The cross-border enforcement of court settlements within Brussels Ia Regulation

Opis: Despite the enormous practical relevance of court settlements, the Brussels Ia Regulation contains only a few explicit provisions for the cross-border enforcement of this legal instrument. This can cause difficulties in borderline cases, for example when it is doubtful whether the legal act in question is to be classified as a settlement or a judgment or which specific European regulation is applicable to a settlement containing several different claims. This paper provides a general overview of the rules for the enforcement of court settlements under the Brussels Ia Regulation and examines some problems that may specifically arise in the case of cross-border enforcement of court settlements.

Private policing in the former Yugoslavia

Opis: Purpose: This paper aims to give an empirical overview of the ‘privatization’ of security (or, in a more narrow sense, policing) services within the former countries of the Socialist Federal Republic of Yugoslavia namely, Slovenia, Croatia, Serbia, Kosovo, Bosnia-Herzegovina, Macedonia and Montenegro. Observations are put in light of the extant literature on private policing worldwide. Design/Methods/Approach: The paper draws on a literature review of academic publications, NGO-reports and other relevant written sources. Findings: Although it is not possible to offer a full picture of the current developments in the region, we argue that the rise of private security markets shows significant variety throughout former Yugoslavian countries, as does the level of state regulation. Moreover, contrary to the views of doomsayers critical of the provision of commercial security, academics and observers alike are optimistic about private security personnel becoming a legitimate and stabilizing presence in post-conflict zones such as the Balkans. Research implications: The persistence of divergence in private policing trajectories within the former Yugoslavia underscores the need for more detailed cross-national studies that take account of differences, as well as similarities, in how commercial security industries are governed and regulated by state institutions. Practical implications: Public as well as private policy-makers in the field of security serve as appropriate anchor points to facilitate, direct and regulate private policing activities across the former Yugoslav republics. Originality/Value: The growing body of knowledge on private policing is heavily suffused by predominantly North American, Canadian, British and Australian studies. Nonetheless, research from countries outside the English speaking world has much to contribute to an understanding of private security industries. An examination of the Balkan countries that emerged from the breakup of Yugoslavia is particularly interesting when viewed as a post-conflict legacy.

Cross-platform Sense Glove Communications

Opis: In this thesis, we have redesigned the communication protocol for the Sense Glove device, so it works on all major operating systems. This opened new ways to develop applications, which use the device and also increased the interest of developers, who use the operating systems on which the development was not possible before. The device has many use cases, such as Virtual Reality training and different kinds of simulations. We have used open-source wxWidgets and Boost libraries to help us mostly with creating a graphical user interface and the serial/bluetooth communication with the Sense Glove device.

Patient safety in cross-border care

Opis: Patient safety is a right and it raises particular issues in the context of cross-border care. Patients should be able to have trust and confidence in the healthcare structure as a whole; they must be protected from the harm caused by poorly functioning health systems, medical errors and adverse events. This paper addresses the state of cross-border healthcare in the European Union, the state of patient safety, the question of quality assurance and the role of accreditation as a risk based approach.

Comparative analysis of ART in the EU

Opis: The need for cross-border reproductive medicine exists for several reasons. Some are due to the fact that some states do not permit particular ART procedures; thus couples travel to the state where needed procedure is allowed (surrogate motherhood, embryo donation, posthumous fertilization). Other situations are due to the fact of who is entitled to ART procedures. In some states ART procedures are not allowed to same-sex couples or a single woman. The consequence of the cross-border reproductive medicine might be that the born child becomes parentless (“limping legal parentage”) and stateless. Since the best interest of the child is the paramount principle in contemporary family law, it is most important to find solutions for these situations. The most complicated issues are the consequences arising from international surrogacy arrangements. The Hague Conference on private international law is working on these issues trying to find the best solutions.

Characteristics of Austrian remedies against enforcement and a general analysis of their suitability for achieving the objectives of Brussels I recast

Opis: Regulation No 1215/2012 (Brussels Ia or Brussels I Recast) was another big step forward towards the establishment of a genuine European judicial area. In the wake of the Brussels I Recast, two facts have rather soon become apparent: One, several well- known (or better: infamous) issues are sadly still unsolved. And two, some other issues have emerged. Because of the abolishment of the “exequatur procedure”, esp. the issue of remedies against enforcement, in both the Member State of origin as well as in the Member State of enforcement, has gained more importance again. Therefore this paper analysis the characteristics of Austrian remedies in enforcement and their suitability for achieving the objects of Brussels I Recast.

Some observations regarding cross-border debt collection in consumer disputes

Opis: Cross-border debt collection in consumer dispute leads to many difficulties. The main one is the access to justice as consumers are generally not aware of their rights and legal proceedings may be expensive. The major difficulty in order to sue a counterpart based in another Member States is the determination of the competent court. However, this private international law issue is the first step in order to bring a legal action. This action may be disproportionate, on time and value, in comparison with the amount of the debt a consumer wants to recover. As a result, the European Commission has adopted the Directive 2008/52/EC on certain aspects of mediation in civil and commercial matters which aims at facilitating cross-border disputes involving consumers. After recalling the main characteristics of the Directive, author also discusses online mediation, that can also lead to more effective results.

Estimating piping potential in earth dams and levees using generalized neural networks

Opis: Internal erosion and piping in embankments and their foundations is the main cause of failures and accidents to embankment dams. To estimate the risks of dam failure phenomenon, it is necessary to understand this phenomenon and to develop scientifically derived analytical models that are simpler, easier to implement, and more accurate than traditional methods for evaluation of piping potential. In this study, a generalized regression neural network (GRNN) technique has been applied for the assessment of piping potential, as well, due to its ability to fit complex nonlinear models. The performance of GRNN has been cross validated using the k-fold cross validation method technique. The GRNN model is found to have very good predictive ability and is expected to be very reliable for evaluation of piping potential.

Strategy of cross curricular connection at technology education as a factor of modern school

Opis: This contribution deals with the topic of inter-subject planning and connecting in technique and technology and as a factor of modern school by emphasizing the strategies of training-educational work in technique and technology. In this context the most suitable project task is being regarded as that strategy of training-educational work, in which the development of divergent thinking, creative compatibilities, acquiring, deepening, practicing and using the knowledge in the field of technique, technology, work organization, economics, ergonomics, ecology, informatics and computer science, industrial design, etc. is concerned. In such a constructed strategy the inter-subject planning and connecting can be represented and the tendency to acquire better knowledge can also be realized, because of the opinion of the constructivists who think that knowledge in its final form can neither be "given " to somebody else, nor it can be "accepted" by somebody else, but it should be rebuilt by everybody with his/her own mental activity and exactly in technique and technology the objective and subjective conditions for such a style and didactic system of training - educational work are being created.
