1. Vpliv umetne inteligence na varstvo osebnih podatkov : magistrsko deloMaja Štritof, 2025, magistrsko delo Opis: Hitro napredujoča tehnologija, zlasti na področju umetne inteligence in avtomatiziranega odločanja, bistveno prispeva k eksponentnemu povečanju količine dostopnih podatkov. To odpira številne pravne izzive in narekuje potrebo po prilagajanju obstoječih zakonodajnih okvirov. Umetna inteligenca omogoča obsežno zbiranje in poglobljeno analizo podatkov iz različnih virov. Med relevantne primere sodobnih tehnologij spadajo tehnologija za prepoznavo obrazov, računalniški vid, deepfakes, personalizirano oglaševanje, sistemi za samodejno prepoznavo registrskih tablic, avtonomna vozila in internet stvari. Takšna raba tehnologije odpira pomembna etična in pravna vprašanja, zlasti glede zakonitosti, varnosti in transparentnosti obdelave osebnih podatkov. Zaradi tega postaja ključno razumeti vpliv umetne inteligence na pravico do zasebnosti in varstva osebnih podatkov. Za celovito razumevanje tega tehnološkega pojava je nujno tudi dobro poznavanje pravnega okvira, tako na mednarodni ravni kot na ravni Evropske unije. Le tako lahko razumemo, katere pravice nam pripadajo, kateri podatki se lahko obdelujejo ter katera tveganja grozijo varnosti, temeljnim pravicam in drugim družbenim interesom. V magistrskem delu je predstavljen razvoj umetne inteligence in njen vpliv na obdelavo podatkov, pri čemer so izpostavljeni ključni izzivi sodobne tehnologije. Poseben poudarek je namenjen pravnem okviru varstva osebnih podatkov in zasebnosti, s poudarkom na Splošni uredbi o varstvu podatkov (Uredbi GDPR) ter Aktu o umetni inteligenci. 2. Izredna odpoved delodajalca v luči novejše sodne prakse : magistrsko deloHana Kotnik, 2025, magistrsko delo Opis: Izredna odpoved pogodbe o zaposlitvi je najstrožja delovnopravna sankcija in skrajni ukrep po katerem lahko delodajalec poseže v primeru najhujših delavčevih kršitev in drugih razlogov, ki utemeljujejo takojšnje prenehanje delovnega razmerja. ZDR-1 predvideva osem razlogov za izredno odpoved delodajalca. Gre za kršitve obveznosti iz delovnega razmerja oziroma situacije, za katere je že sam zakonodajalec predvidel, da upravičujejo podajo sankcije v obliki izredne odpovedi pogodbe o zaposlitvi. Za zakonitost izredne odpovedi pa se poleg tega, da je izpolnjen kateri izmed osmih odpovednih razlogov zahteva tudi, da so izpolnjeni ostali pogoji za njeno zakonitost, predvsem, da je delavcu omogočen zagovor, da obstajajo okoliščine, ki utemeljujejo takojšnje prenehanje delovnega razmerja brez odpovednega roka, da je odpoved podana v zakonsko predvidenih rokih in tudi ustrezno obrazložena. Zakonodajalec v zakonu ni predvidel vseh situacij in razlag pravnih vprašanj, ki se ob uporabi instituta izredne odpovedi pojavljajo v praksi. Prav sodna praksa je tista, ki pripomore k razlagi posameznih izrednih odpovednih razlogov ter ostalih pravnih vprašanj povezanih z izredno odpovedjo delodajalca ter prikazuje kako se ti uporabljajo in razlagajo v praksi. Vrhovno sodišče Republike Slovenije in Višje delovno in socialno sodišče tudi v novejših sodnih odločbah obravnavata pravna vprašanja povezana z izredno odpovedjo ter pripomoreta k razlagi pravnih institutov ter pravnih vprašanj povezanih z izredno odpovedjo, s čimer dopolnjujeta obstoječo sodno prakso.
V skladu z načelom stopnjevitosti sankcij v delovnem pravu izredna odpoved pogodbe o zaposlitvi kot najstrožja sankcija pride v poštev zgolj v primeru najhujših kršitev. Ob tem se pojavlja vprašanje, kdaj gre za hujšo kršitev delovnih obveznosti, ki upravičuje podajo izredne odpovedi brez odpovednega roka in kdaj gre za kršitev, ki upravičuje podajo katere od milejših sankcij na primer redne odpovedi iz krivdnega razloga z odpovednim rokom. Tako v primeru pojma hujše kršitve kot pojma krivdnega razloga gre za pravni standard, ki ga zapolnjuje sodna praksa. Iz novejše sodne prakse ne izhaja točna ločnica v katerih primerih pride v poštev prva in kdaj druga, saj postavlja zgolj nekatere smernice kdaj gre za hujšo kršitev delovnih obveznosti in kdaj ne. Presoja ali gre za hujšo kršitev je namreč v vsakem primeru odvisna od okoliščin konkretnega primera. 3. Legal regulation of MAR and their impact on the child's right to origin disclosure – a slovenian perspectiveSuzana Kraljić, 2025, izvirni znanstveni članek Opis: Having a child remains one of the fundamental values of life for individuals. However, many individuals and couples face difficulties in conceiving a child naturally. The rapid development of medicine—in particular, reproductive medicine—has brought hope and the realisation of the desire to have a child to individuals and couples who, in the past, would have remained childless. Artificial reproductive technologies have been developed, enabling the conception of a child who is genetically related to both parents, as well as a child whose conception involves a third party (e.g., a gamete donor, surrogate mother, or mitochondrial parent). The rapid development of reproductive medicine also requires appropriate legal regulations. In particular, issues relating to the right to disclosure of persons conceived with donated gametes and the related right to know the (genetic) origin have been raised in recent years. Many legislations, including that of Slovenia, still lean more toward maintaining donor anonymity, with possible exceptions (e.g., medical reasons), primarily regarding access to nonidentifying information about the donors. While Slovenian legislation emphasises the right of the child to information on their origin, it limits this to essential medical information and does not include personal data about the donor. This paper discusses possible amendments to existing Slovenian legislation in light of defining a child's right to origin disclosure and balancing the interests of the other parties involved. 4. Labour law aspects of child labour in the information ageMojca Tancer Verboten, 2025, samostojni znanstveni sestavek ali poglavje v monografski publikaciji Opis: The article analyses the labour law aspects of child labour in the information age. It presents in detail the specific features related to the regulation of child labour and the possibilities of applying labour law legislation particularly to the work of children under the age of 15, pupils and students. Three sections are discussed: the normative regulation of child labour, the specific features of performing light work by children, the special protection provisions that apply to child labour, and the specific features related to digital child labour, which is emerging as a new form of work. The basic hypothesis in the article is that when defining child labour and the emergence of new forms of work, such as the work of information child influencers, it is necessary to regulate this appropriately in a way that takes into account the specific features of the situation of children who perform such work so that such work does not harm their safety, health, morality, education and development. 6. 35 years of child rights and the emerging right to a healthy environmentCocou Marius Mensah, Zorica Brajovič Mensah, 2025, samostojni znanstveni sestavek ali poglavje v monografski publikaciji Opis: As of November 20, 2024, 35 years have passed since the adoption of the United Nations Convention on the Rights of the Child (UNCRC) in 1989, a unique and binding instrument that enshrined, for the first time in international law, a comprehensive set of rights for children across the globe. While the UNCRC has driven significant progress since its adoption in 1989, emerging challenges, particularly digitalisation and the climate crisis, reveal critical gaps in its implementation. This article evaluates three decades of achievements in child rights protection, identifies persistent shortcomings, and examines the urgent need to address environmental degradation as a violation of children’s rights. Through an analysis of international legal provisions and landmark cases, the authors argue for stronger enforcement mechanisms to uphold children’s right to a healthy environment. 7. Children's right to privacy in the virtual world of appsSuzana Kraljić, Ema Turnšek, 2025, samostojni znanstveni sestavek ali poglavje v monografski publikaciji Opis: The world has become increasingly globalized, with the exchange of goods and services spanning continents, often leading to clashes between differently regulated legal systems. A prominent example of such a conflict arises in the context of digital health applications and the processing of personal data within them. Although in the sense of human rights, the rights to privacy and data protection are guaranteed to every person with numerous national and international legal acts, and secondary law and sectoral legislation that delves into this field. In Europe, personal health data are mainly regulated with GDPR, whereas in US the field is fragmented and regulated by sectoral regulations. The issue occurs when we deal with the protection of personal health data in the virtual world of health apps, which in the US remains in the grey zone without proper legal safeguards. US HIPAA, which governs personal health data at the federal level, does not protect all data provided to a health app, not even data provided to unlicensed counsel offering services through it. 8. Minimum age of criminal liability of childrenMaša Kočivnik, Miha Šepec, 2025, samostojni znanstveni sestavek ali poglavje v monografski publikaciji Opis: Accusing the perpetrator of criminal responsibility makes sense only if he understands the significance of his actions. Since it is a generally accepted fact that children are not capable of developing culpable responsibility until a certain age, practically every criminal law in the world sets an age limit up to which criminal responsibility cannot be attributed to a child. Until a certain age, the child is not mentally developed and mature enough to be able to understand the consequences of his behaviour, and thereby, he develops guilt in the criminal law sense, which deserves the criminal law repression of the state. The question remains, what should be the age up to which the child does not answer for committing a crime? In this chapter, the authors examine this question. At the same time, we wonder whether it is fair and just that a child who commits a serious crime, while being aware that his behaviour is evil (so he actually understands the consequences of his action), is not criminally responsible just because he has not yet reached the objectively set age in the Criminal Code. 9. Safeguarding the child's best interests in judicial proceedings through digital technologyKatja Drnovšek, 2025, samostojni znanstveni sestavek ali poglavje v monografski publikaciji Opis: Although appearing in court can cause significant psychological distress to children, especially when involved in criminal proceedings or family disputes, their participation in judicial proceedings is sometimes unavoidable. While children's procedural rights are rarely the main issue in proceedings before the ECtHR, its case law has nonetheless established certain standards concerning the need for child-friendly approaches. However, safeguarding children's rights to effective participation and to be heard while simultaneously protecting them from secondary victimisation remains challenging. With the development of technology and the digitalisation of judicial systems, new approaches and opportunities continue to emerge. Remote hearings and various digital tools hold great potential to make judicial proceedings less intimidating and traumatic when implemented with proper safeguards. The paper analyses relevant ECtHR case law, the psychological aspects of remote hearings, and some examples of Slovenian good practices concerning using digital tools in judicial proceedings involving children. 10. Praktikum za delovno pravoDarja Senčur Peček, Aljoša Polajžar, 2025, učbenik za višje in visoke šole Opis: Predmetni praktikum predstavlja učno gradivo, ki je namenjeno študentom, ki se tekom študija srečujejo s področjem delovnega prava oziroma tematiko delovnih razmerij. Praktikum vsebuje jedra ključnih sodnih odločb (predvsem Delovno-socialnega oddelka Vrhovnega sodišča RS), s katerimi želita avtorja študentom približati posamezne delovnopravne institute.
