Legal characteristics of a maximum mortgage with an analysis of the latest case law

Opis: The article examines the legal nature and transferability of the maximum mortgage under the Slovenian Law of Property Code (Stvarnopravni zakonik or in abbreviation SPZ), focusing on Article 146(4) and its interpretation in case law and theory. It first recalls the accessory nature of liens, which normally follow the secured claim as to creation, scope, transfer and extinction. Against this background, it shows how the maximum mortgage was designed to secure fluctuating or future claims arising from an ongoing creditor–debtor relationship, up to a registered ceiling amount. The authors reconstruct the prevailing Slovenian view that, in the case of a maximum mortgage, the accessory link exists not between individual claims and the mortgage but between the business relationship and the maximum mortgage as a protective right in rem. They contrast this functional understanding with the literal wording of Article 146(4) SPZ, which excludes the transfer of the mortgage when a secured claim is assigned, and with the conservative approach of the Supreme Court. According to its case law, an assigned claim secured by a maximum mortgage is transferred without security, which reduces its market value and narrows the practical usefulness of this instrument. Using German and Austrian law as key comparators, the article argues that the Slovenian solution is unnecessarily rigid and departs from models that allow, under certain conditions, the transfer or transformation of a maximum mortgage into a fixed mortgage when claims are assigned or when the credit relationship is reduced to a single outstanding claim. The authors endorse the more recent doctrinal position and the approach taken by the Higher Court of Ljubljana, under which individual “sub-mortgages” arise within the maximum mortgage and accompany the assigned claim to the new creditor, creating a community of mortgagees governed by general rules of the Obligations Code. The general view that a maximum mortgage is more flexible than a fixed mortgage is, in the Slovenian context, undermined by the current statutory wording and restrictive case law, which call for a systemic and functional reinterpretation of Article 146 SPZ – or, failing that, for legislative reform.

Generalized symmetries, gravity, and the swampland

Opis: Generalized global symmetries are a common feature of many quantum field theories decoupled from gravity. By contrast, in quantum gravity/the Swampland program, it is widely expected that all global symmetries are either gauged or broken, and this breaking is in turn related to the expected completeness of the spectrum of charged states in quantum gravity. We investigate the fate of such symmetries in the context of 7D and 5D vacua realized by compact Calabi-Yau spaces with localized singularities in M theory. We explicitly show how gravitational backgrounds support additional dynamical degrees of freedom which trivialize (i.e., “break”) the higher symmetries of the local geometric models. Local compatibility conditions across these different sectors lead to gluing conditions for gauging higher-form and (in the 5D case) higher-group symmetries. This also leads to a preferred global structure of the gauge group and higher-form gauge symmetries. In cases based on a genus-one fibered Calabi-Yau space, we also get an F-theory model in one higher dimension with corresponding constraints on the global form of the gauge group.

Generating test cases for automotive requirement testingusing rag : magistrsko delo

Opis: The automotive industry is increasingly confronted with challenges in managing complex requirements and test cases arising from the integration of advanced electronic systems, software functionalities, and compliance with international standards. Conventional manual validation of requirements is time-consuming, error-prone, and resource-intensive, underscoring the need for more efficient and reliable approaches. This thesis investigates the automation of test case generation through the application of Retrieval-Augmented Generation (RAG) in combination with Large Language Models (LLMs). A complete RAG workflow was implemented in Python, incorporating LangChain, LangGraph, Ollama, and ChromaDB to facilitate indexing, retrieval, and generation. The system was trained and evaluated on datasets comprising automotive requirements and test cases, with experiments examining embedding quality, retrieval strategies, prompt engineering techniques, and generative model parameters. The results demonstrate that RAG is capable of generating high-quality, contextually relevant test cases on consumer-grade hardware, thereby significantly enhancing efficiency, consistency, and productivity relative to manual methods. Furthermore, the findings suggest that RAG-based systems are best positioned as complementary tools that support, rather than replace, human engineers. This research provides a foundation for future work on hybrid retrieval methods, advanced embedding techniques, and the integration of more powerful LLMs into requirement and test case management processes.

How multicriteria environmental assessment alters sustainability rankings : case study of hempcrete and prefabricated walls

Opis: The construction sector emphasises circular economy principles that prioritise eco-design strategies, particularly the usage of secondary raw materials. The growing interest in using industrial hemp as a sustainable building material in the construction sector is driven by its versatility. Industrial hemp has been preferential in comparison to other traditional building materials due to its lower global warming impact. Claims regarding the environmental benefits of hemp-containing construction materials based on the single impact category could be misleading; therefore, life cycle assessment (LCA) studies including multiple environmental indicators should be implemented. This study aims to compare two alternative wall designs regarding their environmental impacts. The comparative LCA study for hempcrete and prefabricated walls used in residential buildings was assessed using IPCC and ReCiPe life cycle impact assessment methods. The study highlighted a significant discrepancy depending on the number of environmental indicators considered, as well as between characterised and weighted LCA results. A hempcrete wall was recognised as a slightly (13.63%) better alternative when assessed by the single-issue IPCC method, while its total burden assessed by the ReCiPe method was recognised to be significantly (2.78 times) higher. Based on the results from this case study, regulators could re-evaluate the appropriateness of reporting LCA results solely on the midpoint level, particularly when limited to a single impact indicator, while producers in the construction sector should recognise the threat of greenwashing when reporting using a single impact indicator only.

Aligning business solutions and business requirements for digital transformation – case research : V.

Opis: This study explores how Business and IT Alignment (BITA) influences business performance (PERFO) and corporate sustainability (SPACS) using a mixed-methods case study of an international manufacturing enterprise. The quantitative analysis (PLS-SEM) indicated BITA affects PERFO indirectly through IT service quality (ITSQ), while remote work (EWORK), despite its relation to BITA, showed no significant impact. BITA strongly predicted SPACS by enhancing employees’ sustainability knowledge, confidence, and willingness to act. Qualitative findings from semi-structured interviews revealed a BITA maturity of 3.3 (on a 5-point scale), highlighting its role in sustainability via better decision-making, process optimization, and IT-enabled transparency. Notable discrepancies between managerial and employee perceptions of BITA maturity were identified. Results suggest successful BITA fosters sustainability-oriented behaviour and IT-driven performance improvements, though continuous reinforcement within organizations is required. The study emphasizes the value of integrating qualitative and quantitative methods for comprehensive insights into BITA's impact.

Reproductive rights : a comparative analysis of abortion regulations and the case of reform in the republic of Benin

Opis: Induced abortion remains controversial due to traditional, moral, political, and religious reasons. Although the common opinion about the illegality of abortion is indicated in medical conditions, its regulation varies widely according to the country. Abortion is available to women on request in many countries, while in others, there is restriction or prohibition altogether. In the contest when some countries end the nationwide right to abortion, the Republic of Benin in 2020 broadened the social grounds, allowing abortion up to 12 weeks of gestational age. This paper aims to overview abortion legislation in selected countries and to compare them to the reform in the Republic of Benin, which became one of the several African countries broadly permitting abortion within 12 weeks of amenorrhea.

Exploring digital transformation journey among micro, small-, and medium-sized enterprises

Opis: This paper aims to explore the patterns in micro, small-, and medium-sized enterprises’ (MSMEs) digital transformation journey during recent years. Using an emergent concurrent mixed-methods approach, we combined insights from six in-depth interviews with MSME managers and owners with survey data from 66 MSMEs. The findings reveal major inhibitors and accelerators of MSMEs’ digital transformation and demonstrate how they cope with them by engaging in digitalisation actions. This study also provides insights into how inhibitors, accelerators, and digitalisation actions vary across MSME sizes. While an increased adoption of digital technology was observed among the participating MSMEs, this study identifies three distinct digital transformation paths: necessary, experimental, and committed. Each path is shaped by a unique combination of inhibitors and accelerators. From the practical perspective, this research provides insights for MSME managers and owners on how to tailor their digital transformation efforts to their unique inhibitors and accelerators. In addition, our insights can help policy makers to promote the digital transformation of MSMEs through appropriate measures and support mechanisms tailored to the specific needs of smaller enterprises.

Is it high time to redefine the legal framework on cohabitation in family law?

Opis: Cohabitation is an institution of Slovenian family law quite similar in effect to marriage in that it creates the same rights and obligations. However, unlike marriage, its existence must be proved in each individual proceeding separately which creates difficulties, particularly in practice. This situation is exacerbated by the fact that the existence of cohabitation in the Slovenian Family Code is defined exclusively using rather vaguely defined legal standards. In this article, the author gives an overview of the current relevant case-law of Slovenian courts on cohabitation and discusses the possibilities for future legal regulation of the establishment of this community.

Case method learning for improving critical thinking skills among elementary school students

Opis: This study aimed to analyse students' critical thinking profiles and assess teachers' needs for case method learning to improve critical thinking skills. The research method used was qualitative. The study's results reveal that most students' mastered critical thinking skills profiles are indicators of reveals existing facts and drawing conclusions. However, indicators that students have not fully mastered critical thinking are formulating the key issues, selecting logical arguments, conducting analysis, and conducting evaluations. As a result, teachers require a learning method, precisely the case method, to encourage critical thinking skills.

Characteristics of an outstanding musical talent : a case study

Opis: The purpose of this study is to investigate the expression of thirty-two characteristics of a musically talented person in various life periods (from three to thirty-five years of age), in a case study of an internationally renowned musician and organist, Aleksey Vylegzhanin. The results show that the expression of the characteristics of his musical talent increased with age. With enough rehearsal and support from the environmental factor, his characteristics increased to a level above average, compared to his peers. These were also predispositions for the musical development of the organ virtuoso.
