SPREMINJANJE JAVNE UPRAVE

Opis: Javna uprava predstavlja pomemben del javnega sektorja, katerega delovanje močno vpliva na celotno družbeno in gospodarsko delovanje neke države. Tradicionalno je bilo njeno upravljanje birokratsko, zaprto, neprilagodljivo. Z procesom globalizacije se je trg izrazito spremenil — kapital, industrija, osebe, znanje in tehnologija lažje kot kadar prej prečkajo meje držav. Na spremembe trgov ni bila imuna niti javna uprava. Smisel in namen javne uprave je v zadovoljevanju javnih potreb ter v primerni podpori in nadzoru gospodarstva. Z namenom uresničevanja svoje namembnosti v novih pogojih delovanja se je moralo njeno delovanje izrazito spremeniti. Spremembe delovanja javnih uprav potekajo v globalnem smislu preko različnih reform. Pri tem so državam v pomoč različni razviti koncepti spreminjanja, med katerimi ima največjo vlogo koncept novega upravljanja javnega sektorja. Spreminjanje javne uprave je proces, ki ga ni možno zaključiti na določen dan. Gre za kontinuiran proces uvajanja postopnih sprememb. Korupcija, slaba kadrovska politika, vladni interesi so le nekateri izmed najbolj pogostih problematičnih dejavnikov, ki otežujejo spreminjanje. Z namenom izmenjave izkušenj, uvajanja skupnih smernic razvoja in predstavljanja dobrih praks s področja javne uprave se države povezujejo v različna združenja. Dodatno usmeritev pridobivajo iz mednarodnih organizacij kot sta Organizacija za gospodarsko sodelovanje in razvoj (OECD) in Svetovna trgovinska organizacija (WTO). Preoblikovanje slovenske javne uprave pospešeno poteka od leta 2006. Največji dejavnik, poleg globalizacijskih procesov in doseganja gospodarske konkurenčnosti države, ki je vplival na potrebo po spremembi delovanja slovenske javne prave so začetna pogajanja Slovenije za vstop v Evropsko Unijo. EU na delovanje javnih uprav svojih držav članic vpliva z različnimi smernicami razvoja in skupnimi določili. Pri preoblikovanju je Slovenija morala upoštevati tako načela EU, kot tudi lastne značilnosti javno upravne ureditve. Slovenija se uvršča med države z najbolj razvitimi pristopi spreminjanja javne uprave. Na področju elektronskega delovanja sodimo celo med najboljše. Vendar pa je trenutno stanje daleč od ciljnega. V prihodnosti lahko pričakujemo večje spremembe na področju upoštevanja uporabnikov javnih storitev, izobraževanja in informiranja zaposlenih, ločevanja stroke od vladnih interesov, večje avtonomnosti in postopno decentralizacijo javno upravnih ureditev.

J. R. R. TOLKIEN'S THE SILMARILLION: GOOD VS. EVIL

Opis: The question of morality in Tolkien’s Silmarillion is a very important part of its theme in the conflict of good vs. evil. Characters are analyzed and classified according to their good or evil nature, as well as intentions and reasons for their thoughts, words and deeds. The method of analysis of imagery and symbolism was used to show the ways the good and evil manifest itself. Mythical qualities of Tolkien’s work are explained as well.

AN ANALYSIS OF THE INQUIRY INTO VALUES IN ZEN AND THE ART OF MOTORCYCLE MAINTENANCE

Opis: It is rare to come across a novel so complex where language moves in waves from pure poetry to cold hard scientific talk, then again carries the reader into a small hot town feeling the fatigue connected to the Socratic dialogues and Plato’s rich imagery, all serving no other purpose, but constantly keeping the reader alert and gently preparing his mind for another philosophical lecture. This carefully planned construction is fundamental for tearing down the Aristotelian cornerstones of modern life and returning the reader’s mind to the times when answers were sought in the wind and Ideas resided in the unknown. Quality, as an event that causes subject and object, would otherwise again be rejected and misunderstood, which poses the threat of the narrator, Phaedrus, being admitted to the mental asylum once more. This time around the message comes through with the use of three safety nets in the form of three levels of understanding of the plot. It is up to the reader’s ability whether to settle for the obvious mental patient scenario, uncover the curtain to see the distrustful Hamlet playing with everyone, or recognize the true philosopher’s lecture on reality filled with concrete guidance on how to see errors and mistakes in our everyday life. They lead to a gumption trap that first needs to be recognised and then, following the example of Stoics, the narrator provides advice and solutions how to free ourselves from it. Making my way through the jungle of my mind in search of the source of reality, I found my own fountain of life and death drawn on a scallop shell by listening to the wind and looking for the answer in Nature. The scallop shell is like our universe, filled with pearl coating of Good and on the surface its lines of life and death like sunrays rise to aretê and realisation, then descending to primary entities that build all that exists. The unifying force behind this movement also resides in everything that it creates, filling a thing with mind that connects its material body to all the other bodies there are.

ORGANIZACIJSKA KLIMA IN ZADOVOLJSTVO ZAPOSLENIH V PODJETJU

Opis: V zadnjem času, predvsem v zadnjih letih, ko je gospodarska kriza močno pokazala svoje zobe in postavila podjetja pred nove izzive, so se le-ta še bolj začela zavedati pomembnosti organizacijske klime in zadovoljstva zaposlenih na njihovem delovnem mestu. Zaposleni danes namreč predstavljajo veliko konkurenčno prednost podjetja, njegovo uspešnost in odličnost. Tako organizacijska klima kot tudi zadovoljstvo zaposlenih sta dejavnika, ki sta kvantitativno merljiva, omogočata hitre odgovore in enostavno ter učinkovito analizo. Obstajajo številni vprašalniki, ki nam lahko dajo odgovore, ali so zaposleni zadovoljni, motivirani, dobro plačani in nagrajeni, ali v podjetju vladajo dobri odnosi med sodelavci (tudi v odnosu delavec – nadrejeni), ali je pretok informacij dober, ali je dober sistem nagrajevanja in podobno. Priporočljivo je, da se organizacijsko klimo in zadovoljstvo zaposlenih meri vsaj enkrat letno, kajti le tako vodstvo razpolaga z ažurnimi informacijami, ki jim omogočajo, da se pravočasno in pravilno odziva in ustrezno ukrepa. V magistrski nalogi je obravnavana tema Organizacijska klima in zadovoljstvo zaposlenih v podjetju Era Good, d. o. o. Naloga je sestavljena iz teoretičnega in praktičnega dela. V prvem delu je na splošno predstavljena organizacijska klima in zadovoljstvo zaposlenih. V drugem delu pa smo z anketnim vprašalnikom ter njegovo analizo in s pridobljenimi rezultati ugotovili, da je organizacijska klima in zadovoljstvo zaposlenih ocenjena dokaj visoko. Podjetje bi lahko z večjo angažiranostjo in pozornostjo stanje še izboljšalo, tudi s pomočjo predlogov, ki so napisani na koncu tega magistrskega dela.

The relationship between delay in announcing quaterly forecasts of annual earnings and the type of earnings news

Opis: The current study aims to examine the relationship between delay in the announcement of quarterly forecasts of annual earnings and the type of earnings news in a unique context. Running a multiple linear regression on data collected from Rahavard Novin software and the companies’ financial statements, is the method of this study to investigate this relationship. Consistent with the pattern of good news early, bad news late, it was found that there is a positive relationship between the bad news type and the amount of delay in announcing quarterly forecast of annual earnings; so that the firms with negative adjustments in earnings forecast (bad news), on average, have 12 more days delay in the announcement. Considering other variables showed that as coverage percentage - a sign of success - increases, the amount of delay in announcing earnings forecast decreases, but companies with losses per share, on average, have an additional delay of about 6 days. The results obtained indicate that at least, in some industries there is certain time for reporting. Finally, it became clear that in the period after the adoption of the new disclosure instruction, despite the increased deadline, the amount of delay in earnings announcement has declined by about 2 days. In this study, for the first time in Iran, one of the company’s financial news (quarterly forecasts of annual earnings), have been classified into good and bad, based on comparison with the market expectation, and the relationship between the news type and the amount of delay in announcing the news, has been examined.

The criminal offense of abuse of position or trust in business activity and the limits of free economic initiative

Opis: The criminal offense of abuse of position or trust in business activity within the meaning of the Slovenian Criminal Code is the most common criminal offense against the economy. To adequately assess such an offense it is essential to clarify at the very beginning of the criminal proceedings that all preliminary questions have their origin in the field of civil, corporative and commercial law. In other words, the difficulty of problem solving for such cases in later stages of the process only intensifies, as the decision-making process becomes more and more difficult and can cause delays. And even in cases where the facts are undisputed, the whole issue concentrates primarily around the dispute regarding the issue of material criminal law. The purpose of this paper is to present the above mentioned issues, firstly from a more theoretical perspective on freedom of economic (business) initiative in a postmodern era, followed by a presentation of the criminal law subsystem dealing also with phenomena from the economic subsystem, and lastly by a presentation of the Slovenian Criminal Code in regards to prosecution and adjudication of economic crimes and its difficulties, specifically by using the example of the above mentioned offense.
