Optional protocol on the sale of children, child prostitution and child pornography – criminalising practices including and exceeding exploitation and abuse of children

Opis: The 2000 Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography is considered one of the most widely ratified international treaties, promulgating the incrimination of customers and intermediaries in cases of sexual and other forms of exploitation of children. This chapter highlights its strengths and limitations. Special emphasis is placed on provisions prohibiting and criminalising practices covered under the Protocol, particularly concerning topical and divisive issues such as commercial surrogacy, virtual pornography and the maximum age of protection under the Optional Protocol. Moreover, topics such as sanctions and other substantive issues, jurisdiction, freezing and confiscation of assets, extradition and further instruments of mutual legal assistance, rights of child victims and preventive measures are briefly addressed. Where applicable, the contrast between the Convention and the Optional Protocol is emphasised, as the drafters of the latter opted for a more welfarist approach. This implies that the Optional Protocol drastically limits children’s agency to, for example, using explicit sexual materials in the context of sexting as a part of their sexual development. Recognising this issue, the authors argue against an unreasonably extensive interpretation of the Protocol’s provisions which concern practices that far exceed the exploitation or abuse of children.

A new logistic regression approach for the identification of factors affecting the partition of costs and risk in the international trade

Opis: Background: The selection of the right Incoterms is crucial for minimising risks and costs in international trade. This paper aims to develop a model that identifies the key factors influencing the selection of Incoterms. The main contribution of the research is the creation of a new statistical modelling process that effectively identifies the variables impacting trade costs and risk. The study uses import and export data from non-EU countries in the context of a Slovenian case study. Methods: A novel model selection mechanism is developed, combining the logistic regression (logit) modelling with Monte Carlo simulations to identify influential factors in Incoterms selection. This mechanism incorporates heuristic techniques, which guide a sequential process of gradually searching through logit model candidates to determine the bestfit model for both import and export scenarios. Results: The application of the new logit modelling procedure reveals that the delivery location is the most significant factor affecting Incoterms selection. Additionally, the value of goods and the type of transport (containerised vs. noncontainerised) also have a considerable influence. For imports, the mass of goods is found to be a significant factor as well. Conclusions: The research results offer valuable insights for companies formulating their international business strategies. By selecting the appropriate Incoterm, companies can reduce transportation risks and costs. Managing costs and risks is especially important for higher-value goods. The research finds that, for lower-value goods, sellers often take on associated costs and risks. This pattern is particularly notable with imports, where sellers are more likely to assume responsibility for lighter-weight goods.

Impact of the COVID-19 pandemic on international freight transport in Slovenia and EU

Opis: The sudden emergence of COVID-19 and the declaration of a pandemic in the year 2020 has significantly impacted all factors of the economy, including international trade of goods. International freight transport (road, rail, air, and maritime) was also affected. The research analyses the changes in the implementation of international freight transport during the COVID-19 pandemic in EU countries. The main research question was: How did the COVID-19 pandemic impact international freight transport in Slovenia and selected EU member countries? According to the results, we can see that the pandemic outbreak had a different impact on each type of transport. Some modes of transport were more negatively affected by the pandemic than others. In the case of international road freight transport, the pandemic positively affected it (both in Slovenia and at the EU level) since the volume of transported goods increased

A comparative analysis of competitive trade in a cluster market of the European Union : the Revealed Comparative Advantage (RCA) Index

Opis: This research is concerned with the comparative analysis of competitive trade within the cluster market economies of the European Union. The aim of this paper is to carry out trade analysis within the competing countries in the European market from 2009 to 2018 which represents the period after the global crisis of 2008 and prior to the Covid-19 pandemic of 2019 for the purpose of determining the extent of competitive trade within the European economies. The chosen metric is Béla Balassa’s Revealed Comparative Advantage (RCA) index used for determining various countries’ comparative advantage or disadvantage in trade. The findings show that the countries with RCA > 1 thrive economically in comparison to other competing lower economies. And the fact that the European Union economy thrives on mechanized trade other than agricultural products irrespective of the competitive market. This study is a significant contribution towards improving the Ricardian model of comparative advantage on trade within a cluster market in the European economies.

Resolving intellectual property disputes

Opis: Within recent decades, increasing the complexity of international trade has resulted in changing many dimensions of doing business with other nations and relevant problems to it. Rising the importance of intellectual property rights as intangible assets of companies is considered among most important characters of modern business process which applies to multinational enterprises and other forms of companies who intend to enter the global market place equally. Benefiting from global marketplace and at the same time protecting IPRs is a difficult goal to achieve due to intangible and diverse nature of such rights which results. In practice of international trade, there is high probability for companies to face with IPR related disputes. Therefore, choice of proper IP Dispute Resolution mechanism is an important step in designing overall IP strategy of the firm as an improper IP dispute resolution method can impose high financial costs as well as affecting reputation of the firm. Current paper tries to answer to the question of what is the most suitable dispute resolution method for IP related disputes. And in order to achieve this objective, paper explores different types of IP disputes, different approaches for resolving IP disputes, factors affecting the choice of method for resolving IP disputes and finally, it will analyse application of dispute resolution mechanisms in different types of IP related disputes.

Slovenia's trade in goods and services with Australia and New Zealand

Opis: This paper analyses Slovenia´s trade in goods and services with Australia and New Zealand, two of Slovenia´ s less important trading partners. In 2012, the value of Slovenia´s trade in goods and services with Australia and New Zealand amounted to EUR 85.1 million, 0.2 % of the value of Slovenia´s trade in goods and services with the world and an increase of 46.3 % over the previous year. In the same year, the value of Slovenia´s exports of goods and services to Australia and New Zealand amounted to EUR 74.9 million, 0.3 % of the value of Slovenia´s exports of goods and services to the world and an increase of 69.2 % ov er the previous year, while the value of Slovenia´s imports of goods and services from Australia and New Zealand amounted to EUR 10.2 million, 0.4 % of the value of Slovenia´s imports of goods and services from the world and a decrease of 26.8 % over the prev ious year. Therefore, a number of (additional) measures should be taken by Slovenia in order to further enhance its trade in goods and services with these two countries.

Opportunities to increase the value of Slovenia's trade in goods with the Pacific Rim countries : the case of Australia

Opis: Slovenia is, like many other countries, especially small ones, dependent on exports and imports of goods and services. European countries are Slovenia´s main trade partners, together accounting for almost 90 per cent of the value of Slovenia´s trade in goods. There are various reasons for this, such as the relatively short distance between Slovenia and other European countries. If Slovenia wants to increase the value of its trade with non-European countries, it should adopt a number of measures, such as increasing the effectiveness and efficiency of its trade promotion. In this paper the authors discuss opportunities to increase the value of Slovenia´s trade in goods with the Pacific Rim countries by focusing on the specific case of Australia.
