Foreign insolvent debtor

Abstract: Creditors in international trade are often faced with issues of an insolvent foreign debtor who often has property and assets in several states. In such a case creditors are faced with difficulties of international collective insolvency proceedings. The introductory parts of the article examines the standard questions like the question of a single, universal property of an individual or legal person and on the other hand the principles of territoriality and universality in public international law as far as the effects of foreign collective insolvency proceedings are concerned. The article then deals with issues of the centre of main interests as the point of contact and issues opened with the application of the lex concursus.

Numerical modeling of floating prefabricated vertical drains in layered soil

Abstract: This paper presents a comparison of field measurements and a numerical model of settlements based on the construction of an embankment on soft soil for the Cirebon Power Plant Project in Indonesia, where prefabricated vertical drains (PVDs) were installed. In the numerical model, floating PVDs in two soil layers for two- and one-way drainage conditions are examined in order to determine the optimum penetration depth. In this study, good agreement between the field measurements of the settlements and the numerical prediction could be achieved. An interesting result of this study is that the differences in the stiffness and/or the permeability in the unimproved area below the PVD tip have a significant influence on the optimum penetration depth (L/H) in the two-soil-layer condition. The numerical study showed that it is possible to use floating PVDs in single drainage conditions if the second layer is stiffer and/or more permeable than the first layer.

Advantages and disadvantages of the single European patent

Abstract: In February 2013, the European Union successfully completed more than 30 years of negotiations and formally signed an agreement establishing a single European patent. The agreement brought about a more competitive patent law compared with that in the United States and Japan. The agreement resulted in a number of advantages, especially for small and medium-sized enterprises, such as the reduction of costs by as much as 80%, simplification of procedures, and the adoption of the Unified Patent Court. With the new unitary patent, intellectual property will grow in importance. Yet experts warn that the new patent results in new forms of unwanted behavior, such as forum shopping and the emergence of patent trolls. This study presents both sides-the pros and cons-to predict the effects on business and cover the widest possible range of experts, providing their views on the topic.

Abstract: This paper presents a comparison of frequency pullability in oscillators using asingle AT-cut crystal and those using two single AT-cut crystals connected in paralleloperated with a series load capacitance or series load inductance at fundamental frequenciesof 4, 10 and 19 MHz. Pullability describes how the operating frequency may be changed byvarying the load capacitance. The paper also gives impedance circuits for both single- anddual-crystal units. The experiment results show that the new approach using two singlequartz crystals connected in parallel increases the frequency pulling range by 30-200% pending on the type of oscillator. Also given is the crystal frequency stability at thesethree frequencies.

A benchmark of lidar-based single tree detection methods using heterogeneous forest data from the alpine space

Abstract: In this study, eight airborne laser scanning (ALS)-based single tree detection methods are benchmarked and investigated. The methods were applied to a unique dataset originating from different regions of the Alpine Space covering different study areas, forest types, and structures. This is the first benchmark ever performed for different forests within the Alps. The evaluation of the detection results was carried out in a reproducible way by automatically matching them to precise in situ forest inventory data using a restricted nearest neighbor detection approach. Quantitative statistical parameters such as percentages of correctly matched trees and omission and commission errors are presented. The proposed automated matching procedure presented herein shows an overall accuracy of 97%. Method based analysis, investigations per forest type, and an overall benchmark performance are presented. The best matching rate was obtained for single-layered coniferous forests. Dominated trees were challenging for all methods. The overall performance shows a matching rate of 47%, which is comparable to results of other benchmarks performed in the past. The study provides new insight regarding the potential and limits of tree detection with ALS and underlines some key aspects regarding the choice of method when performing single tree detection for the various forest types encountered in alpine regions.

Single nucleotide polymorphisms as prognostic and predictive factors of adjuvant chemotherapy in colorectal cancer of stages I and II

Abstract: Colorectal cancer (CRC) is a highly heterogeneous disease regarding the stage at time of diagnosis and there is special attention regarding adjuvant chemotherapy in unselected patients with stage I and stage II. The clinicohistologically based TNM staging system with emphasis on histological evaluation of primary tumor and resected regional lymph nodes remains the standard of staging, but it has restricted sensitivity resulting in false downward stage migration. Molecular characteristics might predispose tumors to a worse prognosis and identification of those enables identifying patients with high risk of disease recurrence. Suitable predictive markers also enable choosing the most appropriate therapy. The current challenge facing adjuvant chemotherapy in stages I and II CRC is choosing patients with the highest risk of disease recurrence who are going to derive most benefit without facing unnecessary adverse effects. Single nucleotide polymorphisms (SNPs) are one of the potential molecular markers that might help us identify patients with unfavorable prognostic factors regarding disease initiation and recurrence and could determine selection of an appropriate chemotherapy regimen in the adjuvant and metastatic setting. In this paper, we discuss SNPs of genes involved in the multistep processes of cancerogenesis, metastasis, and the metabolism of chemotherapy that might prove clinically significant.

Single nucleotide polymorphisms in genes MACC1, RAD18, MMP7 and SDF-1[alpha] as prognostic factors in resectable colorectal cancer

Abstract: Background: Colorectal cancer (CRC) represents one of the most common malignancies worldwide. Research has indicated that functional gene changes such as single nucleotide polymorphism (SNP) influence carcinogenesis and metastasis and might have an influence on disease relapse. The aim of our study was to evaluate the role of SNPs in selected genes as prognostic markers in resectable CRC. Patients and methods: In total, 163 consecutive patients treated surgically for CRC of stages I, II and III at the University Medical Centre in Maribor in 2007 and 2008 were investigated. DNA was isolated from formalin-fixed paraffin-embedded CRC tissue from the Department of Pathology and SNPs in genes SDF-1alpha, MMP7, RAD18 and MACC1 were genotyped using polymerase chain reaction followed by high resolution melting curve analysis or restriction fragment length polymorphism. Results: We found worse disease-free survival (DFS) for patients with TT genotype of SNP rs1990172 in gene MACC1 (p = 0.029). Next, we found worse DFS for patients with GG genotype for SNP rs373572 in gene RAD18 (p = 0.020). Higher frequency of genotype GG of MMP7 SNP rs11568818 was found in patients with T3/T4 stage (p = 0.014), N1/N2 stage (p = 0.041) and with lymphovascular invasion (p = 0.018). For MACC1 rs1990172 SNP we found higher frequency of genotype TT in patients with T3/T4 staging (p = 0.024). Higher frequency of genotype GG of RAD18 rs373572 was also found in patients with T1/T2 stage with disease relapse (p = 0.041). Conclusions: Our results indicate the role of SNPs as prognostic factors in resectable CRC.

Polymorphism of the IL13 gene may be associated with uterine leiomyomas in Slovenian women

Abstract: Uterine leiomyomas (ULM) are a common cause of solid pelvic tumors in women. Their etiopathogenesis remains unclear. Interleukins (ILs) and their receptors can influence tumor biology of ULM. The aim of this study was to evaluate single nucleotide polymorphisms (SNPs) exhibited in the genes IL4 (rs2070874), IL4R (rs1801275), IL12RB1 (rs11575934), IL12B (rs6887695), IL13 (rs20541) and IL23R (rs7517847) as risk factors for ULM in Slovenian women and to identify associations between corresponding clinical parameters and the analyzed SNPs. In addition, solitary and multiple ULM were compared to identify clinical and/or genetic parameters influencing their occurrence. We conducted a case-control study that included 181 women with leiomyomas and 133 control subjects. Genotyping of selected SNPs was performed using polymerase chain reaction-restriction fragment length polymorphism (PCR-RFLP) and high resolution melting (HRM) techniques. The TT genotype of rs20541 (IL13) was significantly associated with decreased risk of ULM compared to both the CC and CT genotypes [p = 0.018; odds ratio (OR) = 0.184; 95% confidence interval (95% CI) = 0.048-0.7121. Using genetic and clinical data to develop a predictive model with logistic regression, we found that adenomyosis, higher age at diagnosis, family history of ULM occurrence, earlier menarche, lower number of pregnancies and lower age at first sexual intercourse, the G allele and genotypes AG and GG of rs1801275 (IL4R) were associated with an increased risk of multiple ULM occurrence. We also found an association between rs20541 (IL13) and 17ß-estradiol serum levels in patients with multiple ULM (p 0.003). Our study showed, for the first time, that rs20541 (IL13) may contribute to susceptibility of ULM development and that rs1801275 (IL4R) can predispose patients to develop multiple ULM.

Vergleich des Morphologieerwerbs bei Kleinkindern und Erwachsenen

Abstract: In dieser Diplomarbeit wurde der Schwerpunkt auf einen Teilbereich der Morphologie, den Plural, gelegt. Die Pluralmarkierung deutscher Substantive gehört mit Sicherheit zu den schwierigsten Bereichen, die ein Nicht-Muttersprachler als auch ein Muttersprachler im Laufe der Aneignung der deutschen Sprache zu bewältigen hat. Im theoretischen Teil der Arbeit wurden einige theoretische Grundlagen gelegt. Zuerst sind einschlägige Spracherwerbstheorien und die Entwicklungsphasen des Grammatikerwerbs beschrieben worden. In den folgenden Kapiteln wurde, als Teilaspekt im kindlichen Spracherwerb, der Plural näher beschrieben. Für den Pluralerwerb existieren nämlich mehrere Modelle, die sich entweder an den Grundkonzepten der Dual-Route-Modelle oder der Single-Route-Modelle orientieren. Weiterhin konnten anhand des Pluralerwerbs noch die möglichen Pluralmarkierungen, ihre Fehlbildungen und die Pluralbildung an Kunstwörtern näher beleuchtet werden. Den Fokus dieser Diplomarbeit bildet der empirische Teil, in dem anhand der Spontansprachdaten (CHILDES Korpus) von zwei Kindern (Erstsprache = Deutsch), deutschen Erwachsenen (ZEIT-Textkorpus) und den Aufsätzen von slowenischen Deutsch-als-Fremdsprache-Lernern (Grundschülern, Mittelschülern und Germanistikstudierenden) mit den Computerprogrammen CLAN (Computerized Language Analysis) und AntConc die Präferenzen und Übergeneralisierungen der Pluralmarkierungen analysiert wurden. Als Abschluss sind die Ergebnisse der Analyse dargestellt, diskutiert und die Ausgangshypothesen bestätigt bzw. verworfen worden.

Raziskave interakcij med celicami in biopolimernimi materiali z naprednimi eksperimentalnimi metodami kot osnova za študij biokompatibilnosti polimerov

Abstract: The last two decades have been determined by the development in the field of tissue engineering. Beside the constant progress in new biomaterials and scaffold fabrication methods, currently the main focus is to understand scaffolds biocompatibility. In our thesis, physical aspects of scaffold biocompatibility were studied by correlating molecular to macro scale physical properties of scaffolds with cell attachment and cell growth. In order to focus on scaffold physical properties, scaffolds were prepared by the same chemical composition of natural polymer gelatin excluding biochemical effects on the cell response. Scaffold with different physical properties were obtained by changing the temperature, pH and crosslinker degree during the cryogelation and populated by the fibroblast cells. Advanced experimental biophysical methods were applied to determine the polymer mobility via electron paramagnetic resonance (EPR) with spin labelling, the scaffold mechanical properties via rheometry, dynamic mechanical analysis (DMA) and nanoindentation using atomic force microscope (AFM) and the scaffold porosity via confocal fluorescence microscopy (CFM). The anisotropy of the molecular mobility of the side chains of polymers in the crosslinked gelatin structure was found to correlate with the initial cell growth (throughout the first week) the best of all the physical properties measured. About five times less efficient cell growth was measured on the scaffolds with highly mobile, spatially nonrestricted dynamics of the polymer side chains, in comparison with cell growth on the scaffolds with the restricted rotational motion of polymers. The result indicates that cells identify and respond to the degree of polymer mobility, where partially immobile phase is necessary for efficient cell attachment and efficient cell growth. So far, the molecular mobility of polymers constituting tissue engineering materials has never been studied thoroughly with respect to its influence on cell response, and therefore may represent a new experimental approach in understanding biocompatibility. To further understand cell-scaffold interaction, the study focused also on the first events during cell attachment - bond formation between the cell surface proteins and the specific binding sites on the material. In our thesis, cell adhesion dynamics was investigated in real-time on the surfaces of gelatin scaffolds with different physical properties using spatially-controlled cell manipulation by the optical tweezers and the confocal fluorescence microscopy detection. Our goal was to elucidate, if the adhesion dynamics can be correlated with cell growth and if it can be dependent on the scaffold polymer molecular mobility. Quantitative characterization of the optical tweezers force applied during cell-scaffold adhesion analysis was done by viscous drag force calibration and dynamic cell sequential trapping of individual cells. The maximal force on a trapped cell not causing the thermal damage was measured up to 200 pN, with nearly linearly increasing force profile across the cell towards the plasma membrane. By submicron spatial resolution of cell manipulation, we managed to quantify probability of cell adhesion, cell adhesion strength and mechanism of cell attachment, including the formation of the membrane tethers, which slow down the adhesion process. Adhesion strength was classified according to the displacement of the attached cell under the force of optical tweezers measured in the direction of the scaffold surface.Cell adhesion was shown to significantly correlate with cell growth in the first days of culture, while the adhesion itself seems to be dependent on the molecular mobility of surface polymers. The result indicates that the interactions during the first seconds may markedly direct further cell response. The developed methodology for cell adhesion analysis on the surfaces of 3D scaffolds serves as a good tool to forecast scaffold biocompatibility.
