5th International Conference EnRe - Energy & Responsibility : book of extended abstracts

Abstract: The tendency to improve energy devices, the impact of environmental factors and the development of new technologies for the exploitation of sustainable resources contribute to the fact that we have witnessed intensive energy development in the last decade. The two most important Slovenian energy pools, located in Velenje and Krško, are at the turning point of renovation, and are facing major challenges in the design and planning of modern energy devices. The current generation faces a great ethical responsibility to leave their descendants a world with as little human impact on the environment as possible. Therefore, communication between experts and researchers, discussion and exchange of different views for the future is of the utmost importance, which is exactly the purpose of the EnRe Conference.

Izzivi pri vzpostavljanju trajnostne oskrbovalne verige palmovega olja

Abstract: V diplomskem delu obravnavamo tematiko palmovega olja, njegove oskrbovalne verige in okoljske probleme, ki jih povzročajo zahteve po palmovem olju. Ker se populacija iz dneva v dan veča in s tem tudi povpraševanje, je pomembno vpeljati spremembe pri tej problematiki. Ključnega pomena bi bilo iskanje novih alternativ in prizadevanje za trajnost palmovega olja. Analizirali smo oskrbovalno verigo palmovega olja in probleme, ki jih nove plantaže predstavljajo okolju. V empiričnem delu smo podjetja spraševali po trajnosti, certifikatih, okoljskih problemih in alternativah. Zanimalo nas je, ali podjetja stremijo k zeleni politiki. Raziskavo smo izvedli s pomočjo ankete, ki smo jo podjetjem poslali preko e-pošte. Podrobno smo želeli raziskati rabo palmovega olja v praksi, jo kritično ovrednotiti in poiskati možne trajnostne rešitve. Izkazalo se je, da je trajnost podjetjem pomembna, vendar le do trenutka, ko še bistveno ne vpliva na zaslužek. Anketirana podjetja poznajo posledice, ki jih palmovo olje povzroča. Kljub negativnim posledicam jim je pomembnejša kvaliteta in nizka cena. Ugotovili smo, da pravih alternativ, ki bi lahko nadomestile palmovo olje, ne poznamo.

The argument for choosing state's judicial system or a "private" outsourced resolution of disputes : a practising attorney's point of view

Abstract: Terms such as arbitration, mediation, conciliation and alternative dispute resolution (ADR) are nowadays standard terms in any classroom textbook on civil procedure. Legal scholars enumerated and assessed in depth the advantages and disadvantages of any type of outsourced dispute resolution. However, a number of legal writers still fail to enumerate the exact differences in course of events and all of the trade-offs that a party will have when deciding to resolve the dispute using an outsourced dispute resolution. Clearly the costs, the celerity and the flexibility are important issues. However, the decision is not influenced solely by legal arguments. This paper will mention some typical Slovenian issues in an assessment of the choice of dispute resolution. If parties want to continue to remain in good terms after the dispute, then an outsourced dispute resolution is highly recommended. Judicial rulings are to binary; one party wins, one loses.

Possibilities of mediation in Republic of Serbia in cases of domestic violence

Abstract: Purpose: This paper analyses the theoretical, legislative and practical advantages and limitations of mediation as an alternative way of resolving the conflict between perpetrator and victim of domestic violence in Serbia. Starting from the premise that mediation in lighter cases of domestic violence is more preferred form of social reaction from the initiation of criminal proceedings; the authors analyse the legislation of the Republic of Serbia and point out that the mutual incompatibility of laws disables use of mediation in practice. Design/Methods/Approach: Based on acceptability of the concept of restorative justice, this scientific work analyses the advantages and limitations of mediation as an alternative way of resolving the conflict of the offender and the victim in cases of domestic violence. Authors use the comparative method, legal dogmatic method, case study method (examples for court practice in Serbia) and statistical data to examine the hypothesis that mediation may constitute a constructive way of resolving less violent conflicts within the family members and why is not enough applied in practice. Findings: Modern criminal political orientation of the “zero” tolerance of domestic violence, which was adopted in law in practice in Serbia is “blocking” use of mediation, which, in public opinion, is seen as an inadequate response to this crime. Results of the analysis show that the Serbian legislature opted for a punitive response and measures of restraining as most important mechanisms for the prevention of domestic violence. Research Limitations / Implications: These data provide insight into the marginal segment of the formal response to domestic violence in Serbia. Originality/Value: Few studies in Serbia comparing foreign experience and domestic social possibilities for the success of mediation in cases of domestic violence.

Resolving intellectual property disputes

Abstract: Within recent decades, increasing the complexity of international trade has resulted in changing many dimensions of doing business with other nations and relevant problems to it. Rising the importance of intellectual property rights as intangible assets of companies is considered among most important characters of modern business process which applies to multinational enterprises and other forms of companies who intend to enter the global market place equally. Benefiting from global marketplace and at the same time protecting IPRs is a difficult goal to achieve due to intangible and diverse nature of such rights which results. In practice of international trade, there is high probability for companies to face with IPR related disputes. Therefore, choice of proper IP Dispute Resolution mechanism is an important step in designing overall IP strategy of the firm as an improper IP dispute resolution method can impose high financial costs as well as affecting reputation of the firm. Current paper tries to answer to the question of what is the most suitable dispute resolution method for IP related disputes. And in order to achieve this objective, paper explores different types of IP disputes, different approaches for resolving IP disputes, factors affecting the choice of method for resolving IP disputes and finally, it will analyse application of dispute resolution mechanisms in different types of IP related disputes.

Some observations regarding cross-border debt collection in consumer disputes

Abstract: Cross-border debt collection in consumer dispute leads to many difficulties. The main one is the access to justice as consumers are generally not aware of their rights and legal proceedings may be expensive. The major difficulty in order to sue a counterpart based in another Member States is the determination of the competent court. However, this private international law issue is the first step in order to bring a legal action. This action may be disproportionate, on time and value, in comparison with the amount of the debt a consumer wants to recover. As a result, the European Commission has adopted the Directive 2008/52/EC on certain aspects of mediation in civil and commercial matters which aims at facilitating cross-border disputes involving consumers. After recalling the main characteristics of the Directive, author also discusses online mediation, that can also lead to more effective results.

Feed intake, body weight changes and haematology of West African dwarf goats fed dietary levels of Moringa oleifera leaf meal

Abstract: A 90-day study was carried out with 36 West African Dwarf goats to determine the effect of Moringa oleifera leaf meal (MOLM) on feed intake, body weight changes and haematology of WAD does. Four diets were formulated such that diets T1, T2, T3 and T4 contained MOLM at 0%, 5%, 10% and 15%, respectively. The diets were offered to the goats, which were randomly divided into four groups of nine goats each in a completely randomized design. Average daily feed intake (ADFI), average daily weight gain (ADWG), feed conversion ratio (FCR) and heamatology of the animals were determined and statistically analyzed. Results showed that ADFI, ADWG differed significantly (P<0.05) with T4 goats having better values. FCR was however best for does fed T4 diet. PCV, RBC, MCV and WBC differed (P<0.05) significantly among the treatments. Packed cell volume (29.50-32.75%) was improved (p<0.05) by MOLM supplementation at 15% inclusion level. White blood cell counts for goats in treatment groups were significantly (p<0.05) higher and better than the control. Incorporation of 15% MOLM in diets of WAD does enhanced their performance and heamatological profile. Moringa oleifera leaf meal supplementation level at 15% was recommended for optimum West African Dwarf goat production.

New type of roundabout: dual one-lane roundabouts on two levels with right-hand turning bypasses - "target roundabout"

Abstract: The problems of low level traffic safety on multi-lane roundabouts have been resolved in various ways in different countries, usually by using alternative types of roundabouts that reduce the number of conflict points. Alternative types of roundabouts typically differ from "normal" or "standard" roundabouts in one or more design elements, as their implementation purposes could also be specific. Today, several different types of roundabouts are already in use ("mini", "double mini", "dumb-bell", those "with joint splitter islands" ("dog-bone"), those "with a spiralling circular carriageway" ("turbo"), those "with depressed lanes for right-hand turners" ("flower") etc.). This paper introduces a new type of roundabout, dual one-lane roundabouts on two levels with right-hand turning bypasses, namely the "target roundabout". This paper describes and analyses their design, traffic safety, and capacity characteristics, compared with the standard two-lane roundabouts.

Primerjalna analiza zavarovalnih in pozavarovalnih poolov

Abstract: Zavarovanje pred določenim tveganjem olajša posledice, v kolikor pride do uresničitve tega tveganja, in s tem zagotovi določeno stopnjo varnosti. Vendar so katastrofalna tveganja posebna, saj je možnost njihove uresničitve izjemno majhna, ob uresničitvi pa za seboj pustijo škodo izjemnih razsežnosti. Prav zaradi tega je omenjena tveganja težje zavarovati, saj odstopajo od pogoja, da škoda pri zavarovarljivem tveganju ne sme biti katastrofalna. Zato se mnoge zavarovalnice izogibajo zavarovanju tveganj, kot so jedrske nesreče ter teroristični napadi. Zavarovanje takih tveganj bi za posamezno zavarovalnico predstavljalo prevelik zalogaj. Zato se na področju zavarovanja katastrofalnih tveganj že več desetletij pojavljajo zavarovalni in pozavarovalni pooli. Gre za skupine več zavarovalnic in pozavarovalnic, ki združijo svoje kapacitete in skupaj zavarujejo obsežna in specifična tveganja. Zavarovalni in pozavarovalni pooli so specializirani, zato poznamo različne vrste poolov. Med bolj znanimi so jedrski in farmacevtski pooli ter pooli za terorizem, lahko pa delujejo tudi na drugih področjih. Kljub določenim prednostim imajo pooli tudi slabosti, zato so s strani poznavalcev pogosto kritizirani. V sklopu magistrskega dela se ukvarjamo z vprašanjem, ali so pooli še vedno edina in najboljša možnost zavarovanja katastrofalnih tveganj ter ali obstajajo alternative, ki bi poole lahko uspešno zamenjale na njihovem področju delovanja. Zavarovalni in pozavarovalni pooli se na trgu pojavljajo različno dolgo, najpogosteje v sektorjih energetike, letalstva, terorizma. Nekateri od poolov so v posameznih državah prenehali poslovati, drugi še vedno poslujejo, nekateri se šele ustanavljajo. Mnogi poznavalci omenjenega področja so začeli razvijati alternativne možnosti, ki bi lahko zamenjale poole. Obstajajo različne alternative, med drugim specializirani zavarovatelji, vzajemne lastne zavarovalnice, prav tako pooli posrednikov, so(po)zavarovalni sporazumi itd. Nekatere od naštetih možnosti na določenih področjih delovanja in v posameznih državah poole že nadomeščajo oziroma dopolnjujejo, druge so manj pogoste, a imajo prihodnost. Vsak trg namreč nima enakih potreb in možnosti za razvoj in uvedbo vseh alternativ, zato se njihova prisotnost med državami precej razlikuje. Kljub vsemu pa je ključno spoznanje, da pooli niso edina možnost, čeprav se velikokrat smatrajo prav za slednjo. Pooli pogosto ne veljajo za najboljši, niti najučinkovitejši način zavarovanja katastrofalnih tveganj, mnogokrat so le edina možna izbira. Kritiki želijo spremembe, izboljšave, možnost skupnih poolov (npr. pool na območju Evropske unije). Kljub vsemu pa so pooli na mnogih področjih čvrsto zasidrani in ohranjajo svoj pogosto monopolni položaj, ki ga ne bodo zlahka prepustili konkurenčnim alternativam. V sklopu magistrskega dela se dotaknemo poolov kot možnih udeležencev zavarovalnega trga, nato pa se posvetimo značilnostim katastrofalnih tveganj ter možnostim njihovega zavarovanja. Katastrofalna tveganja so pogosto nezavarovarljiva s strani posameznih zavarovalnic, zato jih zavarujejo pooli. Sledi definicija poolov ter opis izbranih vrst poolov. Pregledu prednosti, slabosti ter kritik delovanja sledijo alternative poolom. Sledi predstavitev delovanja poolov v praksi, s poudarkom na slovenskem jedrskem poolu. Ob koncu analiziramo poole na območju EU po različnih kazalnikih in jih medsebojno primerjamo.

Abstract: Živimo v obdobju finančne negotovosti, kjer finančno načrtovanje vse bolj postaja prej nuja kot potreba. Trenutne razmere in vsa negotovost povzročajo, da se ljudje vedno bolj ukvarjajo s svojimi financami in ob tem čutijo potrebo po njihovem upravljanju. Ker država vedno več obveznosti prelaga na svoje državljane, narašča tudi vse večja potreba po socialni varnosti. Potrošniško usmerjena družba nas dnevno sili k potrošnji, zato poznavanje področja osebnih financ in njihovega upravljanja postaja ključnega pomena.
