. Sama narava korupcijskih kaznivih dejanj, ki vključuje izvršitev na štiri oči ter odsotnost neposrednih dokazov, pa omogoča, ob upoštevanju, da je predhodno odobrena s strani pravosodnih organov, tudi uporabo posebnih metod in sredstev oziroma represivnih ukrepov, in sicer prikritih preiskovalnih ukrepov skladno z določbo 150. člena Zakona o kazenskem postopku ter ukrepa navideznega odkupa, navideznega sprejemanja oziroma dajanja daril ali navideznega jemanja oziroma dajanja podkupnine skladno z določbo 155. člena Zakona o kazenskem postopku, pri čemer lahko slednji pod določenimi pogoji privede do t. i. policijske provokacije, ki je prepovedana. Analiza nabave zaščitne opreme, potrebne pri obvladovanju nalezljive bolezni covida-19, s strani Zavoda Republike Slovenije za blagovne rezerve, drugih subjektov javnega sektorja, izbranih občin in javnih zdravstvenih zavodov je pokazala, da so bila ugotovljena korupcijska tveganja v prav vseh fazah javnega naročanja.

Economic analysis of the cultural and creative industries in Slovenia

Opis: This paper presents results of the qualitative and quantitative economic analyses of the cultural and creative industries (CCI), which were carried outwithin two projects: "Creative Cities" and "The state of design, with a focus on industrial design, as a part of creative industries, and best international practices as a foundation for fostering this sector in Slovenia." This paper tacked the several methodological issues related to CCI analysis by combining different methodological approaches in order to improve their reliability. The main results of the public sector, industrial, occupational, and SWOT (strengths, weaknesses, opportunities, threats) analyses are described. CCI in Slovenia presented as a potential that has not been fully mobilised. In order to further develop CCI and exploit the economic potential, a comprehensive policy support of CCI at the local, national, and EU levels is needed.
