Local governments as providers of public order : the case of Estonia

Opis: Purpose: This paper deals with the legal regulation of Estonia’s public order from the aspect of local governments. The purpose of the article is to analyse relevant Estonian legislation to help identify problems and make suggestions for improvement. Proposals are intended for the institutions involved in developing legislation in Estonia. Local governments in the country act according to the Constitution of the Republic of Estonia (1992), but still retain enough legal autonomy to decide on local affairs independently of the state government. Methods: The paper is based on an analysis of national legislation. In the legal research, the author pays attention to written sources of law, e.g. the Constitution of the Republic of Estonia (1992), and subsequent legal acts regulating public order. Findings: The main task of local government is to provide public services and improve the quality of the living environment. In Estonia, the principal provider of internal security is the Police and Border Guard Board. It is the responsibility of local government to assist the national structures in fulfilling their duties. On the other hand, the municipalities are required to ensure public order within their territories. The legal power given by parliament to local governments to carry out such activities is insufficient to ensure the law is enforced. Practical Implications: The findings in this paper highlight areas in which the legal regulation could be improved. Originality/Value: Although the legal basis for Estonian municipalities’ operations has been studied carefully, it is necessary to examine issues concerning the links between local governments and public order in detail. The continually changing legislation makes the situation complex to handle. It also provides an opportunity for international comparative analysis with other European Union member states.

Unemployment and government's subsidizing

Opis: Unemployment has become more and more pressing matter nowadays. Governments all across the world are implementing policies to increase the employment rates back to the levels before the economic downturn. One of the most important policies implemented by countries governments were employment subsidies, which means that companies got government funding when employing and also that private citizens had the possibility for entrepreneurship stimulus packages. The scope of our study was to determine how the gross domestic product and the government's subsidizing on a country's level affect the number of unemployed on a country level. We have conducted the empirical part of our study on the case of Slovenia and found out that gross domestic product has a bigger effect on the number of unemployed than government's subsidies.

Long-term digital preservation in e-government : a case of Slovenia

Opis: The use of information and communication technology and its widespread presence cause a vast amount of data to be created in the public and private sectors every day. The widespread presence of e-government sites, services and communication in the developed world add even more data. This digital data does not only represent the accountability and reliability of the processes, steps and decisions taken by organisations, but also a source of information for future generations. This paper discusses the issue of long-term digital preservation with a special focus on long-term digital preservation in public administration. It analyses problematic issues, current development trends in this area, and principles and solutions that can be found around the world. The paper focuses on Slovenia as one of the EU countries that has most effectively developed its e-government during the last decade. It analyses the situation in Slovenia through legal, organisational and other changes that have appeared over the last few years, and considers this as a model for possible long-term digital preservation. To describe the situation for digital preservation in Slovenian public administration, the results of empirical research made in 2007 are used. The paper uses theoretical background from the field of digital preservation and empirical results to show the important link between e-business, e-government, e-governance and digital preservation. It demonstrates that since Slovenian public administration has strictly specified business processes, the task of implementing digital preservation is much easier. The same concepts can be transferred to the private sector in Slovenia or anywhere else in the world.

Organizational innovation in health care - as a process

Opis: Slovenia, like most countries of the modern world, spends too much on its public health care and supplies too little public health care services for the government, economists, politicians, and citizens to be happy. The many reforms of the public health care, e.g. in Slovenia, seem to be inefficient, one after the other, in solving this problem. Reforms have been conceived with a too poor consideration of the law of the requisite holism in decision preparation, decisions making and decision implementation. The article tackles procedure of implementation of reforms as inventions are supposed to become innovations in the public health care organization and management, rather than reforms' content. Combination of the absorption capacity, innovation promotion and diffusion is suggested for the requisite holism of implementation.

Opis: Bled eConference, organized by University of Maribor, Faculty of Organizational Sciences, has been shaping electronic interactions since 1988 and is celebrating its 30th anniversary in 2017. Bled eConference is the oldest, most traditional and well renowned conference in the field. It attracts speakers and delegates from business, government, information technology providers and universities and is the major venue for researchers working in all aspects of “e”. The theme of this year’s conference is dedicated to “Digital Transformation – From Connecting Things to Transforming Our Lives”. The evolution of digital technologies and solutions (e.g. Internet of things, mobile technology, social media, cloud and high performance computing, artificial intelligence and advanced machine learning, virtual and augmented reality, big data & big data analytics, service architecture, digital technology platforms, 3D printing, robotics etc. …) has significantly impacted on the way how business is conducted and had big implications on our lives. The nowadays digital economy calls for transformation of businesses, governments, education and societies as whole. It also calls for enabling policies and politics for cross border and global digital business. Digital transformation is reflected in the organizations’ ability of comprehensive transformation of business activities, processes, competencies and business models in order to take advantage of digital technologies. Digital technologies require changes in our mind set, culture and functioning and have strategic impact on both the organization itself and its business ecosystems. In this year’s conference, we address various aspects of digital transformation and provide directions and guidelines for organizations to overcome challenges on their way of successful digital transformation. Themes covered in the papers of these proceedings are focused to digital transformation challenges, opportunities and cesses, furthermore to business model innovation, social media and big data analytics implementation, e-health, digital wellness and wellbeing experiences, new applications and organizational models, and novel approaches and cases in education in digital economy.

Local self-government financing and costs of municipality in Slovenia

Opis: This research paper focuses on the compliance of the actual system of financing local self-government in Slovenia with the basic principles of the theory of decentralization and guidelines of the European charter of local self-government. It addresses the level of costs coverage within the municipal competence by using the allocated appropriate expenditure resources calculated according to the Law of financing municipality Act. The purpose of the paper is, therefore, to look for an answer to the question whether and to what extent the obtained funds correspond to the actual workload that municipalities have for performing statutory tasks and for exercising their competences. Analysis shows that, on an aggregate level, these actual systems ensure enough resources for local governments to cover their actual costs and current expenditures; some groups of municipalities, e. g. larger urban municipalities, municipalities with large proportions of elderly people etc. are faced with lack of funding, according to the actual costs data available, while other groups of municipalities receive more funds than they need.

(De)centralization of public procurement at the local level in the EU

Opis: The so-called decentralization of public procurement in EU Member States is accepted as the most suitable design of the public procurement system, often justified by greater economic efficiency and by the possibility of boosting the development of small and medium-sized enterprises, which act on the public procurement market as providers of goods, services and works. Despite the existence of highly decentralized public procurement systems which reflect the decentralization of administrative systems, especially after the recession, there is a stronger tendency for centralization of public procurement in the EU. The so-called aggregation of demand by contracting authorities can be done in order to achieve economies of scale, including lower prices and transaction costs as well as to improve and professionalize the management of procurement procedures (as highlighted in the Directive 2014/24/EU by the European Parliament and the EU Council). However, even in the context of public procurement centralization, local contracting authorities (i.e., public administration authorities and organizations) in Member States should be provided with a sufficiently wide range of possible (centralized) organizational structures and contractual (vertical and horizontal) public-public partnerships which will allow them to select the most suitable and most economically effective organizational structure for the execution of public procurement.

TOWARDS A SUSTAINABLE SYSTEM FOR NON-BUREAUCRATIC GOVERNMENT

Opis: The present doctoral thesis develops a pioneering system for the self-management of jural eligibilities by means of ICTs as the basis for a novel form of government of juropolitical societies. By means of this system we aim to contribute towards a form of government that would not require a dedicated civil service for the creation, storage, change, and deletion of jural eligibilities in the context of the res publica. In the thesis we explore the concept of jural relations as the atomic links of governmental systems, the composition of the jural relations as such, as well as the role of the jural subjectivity as a crucial component for creating complex systems of jural relations that serve as the underlying structures of juropolitical systems. We then walk through the history of the civil service – the bureaucratic machine, as Banfield called it, to understand its role and implications on the course of civilization, up till present time, where we discuss the impacts of ICTs on the development of the bureaucratic machine as such. We argue that the changes which ICTs so far brought to the government sector through what is known as e-government, e-democracy, and e-governance respectively, are based on unsustainable artefacts and hence there are strong reasons for them to be considered more of a burden to future generations, rather than a source of relief. Based on the implications of the so explored context we describe a model for an information system that would enable self-managed creation and determination of jural eligibilities, and thus self-managed government of juropolitical societies as such. We call this model Sustainable Non-Bureaucratic Government (SNBG). SNBG bases on a network of electronic registries, which store jural facts, from which eligibilities can be derived through a dedicated mechanism, which we call constellation-based reasoning (CBR). CBR bases on a purposely developed fine-grained data access control mechanism, which does not rely on predefined accessor roles, but dynamically enables / disables access to data based on the context of the request and the context of the data stored in the accessed registry. As such, CBR is purposely designed to support changing the rules of access to the stored data by means of collaborative decision making, as such is required in the political legislative context, whereby the rules that regulate such decision making, are again governed by the very same system, which ensures full flexibility of the SNBG system to fluidly undergo at design-time unpredictable transitions that would happen through time. This feature amongst others then, assures the system’s sustainability. We describe the architecture and the stakeholders of SNBG, as well as auxiliary constructs for planning and communicating regulations which make-up the CBR rules. We define the functional characteristics that instances of the electronic registries must satisfy in order to assure sustainability and to be applicable in the juropolitical context in accordance with core jural principles (and in order to avoid the mistakes as conducted in the course of development of e-government artefacts). Then, we describe the instantiation of a prototype SNBG system, i.e. the instantiation of a respective electronic registry that provides CBR-based access to the underlying data stored in a relational database. We evaluate this prototype instantiation based on three demo applications, which prove its technical feasibility in different scenarios. Finally, we evaluate the SNBG model in four different real-world scenarios to argue for its feasibility in crucial governance situations.
