Water protection litigation in Slovenia

Opis: This article explores the possibilities for the private enforcement of the constitutional right to drinking water in Slovenia, enshrined in Article 70.a of the Constitution. Through an analysis of constitutional, civil, and administrative legal frameworks, it identifies both the structural availability and the practical limitations of existing mechanisms. While Slovenia offers several legal avenues for water-related litigation, their effectiveness is often hampered by procedural barriers, evidentiary challenges, and the absence of coherent implementing legislation. Particular attention is given to the role of the Constitutional Court and the underutilized potential of administrative remedies based on the Environmental Protection Act. Civil litigation, though possible in cases of identifiable harm, remains constrained by the inherent limits of tort law. The article argues that for Article 70.a to have meaningful legal effect, legislative reform and more active judicial engagement are essential.

The ban of political parties – an analysis of the criteria developed by the German Federal Constitutional Court and the European Court of Human Rights and their interconnection

Opis: It is possible to ban political parties in many modern democracies. However ideologically extreme they may be, their ban constitutes a violent interference in the political sphere and should therefore only be applied in particularly justified cases. The article analyses the relevant case law of the German Federal Constitutional Court and the European Court of Human Rights. It comes to the conclusion that the jurisprudence of the two courts is closely linked and builds on each other. Moreover, by today’s standards, it is not possible to ban a political party that has an unconstitutional programme, even if it tries to implement it aggressively and violently, as long as it is not in a position to actually implement it, i.e. it does not have the necessary political power.

The “objective test” and the downstream market presence requirement in Big Data access cases under the essential facilities doctrine - a critical assessment

Opis: One possible way to gain access to competitively relevant sets of Big Data is toapply the essential facilities doctrine. However, the European Commission and theEuropean Court of Justice have established several different criteria for applying thedoctrine. Since neither institution has yet applied the doctrine in Big Data accesscases, it is not clear which of the criteria applies in such positions. This paper attemptsto analyze the impact of the “objective test” and the requirement that the controllingcompany be active in the downstream market (which are included in all assessmentcriteria) in Big Data access cases, with the goal of answering the research question,“Do the application of the “objective test” and the requirement that the controllingcompany be active in the downstream market impede the effectiveness of the doctrinein Big Data access cases under EU competition law, and if so, how should they bechanged?” The conclusion is that in Big Data access cases, the “objective test” shouldbe mitigated and replaced by the “subjective test” or the “average company test” andthe requirement that the controlling company be active in the downstream marketshould be discarded altogether in order for the doctrine to be an effective tool foraccessing competitively relevant sets of Big Data.

Targeted advertising and the (children's) right to privacy - remedies of ex-ante and ex-post regulation

Opis: This paper analyses how instruments of economic regulation can be used to protect the right to the protection of personal data, especially in relation to vulnerable societal groups, such as children. In this regard, it analyses the Bundeskartellamt’s Facebook decision that established an unprecedented connection between competition law and data protection law, as well as the Digital Markets Act, which imposes several positive and negative obligations on companies branded as “gatekeepers,” which could also increase the level of personal data protection. It is concluded that instruments of economic regulation can have a profound impact on data protection issues, although addressing them is not their primary goal.

Varstvo osebnih podatkov kot necenovni konkurenčni parameter

Opis: Pravica do varstva osebnih podatkov je v pravu EU pripoznana kot temeljna pravica. Po sodni praksi Sodišča EU vprašanja varstva osebnih podatkov kot taka niso relevantna za konkurenčno pravo. Vendar pa je lahko raven varstva osebnih podatkov za konkurenčno pravo relevantna takrat, ko vpliva na kakovost storitve, ki je necenovni konkurenčni parameter. Takšno relevantnost varstva osebnih podatkov v konkurenčnopravnih presojah je potrdila Komisija EU in nekatere pomembne nacionalne agencije za varstvo konkurence. Varstvo osebnih podatkov se v konkurenčnopravnih presojah zaenkrat pojavlja v povezavi z večstranskimi spletnimi platformami in aplikacijami za pošiljanje sporočil. Pomembna težava, povezana z operacionalizacijo varstva osebnih podatkov v konkurenčnem pravu, je težavno merjenje pomena ravni varstva osebnih podatkov na kakovost storitve.
