Varstvo podatkov in pravice potrošnikov v digitalnem marketingu

Opis: Magistrska naloga raziskuje varstvo osebnih podatkov in pravice potrošnikov v kontekstu digitalnega trženja, področja, kjer hitra rast spletnih storitev in obdelava osebnih podatkov postavljata zasebnost v ospredje razprav. V teoretičnem delu smo analizirali ključne evropske zakonodajne akte – Splošno uredbo o varstvu podatkov (GDPR), Zakon o digitalnih storitvah (DSA), Zakon o digitalnih trgih (DMA), Zakon o upravljanju podatkov (DGA) in Zakon o podatkih (Data Act), ki skupaj predstavljajo temelje za pregledno, odgovorno in pošteno obravnavo osebnih podatkov v digitalnem okolju. Empirični del temelji na anketi med 108 potrošniki in se osredotoča na njihovo ozaveščenost o pravicah, izkušnje s kršitvami ter odnos do obdelave osebnih podatkov. Rezultati kažejo, da potrošniki poznajo predvsem osnovne vidike GDPR, medtem ko novejši akti in celoten nabor pravic ostajajo večini neznani. Zakonodajo pogosto zaznavajo kot zapleteno, kar zmanjšuje njihovo pripravljenost na ukrepanje ob kršitvah. Večina se ob zaznanih nepravilnostih ne odloči za formalno pravno varstvo, saj jim primanjkuje jasnih informacij, zaupanja v učinkovitost sistema ali občutijo, da situacija ni dovolj resna. Kljub temu raziskava potrjuje, da zasebnost ni zgolj formalno zapisana v zakonodaji, temveč jo potrošniki razumejo kot ključen element zaupanja v digitalno okolje. Pogosto se odločijo, da določenih storitev ne bodo uporabljali, kadar menijo, da podjetja preveč posegajo v njihove osebne podatke. To nakazuje, da so potrošniki zasebnost pripravljeni braniti tudi z lastnimi odločitvami, čeprav redko ukrepajo po formalnih pravnih poteh. Naloga tako pokaže, da je evropski zakonodajni okvir sicer obsežen in napreden, a njegova učinkovitost v praksi ostaja omejena zaradi nizke ravni ozaveščenosti, nepreglednosti pravil in pomanjkanja enostavnih mehanizmov za uveljavljanje pravic. Potrošniki ob tem jasno izražajo pričakovanja po večji preglednosti, strožjem izvrševanju zakonodaje ter širšem ozaveščanju in izobraževanju. Magistrsko delo zato poudarja potrebo po celovitem pristopu, ki združuje pravne, regulatorne in izobraževalne ukrepe ter zagotavlja ravnovesje med razvojem digitalnega marketinga in zaščito temeljnih pravic posameznika.

Some comments on the legal regulation on misinformation and cyber attacks conducted through online platforms

Opis: What are the tools to effectively manage the new threats to the free flow of opinions to protect this essential precondition for a pluralist social and political system? As a basis for action at the community level, how can we protect users who use internet platforms to inform themselves on issues of public interest from disinformation attacks through cyberspace? Effective action against cyber-attacks that adversely affect certain fundamental rights requires a combination of instruments, creating the technological, economic, human and legal conditions for meaningful counter-measures. In legal terms, the guarantees that platform providers must offer each user to prevent cyber attacks and illegal content should be laid down, and legal instruments shou ld be put in place to ensure they are always available. In addition, in the event of misusing any content shared on the platform or of personal data made available to the operator, clear responsibilities should be established, and the extent to which the responsibility for protection lies with the platform operator or the user should be clarified. In our study, we outline regulatory options to address these challenges.

Targeted advertising and the (children's) right to privacy - remedies of ex-ante and ex-post regulation

Opis: This paper analyses how instruments of economic regulation can be used to protect the right to the protection of personal data, especially in relation to vulnerable societal groups, such as children. In this regard, it analyses the Bundeskartellamt’s Facebook decision that established an unprecedented connection between competition law and data protection law, as well as the Digital Markets Act, which imposes several positive and negative obligations on companies branded as “gatekeepers,” which could also increase the level of personal data protection. It is concluded that instruments of economic regulation can have a profound impact on data protection issues, although addressing them is not their primary goal.

Generative AI in pragmatics : assessing the accuracy of automated speech act classification in Pinter’s The birthday party

Opis: This study explores the feasibility of using generative AI (ChatGPT, Gemini, and DeepSeek) to automate speech act annotation in Harold Pinter’s play The Birthday Party. Three chatbots – ChatGPT, Gemini, and DeepSeek – were tested under three scenarios varying in the amount of theoretical material provided. Each chatbot’s output was compared to a manually annotated reference via a Python script measuring classification accuracy. Scenario 2 produced the highest accuracy overall (75–82%), while Scenario 1 underperformed, owing to incorrect reliance on external typologies, and Scenario 3 showed signs of overfitting. ChatGPT o1 emerged as the most accurate model, achieving 82% accuracy in Scenario 2. The findings suggest that GenAI chatbots can serve as valuable preliminary annotators when good prompt-engineering and well-curated theoretical material are provided. Future research could extend this methodology to more context-dependent texts, further refining prompt-engineering strategies and exploring larger linguistic corpora.Študija raziskuje smiselnost rabe generativne umetne inteligence (ChatGPT, Gemini in DeepSeek) za avtomatizacijo anotacije govornih dejanj v Pinterjevi drami Zabava za rojstni dan. Trije klepetalni roboti – ChatGPT, Gemini in DeepSeek – so bili testirani v treh scenarijih, ki so se razlikovali glede na obseg predloženega teoretičnega gradiva. Rezultati vsakega klepetalnega robota so bili primerjani z ročno anotirano različico s pomočjo Python skripte, ki je izmerila natančnost klasifikacije. Scenarij 2 je na splošno dosegel najvišjo natančnost (75–82 %), medtem ko je bil scenarij 1 zaradi neustreznega zanašanja na tuje tipologije preslab, scenarij 3 pa je kazal znake preprileganja (angl. overfitting). ChatGPT o1 se je izkazal za najnatančnejši model, saj je v scenariju 2 dosegel 82-odstotno zanesljivost. Ugotovitve kažejo, da lahko klepetalni roboti GEN-UI služijo kot koristni predhodni anotatorji, če so na voljo dobro zasnovani pozivi in dobro pripravljeno teoretično gradivo. Prihodnje raziskave bi lahko to metodologijo razširile na besedila, ki so bolj odvisna od konteksta, nadalje izpopolnile strategije inženiringa pozivov in raziskale večje jezikovne korpuse.

Vaccines immunize people; legislation immunizes vaccine manufacturers. Legislation in the United States Regulating liability for the manufacture, distribution and administration of vaccines

Opis: Infectious diseases have caused widespread misery, and have wreaked havoc physically, mentally, economically, politically, and socially. Fortunately, in more recent years, scientists have developed vaccines. Vaccines are generally very safe, but cause side effects in a small percentage of cases. The United States Congress has passed two major pieces of legislation that provide sweeping tort immunity to vaccine manufacturers and others. In 1986 Congress passed the National Childhood Vaccine Injury Act (NCVIA) and in 2005 it passed the Public Readiness and Emergency Preparedness Act (PREP ACT). Both Acts were passed to encourage manufacturers to develop vaccines, particularly in times of public emergencies, in exchange for expansive liability protection. Both Acts established no-fault type compensation schemes to compensate those suffering injury or death from vaccines without having to resort to typical litigation. The author discusses both Acts in detail, in the context of the current Covid-19 crisis.

The (un)constitutionality of the financial investigation as provided by the Financial Administration Act – a case study

Opis: Purpose: The article provides an in-depth analysis of the regulation of financial investigations under the Financial Administration Act (“Zakon o finančni upravi (ZFU)”, 2014) and the manner of implementing the regulatory framework of this instrument in Slovenia. It presents the conditions for the initiation of a financial investigation, along with the competence and authorisations of investigators, the status of a person under investigation, and the procedure and conclusion of a financial investigation. In the article we take the position that either the existing regulatory framework or the manner in which the regulatory framework of financial investigation is implemented is unconstitutional. Design/Methods/Approach: We applied the normative method, the analysis and synthesis method, and a case study. Findings: We claim that Article 100 of the “ZFU” (2014), which governs financial investigations, is not compliant with the Constitution or the manner in which this provision is implemented by the Financial Administration of the Republic of Slovenia, which also has support in courts’ decisions. The Financial Administration, the Administrative Court and courts of general jurisdiction interpret and implement Article 100 of the “ZFU”, in the section relating to the moment in which a financial investigation is completed and tax inspection proceedings begin, in a way that is not compliant with the explanation by the Constitutional Court of the Republic of Slovenia in decision No. U-I-69/22-4. Research Limitations/Implications: The research does not include a comparative analysis, i.e., an analysis of the regulation and practice of conducting financial investigations pertaining to infringements of tax regulations in other countries.

PALETIRANJE IN PREIZKUŠANJE ZLEPNEGA SPOJA NA UMS2 : diplomsko delo

Opis: V diplomskem delu je predstavljena dodelava obstoječega montažnega stroja UMS2, ki je produkt podjetja Vivapen d. o. o. Gre za napravo, ki preizkuša zlepni spoj med notranjo in zunanjo pušo ustnikov ter njihovo nadaljnjo manipulacijo v namenske zalogovnike. Opisana sta mehanski in električno-pnevmatski postopek načrtovanja stroja od ideje do končnega izdelka z vsemi pripadajočimi zahtevami in omejitvami. Diplomsko delo zajema modeliranje v SolidWorks-u, projektiranje električnih in pnevmatskih načrtov ter pisanje programa krmilnika v programskem okolju CyPro v povezavi z linijskim servo pogonom SMC. Na podlagi uspešno opravljene analize dobrih kosov, ki so produkt tega diplomskega dela, se je stroj aktivno vključil v proizvodnjo.

Analysis of the legal aspects of illegal asset recovery in Slovenia

Opis: Purpose: The aim of the study was to analyse the legal aspects of asset recovery in Slovenia through a five-stage asset-recovery process: financial investigation; freezing or seizure of assets; confiscation; enforcement of the confiscation order; and asset disposal. Design/Methods/Approach: EU and Slovenian legislation in the area of illegal asset recovery was analysed and compared. Using legal analysis, gaps and inconsistences were discovered and discussed. Findings: The Slovenian legal order provides relevant bodies with several avenues to recover ‘proceeds’ and illegally acquired assets. There is the traditional confiscation of proceeds, in personam confiscation in criminal proceedings, extended confiscation in criminal proceedings, and civil forfeiture pursuant to the Forfeiture of Assets of Illegal Origin Act. One problem is the related provisions are dispersed across both substantive and procedural law. Another problem is that some provisions are formulated in such a way that makes them impossible to apply in practice. It would be necessary to introduce a category of financial investigation in criminal proceedings. It is inappropriate that financial investigations are carried out under the provisions of civil law. Financial investigation must, therefore, become an essential part of all police criminal investigations of relevant offences, and holds the potential to generate proceeds. However, at the same time, law enforcement authorities must obtain a clear mandate that in the particular conditions they may investigate all assets of a suspect and not simply the concrete proceeds of crime. Practical Implications: The study findings are useful for preparing systemic changes in relation to the seizure of assets of illegal origin, also because the changes can be used to help establish an efficient way of organising the work of state bodies in this area. Originality/Value: The purpose of the paper is to comprehensively analyse all aspects of the seizure of assets of illegal origin. The results of the analysis substantially complement existing knowledge in the analysed field.

The Impact of the EU General Data Protection Regulation (GDPR) on mobile devices

Opis: Purpose: The purpose of this paper is to examine novelties introduced by the European Regulation (2016/679) on the Protection of Natural Persons with Regard to the Processing of Personal Data (GDPR) and its key impacts on mobile device users. The paper also presents some of the main changes affecting both natural persons and legal entities. Further, certain issues that might occur while implementing the Regulation are raised together with the degree of individuals’ awareness of the need to protect the personal data stored on their mobile devices. Design/Methods/Approach: For the purpose of this paper, we reviewed the legislation, Slovenian and international literature, brochures and media stories in the field of personal data protection. We also used a questionnaire to determine the degree of awareness of the importance of protecting personal data among the general population. Findings: The findings show that no revolutionary changes are introduced. Nevertheless, quite a few novelties concern data controllers and processors. In particular, penalties for breaching the GDPR are now much higher. Individuals’ rights are strengthened and easier to control. In contrast, data controllers and processors are subject to more stringent duties and legal obligations. These changes also apply to mobile device users. The research findings show that individuals are relatively well aware of the concept of personal data; however, the scope of their knowledge shrinks as this concept becomes increasingly complex. Familiarity with the new Regulation (2016/679) having been introduced at the EU level was claimed by 55% of the respondents (N = 195). Research Limitations / Implications: The limitations stem from the selective choice of the GDPR’s impact on mobile device users. More important influences are emphasised. Originality/Value: The findings will help both individuals and legal entities understand the changes brought to the area of data protection and tackle them more successfully.
